Red herring: Robert Bowick, an attorney for King, said, "It doesn't matter if Cadet King was impaired from a drink or two. He was minding his own business.

Something tells me, there's a lil' bit more to this story than the video presents. Even so, that's what courts are for. biggrin

I'll repeat criminal charges were not filed. Police presents the evidence to the DA they (the DA) inturn determines if there's enough evidence to precede. If records show there were calls into Police stating .... a man fitting Mr. Bowick description was intoxicated and harassing people in a limo, I'd say there's a lil bit more to this story.

The old saying: her side, his side and the truth. In my opinion, it was a mistake for his lawyer to even acknowledge Mr. Bowick had any drinks to the press, loose lips. Another thing, in

Mr. Bowick civil lawsuit he states Ms. LaBelle ordered her bodyguards to beat him up. He'll have to present evidence or witness to prove Ms. LaBelle gave orders to beat the snot out of him. If his lawyers fail to provide that evidence, in most instances she's not liable to pay monetary damages.

Did something happen before Mr. Bowick and LaBelle's bodyguard's came into camara range? I'm not stating yea or nay; I've stated here many times I don't believe in "hood rules" and it's not an excuse or a defense. Having said that... a civil lawsuit has been filed stating Ms. LaBelle ordered her bodyguards to beat up this young man. This will have to be proven, in a court of law. Unless, where there's smoke there's fire -via the video- Ms. LaBelle counsel could recommend she settle out of court.

Mr. Bowick lawyer made a major mistake in my opinion when he acknowledge anything about whether his client had a drink, drinks, or was impaired. "It doesn't matter if Cadet King was impaired from a drink or two". Really? Isn't LaBelle people claiming an intoxicated man was harassing them... he threw a punch at their limo driver? If he was "impaired" is it possible he couldn't remember all he said or done? The police said, they smelled alcohol on him.

In a Civil litigation, the burden of proof is intially on the plantiff. However, there are a number of technical situations in which the burdens shifts to the defendant. This is called, a prima facie case, the burden shifts to the defendant to refute or rebut the plaintiff's evidence. The police claimed they smelled alcohol, did they give Mr. Bowick a breathalyzer? If they thought he was inebriated and someone called saying they had been assaulted why didn't they consider arresting Mr. Bowick? This could along with his claims of LaBelle people filing a false police report and as sosgemini suggested, the police were star struck, so they ignored their duty to serve and protect.

Playing devil's advocate: Ms. LaBelle could argue she has many fans.... people who approach her always in public. Its it feasible that her bodyguards would jump someone because they stood close to her luggage? In this civli lawsuite the plantiff says Ms. LaBelle ordered her bodyguards to kick his ass. Form that video we see a couple of people and one person punch Mr. Bowick out. Does the video show that... Ms. LaBelle directing her bodyguards to beat up Mr. Bowick? Is there more video at different angles? Words and how they are used in law are very important. Ordered? If she didn't order her bodyguards to beat Mr. Bowick down, is Ms. LaBelle libel under Texas law? She may not be but they may not let her bodyguards off the hook but guess who has deeper pockets. In short, the video may not be the end all to be all in a court of law. That's why I said, this is much to do about nothing... until you hear everyone's side.

The shame, the understanding of civics / goverment appears to be at an all time low.

I don't think anyone here gives a squat about the grounds of the civil case. lol I think everyone is too outraged at someone being beatdown and the police taking a picture with an entertainer who was involved. lol To make matters worse, the victim involved happened to go to the top, let me repeat, top military school in our Nation, was booted due to what appears to be a false police report and all this during war time when folks have a soft spot for our military. We have people in this country who think others shouldn't get due process because they've deemed them unworthy or less than. Sosgemini it goes both ways, I don't uphold knee jerk reactions.... that's why it's important to have due process for everyone. It makes one wonder why he didn't also file a lawsuit against H.P.D.

The alledged victim in this case "Richard King," according to the press reports, had been drinking.

Then it says, he said "he was not impaired." Since when does a person with an obvious smell of alcohol upon his/her person get to determined the level of non-sobriety. There is no problem for the police officer to do a blood test (perhaps not a breathelizer test) on an injured person under the influence while on the way to the hospital.

I found this article: http://www.chron.com/disp...94731.html , which made me question this incident.

If you look at the video again, you'll see from the very first moment of the tape, his yellow shirt. Then when everyone from the bus has walked away, you still see this guy. It's as though he must have walked past then returned to the area.

Too bad there is no audio replay of the incident. My question is why when everyone else has left the area Richard King (who was momentarily out of the frame) decided to return to that particular area.

Was he a little drunk and had a nosy desire to get the 411 on these well dressed citizens who were minding there own business?

An inquiring mind wants to know.
