Well, it is true that they do need all 12 jury members for a conviction. They also need all 12 jury members for an acquittal. In case of a 'hung' jury, it's a not-guilty verdict, but he can be trialed again for the same charges in the future. (or at least that's what i've read. Someone please correct me if i'm wrong) Everything is correct Except the Hung Jury, It is only in Miniscule cases that a stalemate jury is an "Aquittal" In Cases like Murder, A Jury MUST under the Writ of Habea Corpus come to a final answer In this case i believe they're going to use this because of the media coverage, and the people involved in the trial . The Jury must deliberate until they have reached a final verdict, if they don't, they have to go through both sides evidence until they do

Jackson's Accuser Connected to Kobe?
January 6, 2003 "Celebrity Justice" has learned that the boy accusing Michael Jackson of molesting him may have also been befriended by Los Angeles Lakers superstar Kobe Bryant, according to statements made to authorities by the boy’s mother. "CJ" has obtained confidential documents, one prepared by the L.A. County Department of Children and Family Services, the other by the State of California Health and Welfare Agency. Both agencies were looking into claims of domestic violence allegedly perpetrated by the boy’s father. In the documents, a caseworker says "Mom showed [Case Worker] numerous photos of her children with various celebrities- Kobe Bryant, Michael Jackson, etc." The following is a passage from confidential documents from the L.A. County Department of Children and Family Services: "When [Case Worker] asked Mother about the celebrities, she said she just met them on the street and one introduced her to another. ‘They are our friends. They shower us with love. We see them very often. They come to our house and we go to their house. We go places together and we eat together.’ [Case Worker] asked where in the street she met the celebrities and mother said ‘the street is anything outside my house.’ Mother said she did not want to answer the question about where she met the celebrities because this is private. [Case Worker] said it is a bit unusual to just meet a bunch of celebrities in the street. Mother said that they are just like everybody else. [Case Worker] said that is not true. [Case Worker] asked if Mother has had any psychological or psychiatric treatment and she refused to answer....Eventually Mom said that they met the celebrities due to her son’s illness and that the celebrities are very supportive of her son and their family. [Case Worker] knows that some celebrities do in fact visit children who have cancer. Mom says that she has found ways to get things for her kids." However, in the State documents dated October of 2001, the mother was more forthcoming in regards to treatment for mental illness. "The officers asked mother if she’s ever had psychiatric treatment and she said yes in the past, but not currently."

Since the book was the biggest 'smoking gun' they got from raiding Neverland in '93 (which wasn't very much to begin with), the judge in the present case didn't allow any of the evidence seized in the '93 raids, including this book. Those photos are totally innocent. Cute, even. I worry about the minds of the people who are reading any sex into them. "A Watcher scoffs at gravity!"

well i think this is why Debbie Rowe joined the prosecution team... so she would have an easy shot at Getting the children. BUT!!!!! she no longer owns the rights to them, she gave up the right as mother in a document in 99, She can only get them back with Jackson's Consent Rowe will be the first to be cancled, because of the several times ahe's admonished the fact that Jackson, treats them well etc... I believe the Children go to a relative of Jackson, Most Likely His Mother and Father I severely doubt Debbie will geta shot then anything more than visitation rights. If jackson appeals, than the children stay with his relative's untill the appeal descion is given.. If jackson is guilty, he would not go to jail, he would undergo Psychiatric treatment, at a mental Facility, to cure him of his "Disease" if it seems that he can't be cured of pedophilia, he will have a choice to be chemically castrated or go to jail,if he is chemically castrated, then will he be able to recieve custody of his children again

