MAN SUES FLORIST FOR REVEALING AFFAIR

HOUSTON (Aug. 10) -- A married man is suing 1-800-Flowers for $1 million for revealing that he was cheating on his wife.
Leroy Greer said in a lawsuit filed this week in a federal court in Texas that he bought flowers for his girlfriend through 1-800-Flowers. He asked to keep his purchase private.

Greer said he was referred to the company's privacy policy, which states that customers can ask 1-800-Flowers not to share personal information with "third parties."

But, the lawsuit says, 1-800-Flowers sent a thank-you note to his house and his wife saw it. When she called the company, 1-800-Flowers faxed her a copy of the receipt from Greer's secret purchase.

The receipt revealed that Greer had sent another woman a dozen long-stemmed red roses, along with a note that read, "Just wanted to say that I love you and you mean the world to me!" according to court documents.

The couple was already going through what Greer's attorney described as an amicable divorce.

After learning of the affair, Greer's wife asked for a $300,000 divorce settlement in addition to child support, said Kennitra Foote, Greer's attorney.

"That thank-you note is going to cost him money," Foote said.

Greer is asking for $1 million for breach of contract and deceptive trade practices.

"This is not a moral issue," Foote said. "The issue is, is 1-800-Flowers in the business of causing divorce or are they in the business of sending flowers and sticking to their privacy policy?"

A 1-800-Flowers spokesman said the company does not comment on pending litigation. In a statement, spokesman Steven Jarmon said, "We take all matters relating to our customers seriously; however, we are not responsible for an individual's personal conduct."

Maybe this will make people who run businesses
think twice about flapping thier gums about thier clients.

People dont value thier own privacy, let alone other peoples privacy.

In fact people seemed to get offended when you value your own privacy.

That reminds me of the call-in radio show that blew open a husband's affair to his wife on the air by falsely promising him tickets to a Beyonce concert -- as his wife listened. Anyone have the link to that? It was hilarious.

i don't think it's a violation of their privacy policy to send a thank you note to the house and to fax the receipt to a person whose name may have very well been on the credit card and who resides at the house.

this guy is an ass. i hope the case gets thrown out.

Thank u note ...I agree but sending anyone other than the purchaser a copy of the receipt and the note that was attached is

I don't think the case will get thrown out. I've ordered many flowers in my day, and I've never received a thank-you note from that company. They were trying to get him caught, I believe.

Especially after he went through the trouble of emphasizing the importance of privacy. Certainly, his motives were dubious, but I think the company acted with malice. I think a judge or jury might find the same.

that was a phoney call but it was a fantastic listen!
just google "won't use the mouth" or something like that.


as far as this case, the thank you note could have been legit
but the employee should certainly not have provided anyone else
even from the same address the information... let alone a copy of
the gift card. i can just imagine some flustered middle aged woman
trying to do the right thing by the person on the other end of the phone
and getting in deep deep shit for doing so.

That's good for them, I hate that shit.mad They should've adhered to their own policy. What if it wasn't his wife and just someone pretending to be her? I bet you 1800Flowers will blames it on the employee that gave her the information.

Sadly, it's just as easy to imagine an embittered divorceé deliberately sending the thank-you note to the customer's home, in the hope of scoring one for the home team. Violating privacy maliciously? That company's going to pay, I suspect.

i wish i knew how to post it but; there's a radio show where the station was teasing a woman about her husband and joking that he was sleeping with the secretary or someone in his office. the man was in the station listening with the dj. as the woman get's irrate she says..."wait til he gets home. and now i don't feel so bad about sleeping with his brother!"

Maybe he put the flowers on a joint credit card, and the wife was entitled to info on a purchase, that the florist needed to prove was made?
Maybe the new GF sent the "thank-you" card so the wife would find out?.....the plot thickens.... smile

i 800 flowers does it automatically. i know a couple people who sent flowers from them and got a thank you card in the mail as well. i heard they have horrible customer service though. but if he did use a joint credit card he may lose.

There's so many things wrong with this, where do I begin?

1.Best way to keep a purchase private, pay CASH. Duhhhh.

2."his house"?? Was the wife visiting "his" home when the mail was received?

3.The florist didn't CAUSE the divorce, it was already in progress.

4.Even if the credit card was not under both their names, chances are, the roses would have been discovered. Sounds like the couple were still living together. When hashing through a divorce, where the $$$$ is spent, who earns what,finances,etc. is dissected. I know I would, anyway... wink

I do not blame 1-800-Flowers, and I do not see this as a breach of contract.

It's easy to see how they could have assumed that his WIFE is not a "third party". SHE IS HIS WIFE. By law she has access to just about everything he owns. Obviously she must have had a reference number or order number from the Thank You note. I can't blame them. HE was being sloppy.

Send the damned flowers from a local florist and pay in cash. IDIOT.

...in fact...I wouldn't be surprised if this was somehow staged and they are going to split whatever settlement he gets. "Amicable divorce" right?

And based on the overwhelming support and sympathy expresssed for this idiot on this thread, he's definitely going to make a killing.

Women calling up to ask about purchases on their joint account that both names were on only to find out their husband had been purchasing flowers, lingerie, etc. Stuff they never got.
