PHILADELPHIA, Miss. - The biracial jury that convicted a one-time Ku Klux Klansman in the 1964 slayings of three civil rights workers initially was split — not by race, but by evidence.

Juror Warren Paprocki offered a peek inside the jury room deliberations that led panelists on Tuesday to vote for a manslaughter conviction instead of murder for alleged ringleader Edgar Ray Killen.

"I think initially we were polarized by two positions," Paprocki said. "On the one hand, this guy needs to be convicted and on the other hand, the state needed to present better evidence."

Paprocki said he hopes the conviction will change the way people look at Mississippi and said the jury of nine whites and three blacks worked well together.

"This is 2005 in Mississippi, not 1964," said Paprocki, a 54-year-old engineer who moved to Philadelphia from southern California several years ago. "We are not barefoot and illiterate down here."

For more than four decades, this Mississippi lumber town lived with an ugly stain on its reputation — the unresolved killings of Michael Schwerner, James Chaney and Andrew Goodman by a mob of Klansmen.

The conviction of Killen, 80, came 41 years to the day after the slayings, which galvanized the struggle for equality and helped spur passage of that year's landmark Civil Rights Act.

"There's some sort of cosmic justice working somewhere," said Stanley Dearman, a former editor of the local paper who had long pushed for the case to be reopened.

Paprocki became emotional during a telephone interview with The Associated Press on Tuesday, saying: "There has been a cloud of evil hanging over this place for the last 41 years and we dispelled that evil."

Killen, a bald figure with owlish bifocals, sat impassively in his wheelchair, an oxygen tube up his nose, as he listened to the verdict. On his way to jail, he slapped two television microphones and a TV camera.

The murder charge carried up to life in prison. But Killen could still spend the rest of his life behind bars; each of the three manslaughter charges is punishable by up to 20 years. Sentencing was set for Thursday.

Chaney was a black Mississippian and Schwerner and Goodman were white New Yorkers who came to register black voters. The three were intercepted by Klansmen in their station wagon on June 21, 1964. The FBI's investigation was dramatized in the 1988 movie, "Mississippi Burning."

After word of the verdict spread, cheers could be heard outside the two-story, red brick courthouse. Passers-by patted Chaney's brother, Ben, on the back, and a woman slowed her vehicle and yelled, "Hey, Mr. Chaney, all right!"

Ben Chaney thanked prosecutors and "the white people who walked up to me and said things are changing. I think there's hope."

Goodman's 89-year-old mother, Carolyn, said from her home in New York on Tuesday that the real heroes were those who stood up to the hate groups.

"I know a lot of people in Mississippi who have risked their lives," Carolyn Goodman said. "I would say those are the most important people in my life. All the people who have stood up and the victims of the Klan."

Killen's lawyers pointed out that prosecutors offered no witnesses or evidence that put Killen at the scene of the crime. Killen did not take the stand.

Defense attorney James McIntyre said he will appeal because he believes the jury should not have been allowed to consider the manslaughter charges.

With a murder charge, prosecutors had to prove intent to kill. With a manslaughter charge, they had to prove only that a victim died while another crime was being committed.

Paprocki said the court's instructions to the jury prevented the group from agreeing on a murder conviction. "Our instructions almost read like he would have had to have been there at the scene of the crime or given instructions during the murders," he said. "The state just did not provide that evidence."

Killen is only person ever brought up on murder charges in the case by the state of Mississippi. He was tried in 1967 on federal charges of violating the victims' civil rights, but the all-white jury deadlocked. Seven others were convicted, but none served more than six years.

On Tuesday, District Attorney Mark Duncan said: "It's not the perfect ending in this case. I believe we proved murder and I believe he was guilty of murder."

But he added: "The bottom line is they have held Edgar Ray Killen accountable for his actions."

Anyway, name some songs that would be appropriate for this man or his other inmates in prison. The best one I can think of is if Ms. Grace Jones would come to the prison and do a free concert to hype up the inmates.....

What's hilarious is that the dumb ass walked around free for 41 years and would still be free if it wasn't for his big mouth. Last October, he wanted to set up a booth at the state fair in Jackson to shake hands with his followers and sign autographs.

People were furious and were planning to boycott the fair. Other people were threatening to go to the fair and start violence. Anyway, the idiot didn't set up his booth but it got people to talking about him again which brought about this court case. I'm glad he wanted to brag because look where it got him. lol

The thing that bothers me about his conviction is the timing. Whats a life sentence to an 81 year old man? Better late than never, I guess.

Actually, an 11-1 split jury kept him from being convicted in 1967 in a federal conspiracy trial. The lone juror told fellow jurors she could never convict a preacher.

Another song that could apply would be "The Second Time Around" by Shalamar.

Epps said prisoners are evaluated by the severity of their crime, length of sentence, age, criminal history, and results of a psychological exam. They are rated by points, with lower points resulting in more favorable custody, such as trusty status, with work priveleges. "Manslaugher is pretty high, especially three counts," he said.

Epps said Killen will be treated like any other prisoner and not be segregated.

For those that think racism is a thing of the past, I will show you that it is still alive and well and living in the good ole "Hospitality State" in 2005. The following is a letter that was written by someone to our local newpaper, The Clarion Ledger, and printed in this morning's edition. Apparently, the author of the letter was very proud of him/herself (I don't know what gender the name "Constance McDowell" would be) because he/she was bold enough to sign it. Please excuse any typos because I am typing fast and straight from the newspaper.....


"LEGAL LYNCHING" AN INSULT TO CONSERVATIVE SOUTHERN WHITES

The "Philadelphia Three" and Emmett Till were long past and forgotten until The Clarion Ledger and other left-wing media, in your endless vendetta against conservative whites - those who believe in racial separation and racial integrity as a natural order of things ordained by God and nature - decided to go digging around in ancient histories in the hopes of committing more "legal lynching" against old, helpless, and probably innocent victims of vicious persecution like Byron de la Beckwith, Ernest Avants, and others.

You have been inciting craven politicians to drag old, sick, and defenseless citizens before "kangaroo courts," get wrongful convictions, and cast these "sacrificial lambs" into dungeons to die.

To show how racism is still alive and well, one of the things our present governor (who the President personally came down here and backed) used to win his election, was by saying that his opponent was against our state flag, which still has The Confederate Flag in it. Rednecks from far and wide came out that day to vote. lol
