The Drug Enforcement Agency has contacted a pharmaceutical company about a batch of the drug propofol after the drug was found in the home of Michael Jackson following his death on June 25.

It emerged that two batches of the drug were recalled after 40 patients in Florida, Arizona and Missouri became ill after the drug was administered to them. The batch was found to be contaminated with bacteria.

A spokeswoman for Teva Pharmaceuticals says that investigators in the Jackson case contacted her about a different batch to the ones that were recalled, according to the Associated Press .

Propofol is a powerful anesthetic and is the generic version of Diprivan. It is usually only administered in hospitals.

Batch of drug central to Jackson probe recalled

LOS ANGELES (AP) — Federal drug enforcement officials have contacted the maker of the powerful anesthetic propofol (PRO-puh-fall) as part of their investigation into Michael Jackson's death.

A spokeswoman for Teva Pharmaceuticals says the Drug Enforcement Administration asked the company about a specific batch of the drug.

Teva voluntarily recalled two lots of propofol after investigators found bacterial contamination in some samples caused up to 40 patients in Florida, Arizona and Missouri to develop fevers and chills.

Teva spokeswoman Denise Bradley says the DEA asked about a different batch of the drug than what the company recalled. Propofol is the generic version of Diprivan. The anesthetic normally used in hospitals was found in Jackson's home after his death June 25.

At the heart of Michael Jackson's musical legacy are two albums that total less than an hour-and-a-quarter's worth of music. Both are rightfully considered among the best pop albums of their era.

Off the Wall," released in 1979, and "Thriller," issued three years later, turned Jackson from a teenybopper into an adult pop entertainer and ushered in his international superstardom.

Both were overseen by Quincy Jones, already a much-admired musician, composer, arranger, conductor and producer who'd worked with Count Basie, Ray Charles, Duke Ellington, Ella Fitzgerald, Dizzy Gillespie, Lionel Hampton and Frank Sinatra. The two first discussed working together while Mr. Jones was supervising the music for the 1978 film "The Wiz," in which Jackson played the Scarecrow.

"I saw his sensitivity and his focus," said Mr. Jones, age 76. "There was such an innocence, but he didn't miss a thing."

Epic, Jackson's label, thought Mr. Jones was too steeped in jazz to produce what became "Off the Wall." But Jackson and his management team insisted, and Epic relented. When the project began, Jackson had demos of two songs; Mr. Jones had a track from the funk band the Brothers Johnson that needed a melody and lyrics. Everything else came together once they became part of a team.

"Don't Stop 'Til You Get Enough," the album opener composed by Jackson, is set up by the syncopated percussion that Jackson, his sister Janet and brother Randy played on a casaba, cowbell and glass bottle and had recorded for the demo version.

Suddenly, Jackson screams and the orchestra explodes: Sweeping strings; punchy horns; bass, drums and handclaps form the foundation under Jackson's vocal. Single notes plucked on electric guitar fold into the Jacksons' percussion, creating a signature sound for the singer.

It's a busy track, but not cluttered. Mr. Jones told me his big-band experience helped him organize all the sounds.

Workin' Day and Night," the album's third song, also rises from percussion that Jackson had recorded earlier with his siblings. Plucked guitars are its core too. Mr. Jones omitted orchestral strings this time, but Jerry Hey and Greg Phillinganes did the horn and rhythm charts, respectively, as on "Don't Stop."

The two remaining tunes on side one reveal a maturing Jackson. "Rock With You," written by Rod Temperton, a composer Mr. Jones still favors, and "Get On the Floor," built on a riff by bassist Louis Johnson of the Brothers Johnson. On the former, the mood is airy and seductive; on the latter, bold and assertive. Mr. Johnson dominates "Get On the Floor," which is also driven by Mr. Hey's horns, John Robinson's cymbal work and Latin percussion by Paulinho Da Costa -- and a forceful vocal by Jackson.

"Rock With You" and the title track are cut from comparable cloth. In "Rock With You," a trombone and two tenor saxophones add warmth to the bottom, while lilting synthesizers and chopping guitar chords fill the midrange. Once again, Mr. Robinson's drumming shines as he shifts the cymbal pattern to deliver the song to its chorus. A synthesizer plays staccato notes, recasting the plucked guitar notes of the opening song, one of the many pull-throughs that Mr. Jones preferred and that give the album its unity.


