Rihanna being sued by famed photographer David LaChapelle

I've not seen her vid in its entirety but I'm wondering why only RhiRhi is being suied and not video director Matsoukas. Unless Rhianna specifically said, I want these types of images and camera angles, I don't see how she alone ripped off LaChapelles' work. confused

Rihanna's 'S&M' Video Prompts Photographer To Sue

in Hip-Hop Media Training

Famed fashion photographer David LaChapelle is suing Rihanna. According to Reuters, LaChapelle claims that the pop star based her controversial video "S&M" on eight of his photos.

In the lawsuit made public Monday, LaChapelle says, "The music video is directly derived from and substantially similar to the LaChapelle works."

Days after the video was released, LaChapelle accused Rihanna via Twitter of using his ideas without his consent. "The next time you make a David LaChapelle music video you should probably hire David LaChapelle," the photographer wrote. Perez Hilton, who appears in the video which attacks media outlets for negative coverage of the "Only Girl (In The World)" singer, posted a copy of the tweet which has since been deleted from LaChapelle's Twitter page.

LaChapelle has directed dozens of music videos, including Britney Spears' "Everytime," Christina Aguilera's "Dirrty," and Gwen Stefani's "Rich Girl."

In one of LaChapelle's photos, a woman lays on a gurney and is attended to by a staff of clowns. By comparison, the Melina Matsoukas-directed video features the Barbados native resting on a desk, surrounded by clowns that happen to be reporters.

Another LaChapelle photo features a group of women with poufy red hair, romping around a room decorated with bright pink and white striped wallpaper and matching furniture. In a scene in Rihanna's video, she's also wearing big red hair and playing around with lady friends in room with hot pink and white striped wallpaper, and black and yellow pictures on the wall.

Each image uses a similar forced and distorted camera perspective. According to LaChapelle, the "S&M" video duplicated the "composition, total concept, feel, tone, mood, theme, colors, props, settings, decors, wardrobe, and lighting" of his images.

The damages LaChapelle seeks have not been specified.

Before LaChapelle expressed his frustration with the short, "S&M" had already sparked controversy because of its overtly sexual content. Matsoukas said she was not bothered by criticisms. "The song is called 'S&M,'" she told MTV. "So I think that the imagery follows suit with what the song is. I wouldn't play down the imagery for a song that's so strong. It makes sense to develop it further and really take it there."

A spokesperson for Rihanna has not yet responded to Yahoo! Music's request for a statement.

Sorry but total BS this should not only be tossed out, it should be laughed out of court. You cant sue on the basis of color schemes, and poses? is he a nutJob?? look at a magazine like SHOW, every chick poses the same way with different photographers, they aint sueing. My guess is that Rihanna used another video director rather than his overpaid wack ass, and now he is crying like a baby.

Because he realizes that others can make bright and colorful videos and NOT have to pay millions to his ass to do it. Its a lame shot at the Rihanna video director, he is actually almost saying he could have done it better, so it REAKS of jealousy, he has no case in this matter. I mean this would be like someone emulating a Baseball players batting swing, or taking a certain shot in a movie and then seeing someone on the street take the same shot and sue them? I mean its a waste, and you cant "own" camera angles and wardrobes and wigs, is he for real? I mean i know he worked with Mariah, but he seems as NUTS as her

Hmm. There seem to be enough similarities for there to be a case.

On the other hand, if the guy has taken hundreds / thousands of pictures with an S&M theme then it shouldn't be a surprise that there are more "matches" than just one or two.

Sounds like one of those cases that should be settled outside court with some money.

It looks pretty obvious to me that team Ri-ri used LaChapelle's work to make this video.

I dont get how they had the nerve to go ahead and do it. Its like the Madonna Hollywood filmclip, Its not just the same posing and angles but almost the exact same set as well. Why do they think they can just blatantly copy someone like that and not expect them to say something? I mean at least change up a few key things so its not so obvious.

Exactly.

I think he handled it all wrong too, hate-Tweeting her about it.

I think in this case...Rihanna merely said "ok" to everything. Sorry but I don't think she spends hours studying and reseaching photography and video artistry. Any woman that can let CB whup on her several times and not send his ass to jail aint got the sense God give a billygoat!

Yeah, but RiRi has probably MORE money than the director, so it's a better target! lol

Yeah he clearly goes after her for her name/fame, if he sued the director, who the hell would care? who the hell would even know the directors name? Its a lame lawsuit, mainly because i have seen tons of pics and color schemes like this LONG before dave's work. I mean to be honest does he think that Rihanna was sitting around and saw the theme of the video and thought....Oh wait Dave did that first? give me a break, who cares about his work? yeah its some good shots he's done, but i have seen people on the street in NYC take better pics and they dont charge 2 million dollars per shoot..like he does.

i would say the vid was inspired by the photos... the photographrer should be flattered, but sadly using the oppotunity to squeeze some money, making himself look tacky as hell

exactly, its a new director, an its just as lame as any other lawsuit where the big money maker jumps on the little person, in this case, there is nothing being "stolen"
