The cats who are saying that Gotta Give it Up and Blurred lines dont sound the same are not understanding what was being debated in court. Contemporary copyright law, doesn't only protect melody of a song. It protects the feel and the texture. While on a melodic and harmonic level, the two songs are onlu vaguely similar. The texture and feel of both songs are near identical, and thats enough to warrant a copyright infringement

So while yes, you can play blurred lines on a guitar and it won't sound like Gotta Give it Up, simply because the notes and harmonies don't line up, this is OLD WORLD infringement. Copyright law doesn't work that way. Rather, It protects every aspect of the song, including the arrangement and groove. So basically what this means if Pharell and Thicke, decided to interpolate the song, but arrange it in say a country folk setting, there would (possibly) be no violation. But because their arrangement is so close to the original arrangement, they have violated the copyright based purely because they copied the texture and feel. But sometimes even a genre change isnt enough to masquerade the alleged infringement

A good example of this type of copyright infringement is the Ghost Busters theme by Ray Parker, infringeing on I Want a New Drug by Huey Lewis and the News

Outside of the riff and the hits, and the over all feel, the two songs are barely the same.

Different melodies and harmonic structures. the arrangement is very similar. You don't have to steal melodies in order to infringe a copyright, this has always been the case. Blurred Lines is not establishing a new precedent at all. And anyone who claims it is, never fully understood contemporary copyright law.

Same again, arrangement can't be defined (unless you're talking about specific melodies in the arrangement instrumentation, none of which applies here because there are no definable similiarities).

Hello, a riff IS a melody. That's exactly why Ray Parker was judged to have infringed, because the riff aka the melody was the same.

You do have to either steal melodies or lyrics to infringe (until yesterday).

If you think it proves something please provide some type of an explanation what you think it proves.

Obviously the two tracks are given different chords by the chordify application. Using the visual cues for the different bars should also pretty satisfyingly demonstrate how differently the accents on the bass are distributed.

I should bring up in this thread too that I feel Thicke / Pharrell should have reached an agreement with the Gaye family earlier on and admitted openly that the background music on "Blurred Lines" is strongly influenced by "Give It Up".

The problem I have with this thing is the way people have a psychological need to see more connections between the two songs that there actually exist. There are no substantial similarities on the melody lines.

Just having a poor attitude is not enough to justify someone being punished by LAW. You need to be able to point out what the crime exactly is and not just "go with how you feel about it". That's just ridiculous.

Let me put it like this..if Pharrell & Robin choose to spend years battling it out with the Gaye family they will tarnish their own Musical Legacies....Robin better not play that Game when he KNOWS Black radio supports ALL his music whenever he drops it...Pharrell is worth $80-million and counting and he's still one of the most Respected, well liked & sought after producers. If the Brotha knows what I know he'll put this Drama behind him and move on with his life..I hope the sake of his own Legacy trumps his Ego.....They will regret the day if they continue this battle with The Gaye Family....Trust what I'm saying...

music is a very important aspect of culture

and I always was an opponent of sampling and hijacking, certain aspects of sampling when Rap originated was legit considering the fact government funding to continue paying for music education was cut severely during the Reagan administration so the luminaries then had to compensate, and they did so in artistic fashion to where their own unique talent still resonated

but over the past 20 years, the sampling grew way outta hand and it became a quick fix method for how to create further music, it became strictly formulatic

and people from all cultural backgrounds have exploited sampling to establish their own careers, white artists, black artists, hispanic artists and the like, they have all done it.......this diminishes the impact of culture and marginilizes it......but the well has dried because most of the music that has been sampled has been sampled

Robin Thicke started his career out the box sampling of all people, Walter Murphy and his rendition of Beethoven's 5th Symphony

when this sampling became extreme, the people who relied on it exclusively knew, and they still know, more than the actual lyrics, it's the music, the meat and the gravy, the foundation of the song that compels peopel to buy the records....

if this was not the case, then sampling would not be used.......

and the issue is deeper than sampling in of itself

it's about all those luminary artists of years past who never was given the opportunity, or the right to own their own songrights, where their music could not be exploited or used w/out their permission.....that's the real issue........

if they did own their own songrights, most of this sampling would not exist because the artists who rely on sampling would not want to continuously pay the money to use the music they want to sample, and the artists just starting out wouldn't have the money to pay for song usage anyway...

all of this was systematic and deliberate when the late 80s arrived where a ton of authentic artists who truly knew how to craft music were pushed out and executives replaced them with counterparts they felt could thrive in the age of video and sell record on mass scale.....that formula is not working anymore

and that's why I'm glad Marvin Gaye's music and his memory was recognized in teh courts this week......
