And possibly she’s the one that actually called the cops, not a resident of the area because she was in the car with them! If Keshia truly was in the car her word could be a big factor especially if she saw that Rihanna threw the first punch. If Chris was driving a Lamborghini, as reported, there'd be no room for another passenger. Also, given the rumored extensiveness of Rihanna's injuries -- and Chris' now-reputed martial arts training -- I don't think a self-defense argument will hold water, even assuming Rihanna threw the first punch. When did the law differentiate? If it were a man, Chris Brown can defend himself but cannot defend himself if the attacker is female? Bullshit. She's not blind. She's making a conscious choice to engage in a physical altercation. She should assume the risk of her actions. If the law is looking at whether Chris Brown used an inappropriate level of force to defend himself, that's a hard one, especially given the closed space of a Lamborghini. That's probably why they charged him with threats and not assault and battery. Also the it seems whether she was choked to unconsciousness seems to be doubtful. The marks on her neck would bruise if he was choking her. Even if her were not cutting off her air, it would leave an impression. And if he's insisting she came at him, then it's hard to charge him. RnBAmbassador said: Earlier today, the Los Angeles district attorney asked police detectives to dig up more evidence for their case against Chris Brown.
The police are getting cooperation from Rihanna, and what she has told them so far is chilling. A source close to the investigation tells E! News exclusively that Rihanna has alleged to police that Brown choked her while threatening to kill her and, subsequently, she lost consciousness. They began squabbling after leaving Clive Davis' pre-Grammy party late Saturday. Shortly after midnight, things blew up. Brown pulled his silver Lamborghini to the side of a street in L.A.'s Hancock Park neighborhood. That's when, per the source, Rihanna grabbed the car keys and tossed them out the window, sending Brown into a rage. He tried in vain to find the keys, then came back to the car, put his hands around her neck and, according to the insider, said, "I'm going to kill you!" According to the source, the 20-year-old "Disturbia" singer told police that she lost consciousness, and when she awoke, Brown had fled. According to the source, her right eye was blackened and badly swollen and she had hand prints on her arms. The responding officers were so concerned about her, they drove Rihanna to the hospital in their squad car instead of waiting for an ambulance. Officers took two sets of photographs of the banged-up singer, one at the scene and the second after she was admitted to Cedars-Sinai Medical Center for treatment. Those photos were presumably among the evidence presented to the district attorney. After being treated for her injuries, police escorted her down a rear elevator and into a waiting Mercedes, the source says. Brown, 19, was subsequently booked on suspicion of making criminal threats. He was released after posting $50,000 bail. His lawyer, Mark Geragos, has not responded to repeated requests for comment on the allegations. Brown's publicist also has not commented. A spokeswoman for Rihanna declined to comment specifically on details of the fight and the arrest and stuck to her earlier statement from Sunday: "Rihanna is well. Thank you for concern and support." source: [url]http://www.eonline.com/uberblog/b99434_rihanna_cops_chris_brown_threatened.html N o hand prints around the neck after he choked her long enough for her to lose unconsciousness but there are still handprints on her arm? New York Daily News: Rihanna & Chris Brown fight started over text message from other woman It started with a text. The explosive fight that landed sultry singer Rihanna in the hospital ignited when singer Chris Brown got a text message from another young woman, a source said. "He got a booty call. He got a text. Rihanna saw it and she got upset. They started to argue. She got out of the car. He wanted her to get back in, so he grabbed her," the industry source said. "She pulled away. That's when she's told people he hit her." The Barbados-born beauty had "visible injuries" when cops arrived, and she's been cooperating with the investigation ever since, while freezing out Brown. "Chris has been trying to contact her. So far she hasn't taken his call," the music business source said. "Her family is on their way to be with her. She has some close girlfriend looking after her." The source scoffed at reports that the fight erupted after a jealous Brown scolded Rihanna for spending time with producer Timbaland at a pre-Grammy party. "That's coming out of the Chris Brown camp," the source said. "It's despicable. They're blaming the victim. She's not prone to that kind of behavior. . . He's the one who's steppin' out." Cops and sources say the two were driving a rented Lamborghini on a ritzy street south of Rihanna's pad in the Hollywood Hills early Sunday when they quarreled, parked, got out and "the argument escalated." Cops responding to a 911 call found the "Umbrella" singer with a split lip and contusions on either side of her forehead, according to People.com. "She looked distraught and in a lot of pain. Her eyes were closed because she