Hall & Oates sue in N.Y. over 'Maneater' recording




NEW YORK (AP) — Daryl Hall and John Oates have filed a lawsuit saying their music publisher failed to protect their rights to their 1982 hit Maneater.

The pop duo's lawsuit, filed in Manhattan's state Supreme Court, says they learned in April 2007 that an unidentified singer-songwriter had used Maneater in a 2006 recording.

"Money's the matter / If you're in it for love, you ain't gonna get too far," the song goes. "Oh, here she comes / Watch out, boy, she'll chew you up / Oh, here she comes / She's a maneater."

The singers' court papers claim Warner/Chappell Music Inc. breached its publishing contract with them by refusing "in bad faith" to sue for copyright infringement.

The singers seek unspecified money damages and want to terminate their agreement with Warner/Chappell.


"We will defend ourselves vigorously," she said.

Hall and Oates started working together in the early 1970s and became the most successful duo in rock history, with more than 60 million albums sold, according to the hallandoates.com website. Their other hits include Rich Girl,Private Eyes,I Can't Go for That (No Can Do),Sara Smile and She's Gone.

From the New York Daily News:
The suit does not identify which artists knocked off "Maneater" in 2006, but singer Nelly Furtado that year released a song of the same name, in which she she sang, "Move your body around like a nympho."

Not relevant and not her. You can't sue someone for having the same song title.

I agree. NYDN is only speculating that they're suing Nelly F, but it could be anybody.

Furtado's "Maneater" is SO different from H&O's. I really hope they aren't trying to come after her. Because if that's the case, we can bring about 10,000 same-titled songs into court.

its odd that it doesnt say the artist that used the song, they do say its from 2006, im curious if its anything to do with the whole "mash up" crap that came out a year or so ago. The suit is aimed at the owners of the copyright and the fact that it allowed the song to be used without knowledge or "payment" at least to Hall and Oates.
