A prenup only protects his assets before the marriage not anything amassed during the marriage. It looks like they were married for 15 years so she's entitled to get half of his shit while they were married. lol

that depends on the state your in.

I believe that's how it works in NY and I also think it's a no-fault state where infidelity is concerned.

people can also put clauses in their prenup that cover things such as cheating. you can have your spouse "sacrifice" his or her claim to your earnings in the case of infidelity.

Dude seriously needs to get over the broken heart and the fact that he donated his kidney to someone who broke his heart. A boo hoo.

Tying up the courts under these pretenses is pathetic and ridiculous....and as shitty as this sounds...very American.

let's say he's honest and it's about cheating.

would you give it to him?

i've seen people label men who cheat all kinds of nasty things on this board but seem to give a woman a pass when she does.

I don't believe in suing for emotional distress. It sucks that she cheated but that's life, that doesn't mean someone owes you money.

No the Today show was just reporting the story, the husband was specific, he didn't cheat. He said his heart was broken and all whining. I think she dissed him. I don't think he beat her, I just think she left him for another man and his pride couldn't take it.

BUT.... If I give MY kidney to a spouse and they want to divorce me after I give my ^&#@@&@^ kidney to him, then a fucker needs to pay me for that quality of life that he is now enjoying with someone else. wink
[Edited 1/8/09 6:15am]

she shouldn't have to pay him anything. especially if he's going on TV, crying like a wuss, and spilling their business for everyone to see. that man is a damn fool. just because you're a fool doesn't mean you should get paid for it.

Enjoying your new Kidney I see.

I've been wondering how binding fidelity clauses are cuz it seems at odds with no-fault divorces.

If they've been married that long and she was taking care of his kids, the shit is hers too. Regardless of who the breadwinner is it's community property depending on where you live. shrug

No. and it has nothing to do with giving his wife a pass on the cheating. Cheating is wrong no matter who does it. But just because someone gives you their kidney, doesn't mean that you should stay in an unhappy relationship with them. She wanted out and she left. This dude needs to talk about his emotions with a therapist or a good friend rather than a TV crew.

This reminds me of a teacher in Durham, NC that gave one of her kidneys to a student. Then three years later the little ungrateful fucker is a 17 year old criminal robbing gas stations.
