De La Soul & Industry Politics

Read an interesting article about De La Soul in today's NY Times. The article talks about their upcoming album but also about why none of their previous joints (except the Grind Date) are available on iTunes and in other digital formats. The article cites sample clearances as the main culprit and that's where I get confused. Not knowing anything at all about the politics and practices of the recording industry, why does Public Enemy (particularly Nation of Millions and Fear of a Black Planet) have the ability to sell their music in any format they want but not De La?

This comment is key, from Deborah Mannis-Gardner, the world's #1 sample clearance agent (and expert).

Deborah Mannis-Gardner, a sample-clearance agent who worked with De La Soul on its new record, said that lack of guidelines could be why Warner Music is keeping the catalog in digital limbo.

“My understanding is that due to allegedly uncleared samples, Warners has been uncomfortable or unwilling to license a lot of the De La Soul stuff,” Ms. Mannis-Gardner said. “It becomes difficult opening these cans of worms — were things possibly cleared with a handshake?”



:2cents: Def Jam/Columbia probably have better documentation since Beastie Boys caught the first sample lawsuit before Public Enemy debuted.

Maybe it might have to do with their management or that their earlier songs heavily sampled from other artists especially 3 Feet High and Rising (1989) album.

They sampled from so many VARIOUS sources, that it is hard to tell if all of their uses are ok for digital distribution or just the formats from before the internet age.