The arrangement for "Off the Wall" foreshadows the title track of "Thriller," with its bass synth, cymbals, insistent backbeat and plucked guitar as the rhythmic platform. Mr. Temperton wrote both songs and had a hand in arranging their rhythm tracks. While "Thriller" lives in the memory as the soundtrack to a long-form music video, it's also an expert piece of pop -- and so is its predecessor.

Throughout the "Off the Wall" album, Mr. Jones challenged Jackson to expand his vocal range. "I wanted him to sing down low," he recalled. "A lot of his habits came from Motown. They wanted him to sing high, but by then we had a relationship of trust, an honesty with each other."

Of the remaining songs of Jackson's solo debut, only the Carol Bayer Sager tune "It's the Falling in Love" seems stuck in the late '70s. Johnny Mandel, who arranged for Basie, Sinatra and others, did the string charts for "She's Out of My Life," Jackson's successful attempt at a big, romantic ballad. Mr. Jones said he had intended to give the song, written by Tom Bahler, to Sinatra to record.

Jackson and Mr. Jones reunited for "Thriller," using key members of the "Off the Wall" team -- engineer Bruce Swedien (who Mr. Jones credits for what he still considers both albums' unsurpassed sound), Mr. Temperton, Mr. Hey and Mr. Phillinganes among them. "The collective is always more powerful than the individual," Mr. Jones told me. Of course, Jackson's enormous talent and unbridled ambition were the major drivers.

By now, the bass synthesizer had become part of the pop vocabulary, and it introduces the album's opener, "Wanna Be Startin' Somethin'." A dance tune with horns arranged by Mr. Hey that was originally proposed for "Off the Wall," it serves as a bridge from the earlier album, but it has a leaner, more biting feel. It ends with a long vocal recitation of a line from Manu Dibango's "Soul Makossa."

After the pop gem "Baby Be Mine," written by Mr. Temperton, and the Jackson-Paul McCartney duet, "The Girl is Mine," comes a four-song stretch as strong as any in pop history: "Thriller," which ends side one with its ghoulish narration by Vincent Price, "Beat It," "Billie Jean" and "Human Nature."

A drum machine's steady rhythm introduces "Beat It," which was written by Jackson and is immediately cast as a rock song by Steve Lukather's guitar and a brief hint of the coming guitar solo by Eddie Van Halen, who Mr. Jones brought to the project. Jeff Porcaro, who, like Mr. Lukather, was a member of the band Toto, plays drums. Mr. Jones said that he and Jackson, determined to expand the performer's base, had their eyes on a rock audience.

"Billie Jean" also was a Jackson composition. Sung with icy fire, its melody rests on what may be the deepest groove in pop history, formed by a battery of synths, N'dugu Chancler on drums and Mr. Johnson on bass. At the chorus, Mr. Jones opens the track, allowing in a chiming guitar to leaven the relentless, bottom-heavy rhythm. Lush synthesizers add movement to the backdrop.

"When you come out of 'Billie Jean,' which is just three chords, you need a kaleidoscopic harmonic structure," Mr. Jones said. "You know, the ear wants that."

Steve Porcaro composed the music for the next tune, a lovely ballad. "Toto sent over a demo and Rod Temperton and I listened to it, but the first two songs didn't do much for us," he told me. "Then the third song came out and I said, 'Yeah!" The next day, Mr. Jones asked John Bettis to write the lyrics to what became "Human Nature."

The performance floats on guitar and bass notes; at first, the brass is barely noticeable. Mr. Jones allows the chorus to arrive without additional fanfare, thus drawing in the listener. Jackson sings it beautifully, allowing his voice to meld with the whole.

"Thriller" concludes with the snappy "P.Y.T. (Pretty Young Thing)," which brought Jackson together with his sisters Janet and LaToya, and "The Lady in My Life," a gorgeous ballad written by Mr. Temperton featuring Paul Jackson on guitar.

Five years after the release of "Thriller," Jackson and Mr. Jones went on to make "Bad," with many of the same musicians who played and arranged parts for their breakthrough recordings. By then, though, the template for presenting the music of Michael Jackson was set. He had become the King of Pop.

"We put this all together behind Michael's energy and sensitivity," Mr. Jones said. "It was a team effort. I swear to you, it was like divinity put us all together."

