Well the thing is with sampling alot of people have let too many off the hook with it, im not saying its not allowed, im just saying that using even 1 second of something someone else did gives them whatever right they want, if it means taking 100% of money made then thats it, but the thing is sampling is considered the cheap way out, so many have gotten away with theft. To date i have done 5 indie films and i copyright every damn thing in it, the thing is alot of times there is music in my films so i get indie artists, or known artists trying to get something out here and use their music but let them have the right to promote my film for the use. And to date i have not had an issue and i have had music in my films from Berlin,John Crawford,a-Ha to name a few.

Tempest can filed a lawsuit IF he register the copyright of his original version six years earlier from the time that Timbaland completed his cover version.

If Tempest didn't register the copyright, he has no case at all.

At least we know why some of today's hip-hop tracks sounds a little too much like casio toy keyboards (as vainandy & voicescarry would say!). Tempest's original track was made with a freaking commandore 64 computer!!!! THAT's cheap.lol

You know what. That's not necessarily true. I used to think that, too but I've studied a few cases where that has definitely not been the case. Its really all about how you can prove your ownership. You can have proof without having a PA form registered. Having a game with your music in it out years before the defendant's use of it can be strong proof. Then all that remains is to prove you are the author. Testimonies from the game publishers, game creators and so on can make the case.

The real bad news is that Timbaland NEVER had the permission to sample that track at all.....or pay for it in advance! disbelief

disbelief Unfreaking believable... You've got to be a pretty nasty person to steal an underground musician's work like that... Unless this guy sues, most people will never know... which is what Timbaland probably wanted in the first place... horrible. machinegun

I really don't like sampling myself... but this is much worse... he didn't give the original creator credit... didn't get his permission... AND he picked an underground artist probably knowing he wouldn't have the money or resources to sue... just a low-life...

I agree - it's absolutely disgusting. I hope that this person realises that for the time being, he doesn't even need a lawyer. All he needs to do is contact the Finnish equivalent of the Performing Rights Society (I'm in the UK so this would be ASCAP, BMI or SESAC in the US) and inform them that he co-wrote the Nelly Furtado song. They'll have to freeze the royalties until this is resolved, meaning nobody will get paid until an agreement is reached.

I hope so. Shame on Timberland to stoop so low. I used to have respect for him and his music back in the days when he was more innovative.

Maybe he did copyright it. I'm not sure.

There may be proof. He won a competition in 2000, after which all the files were uploaded to www.scene.org. Here's his file: http://www.scene.org/file...p&fileinfo

If there's a log file available showing when the file was uploaded, will that be enough? Plus I'm sure plenty of people have listened to his tune over the years...

His song is copyrighted, as his song was put down in a tangible form (such as the sound format within which it was created). I really hope he gets some hefty renumeration out of this case, as I hate seeing writers and musicians being ripped off, especially by other scummy musicians. I've been at the receiving end of it enough times, but nowhere near this degree. By the way, I did try to find an email address for him, but to no avail. sad

Check out his website:http://www.fairlight.fi/tempest/ He doesn't list his email though (I didn't see it). Seems like there's plenty of evidence... Hope he takes action...
