R. Kelly Found Not Guilty In Sex Trial

Judge Considers Removing Juror Who Yells At Restaurant Server, But Decides Not To
CHICAGO (CBS) ― A jury has acquitted R. Kelly in the child pornography case for which he stood trial.

Kelly was charged with 14 counts of videotaping himself having sex with an underage girl, who prosecutors say was as young as 13. If convicted, he faces a minimum of four years in prison and a maximum of 15 years. He would also have to register as a sex offender in Illinois.

The jury-nine men and three women-was given the case Thursday.

The key question for the jurors was whether they believe it was Kelly in the video, as prosecutors contend. Kelly's attorneys say it wasn't him.


Jurors returned to court from a hotel Friday morning, after spending the night sequestered while they worked to reach a verdict.

The jury began deliberations on Thursday afternoon, following closing arguments. While they heard 12 witnesses identify Kelly as the man on a sordid 27-minute sex tape and 14 witnesses identify the girl on the tape as a 13- or 14-year-old, they failed to reach a quick verdict in the R&B superstar's child pornography trial.

In court Friday morning, Judge Vincent Gaughan dealt with an issue with one of the jurors, who on Thursday night had a verbal altercation with a server at a restaurant.

Jurors were together eating Thursday night, when one of the jurors, a male, became upset about his service. He began shouting at the server and deputies had to take him outside.

Judge Gaughan talked with the juror this morning and briefly considered whether to remove him. After talking with the other jurors, the judge decided to let deliberations continue.

On Friday morning, Kelly arrived at the courthouse shortly after 9 a.m.. He appeared relaxed as he greeted his attorneys, and he smiled when several people in the courtroom gallery gasped when they saw him. He will remain either in or near the courthouse so that he can quickly return to the courtroom in the event the jury reaches a verdict.

The sequestered jurors include the wife of a Baptist preacher from Kelly's Chicago-area hometown as well as a compliance officer for a Chicago investment firm and a man in his 60s who emigrated from then-Communist Romania nearly 40 years ago.

Analysts have said the delay in reaching a verdict may be good news for Kelly.

"A lot of people who have seen the entire trial say this is a slam dunk guilty and others are saying, 'Hey, listen, there's reasonable doubt there,'" said Legal Analyst Irv Miller told CBS station WBBM-TV in Chicago. "There's issues in this case and, apparently, that's being reflected back in the jury room also."

In that jury room, early indications were that there's debate over the prosecution's star witness.

Lisa Van Allen was the only one who claimed she actually saw Kelly and the alleged victim engaged in sex. Van Allen claimed that she was there and actually took part in a separate sexual encounter with Kelly and the girl.

Kelly's attorneys called her a liar, maintaining her claims were part of an extortion plot.

The jury asked Judge Vincent Gaughan for a transcript of her testimony. Gaughan initially denied the request, but later told attorneys to have the transcript ready on Friday.

The singer, 41, whose full name is Robert Sylvester Kelly, has pleaded not guilty to 14 counts of child pornography. Both he and the alleged victim, now 23, deny being on the tape and neither testified at trial.

During the trial, the always meticulously dressed Kelly endeavored to make a good impression on jurors - always standing ramrod straight and folding his hands in front of him whenever they entered the stately, colonnade courtroom.

Jurors, in turn, made a good impression on Judge Vincent Gaughan, who repeatedly praised their attentiveness.

Unlike at some trails where jurors can be seen drifting off, their eyes drooping, the men and women in the jury's box at Kelly's trial nearly all appeared to take careful notes, even when testimony became highly technical.

"You're one of the best, if not the best jury I've had," Gaughan told the jurors in court Thursday.