LA mayor: City will pay costs from Jackson event

LOS ANGELES (AP) -- Mayor Antonio Villaraigosa is trying to quell the escalating debate over who should pick up the estimated $1.4 million tab for police, traffic control and other services related to Michael Jackson's memorial service.

Villaraigosa, who was vacationing in South Africa a week ago when more than 17,000 fans flocked to downtown Los Angeles to watch the public memorial, asserted Monday that the city will pay. He said he will not ask the Jackson family or AEG Live, the owner of the Staples Center where the event was held, to help the city recoup its expenses, and he lambasted a city Web site set up to request donations.

"This is a world-class city, and we provide fire and police protection, period," Villaraigosa said during his first public appearance since returning from his weeklong trip. "The idea that we would charge the family for a funeral is nonsensical."

Despite his comments, the City Council was expected to take up the issue Tuesday when City Attorney Carmen Trutanich reports on the costs of the event. Trutanich launched an investigation into laws to force third parties to pay the municipal costs associated with unexpected events such as the Jackson memorial.

Villaraigosa told reporters that major events such as the memorial occur frequently in Los Angeles and other big cities. New York and Chicago do not ask others to cough up cash, he said.

The mayor called the city's donation Web site, which raised $35,000, "ridiculous." The site stopped operating Friday afternoon. It was unclear whether the money would be returned to donors.

Villaraigosa's comments was in contrast to a statement attributed to him in a news release distributed by his office last week. In it, he encouraged Jackson fans to memorialize the pop star by donating to the city.

The release quoted Villaraigosa as saying: "Michael Jackson's music touched millions of fans across the globe. Donations will help the City of Angels provide the extraordinary public safety resources required to give Michael the safe, orderly and respectful memorial he deserves."

Matt Szabo, the mayor's spokesman, said the idea to seek donations came from Councilwoman Jan Perry, who served as acting mayor while Villaraigosa and City Council President Eric Garcetti were out of the country.

"Her office asked for donations to be mailed in," Szabo said. "The bottom line is our office then moved to support that effort with an online contribution form."

Perry could not immediately be reached for comment.

The issue took on political overtones last week when several council members asked who was going to foot the bill at a time when the city faces a $530 million budget shortfall and layoffs. One of the most vocal critics was Councilman Dennis Zine, who said taxpayers don't typically pay for motorcade escorts for funerals.

Zine said he agreed with Villaraigosa that the city should not solicit donations, but asserted that the Jackson family and AEG Live should pay.

"AEG and the Jackson family turned this memorial into a worldwide event. The taxpayers should not be responsible for what they did," Zine said Monday.

Zine introduced a motion calling for a review of city policies governing expenditures on such events and a detailed report of the costs related to Jackson's death, as well as who approved the expenditures.

Councilwoman Janice Hahn, meanwhile, introduced a motion asking for a full accounting of tourism-related revenue that flowed into the city after the singer died June 25.

Both motions are on the council's agenda for July 21.

Thousands of Michael Jackson fans gathered at the 02 arena to remember the star on the day that would have seen his first London concert.

The venue was turned into a shrine as people paid tribute to their idol by singing his songs and celebrating his life.

Ellie Howlett, 24, a student from Portsmouth, who made the trip with her sister, said the event was a chance for a "final goodbye" and in contrast to the sombre memorial service in Los Angeles last week.

She said: "I had tickets to see the concert this week and I had to come down just to be with other fans. It's a way of getting closure.

"I cried when I signed the memorial wall, but apart from that the atmosphere has been happy. London has become the focal point for all of his fans in Europe because of the concerts so it was important to be a part of this."

Last night would have been the first of 50 planned dates for his This is It comeback tour.

Some of those at the O2 dressed in Jackson costumes spanning his 40-year career from red leather Thriller outfits to sequined military jackets and single white rhinestone gloves.

Michael Lewis, 25, a retail manager from Edmonton, dressed in full Jackson stage costume, spent more than £1,000 for concert tickets for seven dates.

He said: "I'm a member of a fan club and we've been holding vigils outside HMV in Piccadilly Circus, but the 02 is now the real focus. I think there will fans meeting here for the whole of the 50 nights he was meant to perform.

"I didn't see a single tear here. We've been dancing and singing. Remembering his music, but also all the good that he did."


A minute's silence at 6.30pm marked the time when the doors to the concert would have opened. Fans also signed a memorial wall while impromptu performances were given on a stage as footage of Jackson was broadcast on television screens.

