this doesn't add up... disbelief

Wife could serve 60 days for killing preacher

SELMER, Tenn. — The Tennessee woman charged with killing her minister husband with a shotgun was sentenced Friday, but may never see another day behind bars.
Mary Winkler was sentenced Friday to three years for the killing of her husband Matthew, but only 210 days of the sentence "in confinement." After subtracting nearly five months of time already served, Winkler may not have to return to prison.

She must however spend "up to 60 days in an appropriate facility that will address her mental health treatment," according to Judge Weber McCraw.

"The defendant is hereby sentenced to a term of three years. Her sentence is to be served in split confinement with 210 days of incarceration, with appropriate credit to be given for time served, and the balance of the sentence to be supervised by state probation," McCraw said.

"Additionally, and subject to further discretion of the court, the court, as a means of addressing the defendant's mental health needs, will consider allowing the defendant to serve up to 60 days of this confinement in an appropriate, court-approved facility," McCraw said.

Winkler, 33, was convicted of manslaughter in April and could have received up to six years for killing her husband, Matthew, in the parsonage where the family lived in March 2006.

At her trial she testified she was physically and emotionally abused by her husband, but at her sentencing hearing Friday she said, "I think of Matthew every day, and I'll always miss him and love him."

She pleaded to the judge for leniency, and asked to be reunited with her three daughters, who are now in the custody of Matthew Winkler's parents.

eek hmm i don't get this?? that seems like a pretty light sentence

then again if she killed him in self defense, and had the scars/bruises/burns to prove it, that really changes things. especially if he had been abusing the children.

self defense only works for me if he was abusing her at the time of the murder, or very shortly after (like he did it and then went into the next room). other than that, pack your bags and bounce up out of there. ithink he was behind a desk when she killed him--that sounds kinda non-self defense to me.

i'd be salty if i were his parents..."oh i shot your son..can i have my kids back now?" disbelief

She did spend 5 months in prison already though.

But I agree... this whole Paris Hilton thing shows that the American public and media is just overly stupid... easily distracted from true injustices and problems. Let's blame the rich celebrity for all our problems!
