Jackson Defense Rests--Again

Fire or ice? The Michael Jackson child-molestation trial is ending in both.

Friday in Santa Maria, California, the prosecution played a potentially incendiary videotape in which Jackson's young accuser was seen reluctantly telling police he'd been masturbated by the pop star.

Then the defense, which had the all-clear to recall the accuser and others to the stand, simply closed up shop.

No more witnesses, no more cross-examinations, no more evidence. For the second time this week, the defense rested.

The unexpected move clears the way for closing arguments to begin as early as Wednesday. From there, it'll be up to the 12-member jury to decide if the music legend is guilty of charges of molestation, conspiracy and plying a minor with alcohol.

Now in its fourth month, the trial's end appeared in sight when the defense rested for the first time on Wednesday, with actor Chris Tucker as its final witness. Then it appeared out of sight on Thursday, when Superior Court Judge Rodney S. Melville gave the prosecution permission to screen the accuser's police interview. The ruling seemed assured of adding days to the trial, because the defense, in seeking to rebut it, was expected to ask the accuser to come back to the courtroom in person. Jackson's lawyers also wanted the accuser's mother; Larry Feldman, the family's civil attorney; and Dr. Stan Katz, the psychologist to whom the boy first revealed the abuse allegations on call.

In the end, the defense just let the tape play, without additional commentary.

On the tape, the boy, then 13, is seen and heard being questioned by police investigators about his time at Neverland. Near the end of the hourlong tape, the boy broaches the subject of abuse.


Jackson, the boy said, told him he wanted to teach him how to masturbate.

"He put his hands in my pants. He started masturbating me," the boy said in the interview. "I told him I didn't want to do that, and he kept on doing it. I told him no."

The story is both consistent and not consistent with the accuser's courtroom testimony. On the stand in March, the boy, now 15, said he was molested on at least two occasions. In the videotape, recorded in July 2003, he assigns a higher number to the alleged crimes.

But if jurors follow Melville's instructions, what the boy said on the tape will not factor into their verdicts.

Meville told jurors merely to pay attention to the boy's demeanor. Prosecutor Tom Sneddon said he wanted to play the tape in order to rebut the defense contention that the teen spat out the allegations after the troika of the mother, Feldman and Katz saw dollar signs and coached the child accordingly.

A decade ago, Feldman secured a reported $23 million settlement from Jackson for the family of the boy at the center of the 1993-94 child-abuse investigation.

Jackson was never charged with a crime in the previous case. In the current one, he has pleaded not guilty to all charges.

And given Friday's events--or non-events--the singer's judgment day is near.

Melville told jurors, who already were taking Monday off for Memorial Day, wouldn't be needed in court on Tuesday, either. That's the day he set aside to hammer out jury instructions with lawyers from both sides. Given that schedule, Melville indicated closing arguments could proceed on either Wednesday or Thursday.