Leo King, 28, a business journalist from Kingston, took promoter AEG Live's offer to trade in his £75 ticket for a souvenir version with a Jackson hologram rather than a refund.

Mr King said: "I decided that if I didn't go for the hologram ticket then I might regret it later. Like all fans I was very sad, but once you come to terms with it, you realise the legacy of great music and videos that he has left us."

Limited recall of drug central to Jackson probe

LOS ANGELES (AP) — A maker of the potent anesthetic propofol found in Michael Jackson's home has been contacted by federal officials investigating the pop star's death and has recalled tens of thousands of vials of the drug after two tainted lots sickened dozens of patients.

There is no apparent connection between the bacterial contamination that prompted the recall and Jackson's death on June 25, Teva Pharmaceuticals spokeswoman Denise Bradley told The Associated Press on Tuesday. The tracking number on the tainted lots was different from the number on a vial that Drug Enforcement Administration investigators told the company was found at Jackson's home, she said.

Propofol usually is administered intravenously in hospitals to patients who need to be unconscious for surgery or other procedures. A central question in the Jackson investigation is who provided that drug and other prescription medications found at his rented Beverly Hills mansion. Investigators are talking to doctors who treated Jackson.

On Tuesday, Los Angeles assistant chief corner Ed Winter went to the offices of Dr. Arnold Klein, Jackson's dermatologist, seeking subpoenaed medical records. He did not get the documents but said Klein's office had promised to provide them.

Klein has said he sometimes sedated the pop star for medical procedures but never prescribed propofol.

Meanwhile, a nurse who provided nutritional therapy for Michael Jackson said Tuesday that she was interviewed by Los Angeles homicide detectives who told her needle marks were found on the pop singer the day he died. Cherilyn Lee said she told the detectives that she didn't see any so-called "track marks" on Jackson's arms when she visited his home to provide vitamins and other supplements earlier this year.

The detectives replied that "the day the paramedics came (to Jackson's house), he had a lot of track marks," Lee said.

Lee also was asked in the 20-minute interview at her office last Friday if she saw bruising on Jackson. Lee said she didn't but told police Jackson's veins were small, which made placing an IV needle difficult and could result in bruising.

Lee has said Jackson asked her for Diprivan, the brand-name version of propofol, to alleviate his insomnia. She said she refused to help him get access to the drug.

Lee, a registered nurse, said Jackson had complained of sleeplessness and told her he knew that Diprivan could provide immediate relief. She cautioned him the drug was to be administered in a hospital under careful supervision and had potentially dangerous side effects.

Jackson replied that he would be "fine as long as I'm monitored. ... He knew that somebody should monitor him with equipment," Lee said, which she took as an indication that he had used Diprivan before.

Lee was asked if there was an IV pole at Jackson's house, and told detectives that the only one she saw was the one she brought to administer a vitamin-mineral supplement, known as a "Myers' cocktail," through a needle placed in the back of Jackson's hand. While administering the vitamin IV on several occasions, Lee said, she needed to move Jackson's sleeves up his arms and saw no evidence of needle marks. She treated the singer from January to April.

Jackson investigators are seeking to trace how propofol ended up in his home. Teva can provide information on which distributor bought specific vials. From there, distributors typically sell directly to hospitals or doctors.

Bradley said she didn't know which distributor handled the drug found at Jackson's home. DEA spokesman Rusty Payne declined to comment.

Teva announced it was recalling two lots of propofol — 57,620 vials in all — after concluding bacterial contamination caused up to 40 patients in Florida, Arizona and Missouri to develop fevers and chills since May. Investigators believe vials were distributed nationally and are urging doctors not to use any propofol from the two lots.

Most of the affected patients were undergoing an endoscopy, an examination in which a tube-like instrument, usually with a camera attached, is passed into an area of the body such as the colon or esophagus. One patient was hospitalized and all recovered, said Dr. Arjun Srinivasan, lead investigator for the U.S. Centers for Disease Control and Prevention.

Karen Riley, spokeswoman for the Food and Drug Administration that oversees drug recalls, said the contamination was found in a single outpatient facility in each of the three states. She did not identify the sites.

FDA investigators arrived Monday at the Teva plant in Irvine, Calif., where the suspect lots were made and were looking for any irregularities in the manufacturing process, Riley said.

Investigators believe that bacteria in vials of the anesthetic released toxins into the drug which caused the fever, Srinivasan said.