was looking down," a police source who saw photos told People.com. Rihanna also reportedly had bite marks on her hand and was treated at Cedars-Sinai Medical Center. Cops delivered their case to prosecutors Tuesday, but the district attorney sent them back to the drawing board. "LAPD did present a case this morning and we have asked for further investigation," DA spokeswoman Jane Robison said. Robison wouldn't describe the holes that prosecutors want plugged. A legal expert said prosecutors generally ask for an overabundance of "witness work" in cases like this because victims often lose their nerve when it comes to trial. "These cases are often stymied by the refusal of victims to testify," said attorney Alexandra Leichter, a Beverly Hills-based private arbitrator. "If witnesses saw the victim before the attack, witnesses heard the screams and then cops came and she was bloodied, then the circumstantial evidence could be enough to convict." The Daily News spoke to a witness Tuesday who heard the raucous fight explode outside her house: "I heard the screaming. It was loud," the homeowner said. "In my opinion, either [the cops] have conflicting stories and not enough evidence, or the DA is debating whether to file this as misdemeanor or felony battery," said defense attorney Steve Cron. "If you have a scratch or a bruise, that's more in the realm of misdemeanor. If you have a cut that requires stitches, bruising showing multiple blows, a broken bone or a chipped tooth, that's more felony." Brown, 19, has kept a low profile since he was booked on a felony criminal threats charge and released on $50,000 bail. His attorney Mark Geragos did not return calls seeking comment. Singer Kanye West, who toured with Rihanna last year, said he was "devastated" by word of the alleged abuse. "All I will say is, it's so devastating. I feel like, just as a person, I don't care how famous she is, or even if she worked at McDonald's, that should have never happened," West told Ryan Seacrest during a radio interview. "It should never come to that place." Or maybe she started it and they don't think the case will get to trial or be enough to win at trial. I don't want you to think like me. [Edited 2/11/09 16:32pm] If she was the one to hit him first, than I see a reason as to why he hit her. I'm not saying that makes the ass-whoopin' session okay or the smartest thing to do on his part, but it does indicate self-defense. Yes, men shouldn't hit women, but women shouldn't hit men either...it's not right either way and everyone has the right defend themselves if someone is assaulting them regardless of whether the aggressor is male or female. Personally, if anyone put their hands on me in a disrespectful manner; then they had better get ready to be disrespected back. I don't give a damn whether it's a man, woman, or child...children nowadays are just as violent and dangerous as adults, so I will knock a kid down if they put their hands on me in a abusive manner; and I really don't care whether people agree with me on that or not because I have a right to defend myself if anyone; and I mean anyone, touches me without my consent. Sadly, some people don't seem to understand you when you tell them to stop and sometimes it's hard to walk away, especially if the person refuses to get away from you, which isn't uncommon in assault cases. If someone hit me, they'd better make damn sure I don't get back up; because if I do, one of us will be going to jail while the other is on the way to the hospital. I've seen lots of fights with girls hitting a guy and the guy walking away with the girl following him and egging him on. Every time I've seen this type of thing happen, I honestly want the guy to turn around and either slap the piss out of her or at least push her down because some females obviously like to learn things the hard way instead of taking a hint and backing off. You can only push someone soo far before they snap and go Bjork on your ass. Self-defense is all I look at in cases like this. Now, what makes it wrong is that she has more injuries than he does and that's really what may work against him in this whole scenario. A smack does not warrant an Ike Turner style beat down. My point is given the extent of her injuries (assuming the rumors are true), a jury would likely laugh at a self-defense argument, even if she struck first. Chris allegedly blackened both her eyes, bruised her on both sides of her head, bloodied her nose, split her lip, bit her, choked her to the point of unconsciousness and bailed before she came to. Meanwhile, he supposedly walked into the LAPD looking fine... aside from his bruised knuckles. [Edited 2/11/09 20:04pm] I edited my post above but I could argue that it is still self-defense. You can kill any intruder coming into your home because of the "a man's home is his castle.' theory of property. But there is also recognition in the law that one's level of fear makes it hard to react rationally and the law is not going to require one to act as if one were "a rational actor." So a court is going to be reluctant to draw line on where self-defense is and isn't acceptable or how far someone should go to deter an attack. In an enclosed space such as a two seat sports car where the smaller person has the advantage, how do you stop the attack? You can't open the door until you get this person off of you.
