Daryl Hall files restraining order against John Oates

Variety reports...

Hall & Oates are embroiled in a confidential legal battle that has led to Daryl Hall getting a restraining order against his former music partner John Oates.

Little information about the lawsuit is publicly available, as the court documents are sealed, but based on court records, Hall filed an undisclosed complaint against Oates on Nov. 16, as well as a motion for a temporary restraining order, as reported by Philadelphia magazine. The following day, the court officially issued a temporary restraining order to begin Nov. 30.

As TMZ points out, Hall disparaged Oates on Bill Maher’s “Club Random” podcast last year, saying, “You think John Oates is my partner? … He’s my business partner. He’s not my creative partner.”

He went on, “John and I are brothers, but we are not creative brothers. We are business partners. We made records called Hall & Oates together, but we’ve always been very separate, and that’s a really important thing for me.”

Yeah I remember watching that episode when it came out and being a little suprised. He honestly came off as a bit of an ass but who knows?

Wow! I have seen recent Daryl Hall interviews and when he is asked about a new Hall and Oates album,he kinda gets defensive and angry eek these days,it seems like he wants to focus on his solo music.But I didn't really know that there was any tension between them.

I was telling Fenwick today that I've noticed his angsty shit lately when Oates is brought up. It feels like a really bad ego trip, honestly.

Yet he defended Oates on Stern in recent years when Stern tried to dismiss Oates as a non-entity in the band or not having talent. Then Hall goes in about how Oates wrote things like "Maneater" or whatever.

He just seems really bitter for some reason. Maybe he hung out with Paul Pesco too long.

It's an odd situation and suprisingly it happens just as he starts Daryl's House again, I wouldn't be shocked if this is over royalties and maybe a catalog sale of their music or John just being pissed off that he is tacked on as a name slapped on like a hired hand. Sorry to say regardless of how little he may have done on songs, the name hall and Oates sells the name Daryl Hall does not sell in the same way, he's done some good solo stuff and some crap stuff. They ironically played shows recently and I get it they are a business and partners in that business like it or not like I said hall and Oates sells tickets.

And Daryl's House isn't the same as it used to be. Yet he's been uploading these older shows, really grainy and not great resolution, to YouTube lately. No harm in re-monetizing those things, but fuck - is there not a better copy somewhere??

I had seen the interview he did with Maher back then and thought about it more now because he did say a few things like "that's me that's just me" and "we are business partners" so I should have realized it then but didn't think much cause those Maher interviews are very off the cuff that's the whole idea but DH seemed to have some venom inside at times and I don't give the alcohol pass though that may make you more hostile for some it doesn't make you say untrue things you never think it's just your judgement to not say it out loud isn't there or impaired or your way to phrase it is off, but alcohol didn't make DH say I di this John didn't do anything. Maybe there were past times of this we don't know of, I'm sure that happened and John just had enough. But in his defense like it or not Hall and Oates is the name and why people go to your shows, so if you want to break up or never tour together ok but if you think you can erase the Oates from hall or vice versa sorry you're stuck dude.

yeah one of my favorites is with Tommy Shaw of STYX mainly because not one guy there can come close to Tommy's notes, as good as Daryl is vocally Tommy's high notes are another level and still are for him, but the video quality of these shows is awful

TMZ is now reporting that the lawsuit/restraining order is over what songs John Oates is allowed to sing during his solo shows.Apparently Daryl feels that,since he wrote most of the songs,that John shouldn’t be able to perform them without him.I know that John recently recorded a reggae version of “Maneater” with some reggae artists,perhaps Daryl is pissed about things like that?

It turns out now more of a twist here, is that this "restraining order" is to block a sale of a company that has ownership of Hall and Oates in some way, John is trying to sell his part and Daryl is trying and has blocked that.

That sounds more like an injunction, not a restraining order. But to just let things out to the press like "begging" for a restraining order is shady as fuck. They don't even live in the same goddamn time zone. I think Oates lives in Colorado or something, and Hall is up here in the northeast.

I kept hearing Hall didn't want Oates performing his songs. I thought, that's stupid. Every band does covers, so let Hall think Oates is just covering his music. However, that'd make Hall charge Oates to perform songs he's already the artist on.

You'd think with the amazing legacy this band has, that Hall wouldn't really care who's thinking what about whichever song. We can see the credits, we hear the voices. We know what's what for fuck's sake.

Ahhh, now see. THAT is 100% more sensible as to the hubbub of it all.

I doubt Hall can buy him out without a loan from some entity. Oates is obviously getting a lot less in songwriting royalties (which likely pays more than performance royalties). I think about MJ borrowing against his Sony catalog and staying in debt from it. I don't know if Hall would ever really come out on the other side if he tried to finagle a deal to let Oates out.

Oates is 75 years old. He has maybe 20 more summers in front of him, at best. Frankly, I'd cash out too and just live as comfortable and carefree as I could until I left this planet.

And with Hall being kind of a big-headed dick about things, I'd almost want Oates to sell just to piss him off. lol But there has to be a sensible resolution to it.

Overall there was a lot of bad business done. And also these two spent a ton of time together during a HUGE part of their lives and want to do other things. I mean the fact that the two of them have not had a new studio album since 2003 (except for a covers record and Xmas album) they are creating anything together so its almost like beating a dead horse at this point. In the article Daryl regrets selling any publishing which he sold some in 2006, he does still own some but not that much which is your bread and butter at the end of the day. So bad busines is no stranger to this band, Oates had filed bankruptcy some years back, he owned cars, planes and homes and sold it all, its nothing new here.

A few years ago,Daryl released a 2-CD compilation of his solo material.I really enoyed it.I wasn't really familiar with much of his solo stuff and I was pleasantly surprised.

but anyway....hopefully this crazy situation gets resolved one way or another.I doubt that these two will ever work/tour together again,but hey at least we have our memories and lots of great music to enjoy smile

Oates filed his response in court on Wednesday, calling Hall’s statements “inflammatory, outlandish, and inaccurate.” He added: “I have no idea who or what is motivating Daryl to take these steps and make such salacious statements, but I am deeply hurt.”

“Over the years, Daryl has consistently and publicly been adamant about being perceived as an individual rather than as part of a duo or group. Thus, he has insisted on our being known as ‘Daryl Hall and John Oates,’ rather than the more commonly known ‘Hall & Oates,’” Oates wrote. “On this point I agree. I now must act with truthfulness and make decisions that are right for myself, my family, and my artistic future.”

This morning CBS Mornings reports that the judge sides with Hall to temporarily block Oates from selling his portion "without Hall's permission." Oates denies going behind Hall's back with the sale, which would include Oates's portion of trademarks, name, and likeness rights, along with royalty income.

Hall calls it the ultimate betrayal. I wonder how his former words with Bill Maher land on Oates ears.
