This happened some years ago.....

I was on my way to the Taco Bell cuz I only had $4.00 until payday, which was a couple days away. I was completely broke and being that you can buy 8,000,000 tacos with $4.00 Taco Bell seemed like the best choice.

I walk inside and order my food. I hand the woman my money, expecting .80 cents in change. Well the woman hands me two $20s. I looked down confused and said "That's not my change." She pushed it towards me. Again I said, "That's not my change, I only gave you $4.00. My change is 80 cents." She replied "And?" then pushed the money towards me again. So I took it, grabbed my food and went on my merry way $40 richer.

Did I do something wrong?

NOPE,money isnt just handed to you very often. So when it does grab it.
If you found $50,000 in a brief case and found out it was drug money would you return it?

What could you do? You could have made a fuss and refused to take it, but that might have gotten her in trouble. Honestly, I would have walked and given the cash to a homeless dude.

Thing is, i don't know what the legal situation in the US is, but I suspect this would constitute theft in the UK, because the woman was clearly acting outside her authority in giving you the cash. That is to say, she was not acting on behalf of Taco Bell when she gave you the $40. And since you were well aware that the $40 was an error, you should return the cash. Same as if you notice your bank accidentally credits you with $1,000. You should own up.

In reality though? smile

like theFrog said, from a legal standpoint, it is theft.
but in that scenario u didn't have much of an option.
i suppose u could have left it on the counter and
walked away. but knowing you, I think it was a
gift from God. Truly.
