well, she IS a soul singer, whether you and i think she's a particularly good one being beside the point. a song is a song. if it's arranged/sung soulfully, then it's a soul song. although i do agree she tries way too hard to sound soulful. she'd probably be a better soul singer X 10 if she would just lay off a little. i think she has it in her. but either she thinks, or somebody's telling her, that she needs to "soul it up" a little to sell the whole "serious soul singer" thing to establish cred. to me, it's backfiring, but apparently it's working with everybody else.
There are a lot of songs that are sung 'soulfully' that don't hit the soul charts. I personally do not know anyone who loves soul music that digs Joss Stone.

alice russell does what joss stone does, and she does it far better.
There are many people that do what Joss Stone does better than her and will never get the spotlight she has. They are many people who are famous in the music industry for nothing and a lot of ordinary people who make these people rich, for nothing.

hitting the soul charts is now a pre-requisite for it being soul?

as for Joss... i pretty much agree with you. but she is a soul singer that sings songs soulfully, which makes them soul songs. whether its forced (or good) or not is up to the listener.
