iTunes question for people

Ok an issue has arisen mainly because i stumbled across it yesterday. The Band a-ha just played at the Royal ALbert Hall in early October, they played their first album with an orchestra, it was a one off show during their current tour. NOW the BBC just ran the show about a week ago on the radio for a few days, now all of a sudden iTunes is selling it in every store the USA included, for 4.99. Now the issue is the band and management as of right now had no knowledge this was even coming out, so there is a possibility that this was a file captured from the radio show, and now being sold by a source unknown, meaning a bootleg. Also the copyright is listed as 2010 copyright control, the bbc is not listed anywhere, nor are a-ha's members names, and though the artwork is looking real, its not hard to photoshop the word a-ha that is already out there and the Royal Albert Hall picture can easily be googled. So the question is, can anyone just get something through? What channels does iTunes use to check how official something is and who gets paid?

Sounds like a major goof,

Itune's has to receive masters from either 1 the record company, 2. the manager of the artist, 3 an outsourced "agent" ( I forget the technical term) who represents both the company and the agents.

However Live CD's are tricky, because they count as a new performance of the song, so technically the person who records the boot retains the copyright, HOWEVER! likeness usages have to be paid, the band can have it stopped just because of that.

While they don't have a piece of the revenue, they still can get performance royalties and publishing monies.

However Likeness alone is enough to stop the presses.
