I personally like the John Coltrane quote that music is a reservoir, and it's OK to take something from it as long as you put something back in it. Neither Thriller or Blurred Lines is 100% free of influence by past history. I'm of the general mind that the Blurred Lines verdict was a mistake, and not does meet the traditional standard of copying either the lead line, the bass line, or the words virtually verbatim (see: Zeppelin). That's exactly right. Another reason I didn't find Pharrell and Robin's statements about inspiration so incriminating: Marvin Gaye was an innovator and a modern soul architect right until the end ("Sexual Healing") so anyone writing soul after him would be hard pressed to say he wasn't an inspiration. What's the difference in that and Morris Levy suing John Lennon about Come Together? Morris Levy owned Chuck Berry's songs. Chuck didn't sue. It was also a publishing company (Bright Tunes) that sued George Harrison for My Sweet Lord. George later bought the copyright to He's So Fine. I remember reading that Daryl Hall heard Billie Jean, acknowledged the similarity to his own I Can't Go For That, and then said something to the effect of "it's different enough to be different" and did not pursue it any further. . I think that says a lot to his (and John's) character. . I'm not sure how lawsuit-crazy people were back in the early 80s, but he would've had a much better argument than Marvin Gaye's family had against Blurred Lines. | |
