Despite the best efforts of Judge Elden Fox to try and exert his judicial powers by attempting to force to endure a 30 day jail sentence by remanding her to jail without bail on a misdemeanor charge, Appeals Judge Patricia Schnegg has overturned Judge Fox's ruling and ordered that Lindsay MUST be allowed to post bail for her misdemeanor infraction. As a result, just hours after L. Judge Schnegg ruled that, "as a matter of right", Lindsay must be afforded the same opportunity to post bail on a misdemeanor charge and (10% of) $300,000. later she is, once again a free woman:

Now that Lindsay is free, again, she must once again wear a court-ordered alcohol-monitoring SCRAM bracelet and will be required — again — to refrain from drinking and must — again — submit to random drug testing. Tho, if yesterday's shenanigans are any indication, there is no real inhibitor to keep Lindsay from drinking or taking whatever the Hell she wants … as long as she can pay her way out of jail, she's pretty much got free reign. On the plus side, tho, yesterday's jail stint was her second longest because as you may recall, she was only jailed for about 84 minutes the first time she was incarcerated back in 2007. Lindsay will still have to return to court on October 22 to face Judge Fox again … and very well could be arrested and thrown back in jail — again. But if I were the Teflon Girl like Lindsay Lohan, I wouldn't sweat it for one second. The girl seems unincarcerateable. Let's hope this uncanny ability to avoid punishment won't lead to her early demise.
And that in a nutshell sums up why she is failing to get sober. Until Lindsay gets rid of all the people enabling her addictions, she will never get well.