From Yahoo! News.....
Smoking Gun Smokes Out Jackson Case? By Joal Ryan Has the gagged Michael Jackson (news) molestation case been unbound? The Smoking Gun on Thursday published 805 pages of purported Jackson grand jury testimony--and said it was busy scanning more. The postings come about a month after the Website, along with ABC News, first made public excerpted testimony of Jackson's young accuser. At the time, both the prosecution and defense teams decried the leaks, essentially confirming their authenticity. As of Friday, there were no new condemnations of the latest Smoking Gun scoop, although Jackson's camp seemed to find comfort in some of its contents. Jackson's official news Website posted a FoxNews.com story, based on the Smoking Gun documents, about how the singer's accuser told the grand jury that he referred to his alleged Neverland tormentor as "Daddy," or "Daddy Michael." Jackson earlier blasted the grand-jury leaks. With the blessings of the court, the pop star released a statement on Jan. 30, saying that he deserved a fair trial and maintaining that the "information" heard by the grand jury was "disgusting and false." California's Santa Barbara County convened a grand jury to hear testimony in the Jackson case last spring. The proceedings resulted in a 10-count indictment against the entertainer. Jackson has pleaded innocent to the charges, which include molestation, conspiracy and plying a child with intoxicating substances. According to the Smoking Gun (www.thesmokinggun.com), the grand jury heard from 41 witnesses--from the accuser to the flight attendant, who told of Jackson's predilection for being served wine ("yucky Kendall Jackson") in Diet Coke cans, to the public-relations expert, who said a Jackson attorney gleefully talked of making the accuser's mother "look like a crack whore." Chief among the new posts were 154 pages of testimony that the Smoking Gun says was delivered by the accuser--all but outed now, if not identified, as a former cancer patient who turned 15 in December--over two days on the stand in March and April of 2003. The choicest contents of the boy's professed testimony are by now familiar to those with a working knowledge of the case: The boy says Jackson showed him naked pictures of women (cracking "Got milk?" at the sight of a woman's breasts), nicknamed him "Apple Head," spoke of the importance of masturbation and then masturbated him, got him woozy on "Jesus Juice" (wine in a soda can), Skyy vodka and Jim Beam bourbon and held the boy and his family against their will at Neverland Ranch. One new detail contained in the boy's supposed complete testimony: Jackson kept a mannequin in his bedroom, and, on one occasion, pretended to have sex with it in front of the accuser and his younger brother. The alleged molestation is said to occurred in the weeks after the boy taped an interview with Jackson for the Martin Bashir documentary Living with Michael Jackson, which aired on ABC in February 2003. The Smoking Gun's mother lode of documents also includes the purported testimony from the accuser's brother, mother and sister, the attorney who represented the family of the accuser in the 1993-94 Jackson molestation investigation, and the therapist who turned authorities onto the family at the center of the current case. In all, the Website says it has obtained 1,903 pages of testimony. Jackson was not called to testify before the grand jury. Leading news organizations such as the New York Times, the Los Angeles Times and the Associated Press, did not publish accounts of the professed leaks Friday, with the L.A. Times saying it could not confirm that what the Smoking Gun has posted is the same document that's supposedly sealed up at the Santa Barbara County Superior Court. The Jackson trial, still in the early phases of jury selection, is on hold until Tuesday. Proceedings were suspended earlier this week when Jackson took ill with the flu, and required an overnight hospitalization. Meanwhile, in another developent, music legend Quincy Jones (news), already on Jackson's star-studded list of possible defense witnesses, might not be the singer's best character witness, Celebrity Justice reports. While Jones has told confidantes that he never saw any criminal behavior by Jackson toward children, the TV show says, the record producer was worried that his friend's "sleepovers with boys" would be his downfall. "We are told Quincy Jones actually did an intervention on several occasions. Going to Michael Jackson and saying, 'Look, this is inappropriate. It's wrong, and it could bring you down if you don't stop,'" Celebrity Justice executive producer Harvey Levin said on Thursday's program. Jones worked with Jackson on his three biggest solo album hits, Off the Wall, Thriller and Bad, and also produced "We Are the World," which was cowritten by Jackson. FOX NEWS REPORT: Jackson Accuser Wanted to Call Him Daddy Friday, February 18, 2005 By Roger Friedman FOX NEWS 411 Michael Jackson's teenage accuser wanted to call him "Daddy," and even asked for the pop star's permission to do so. This revelation comes up on page 369 of grand jury testimony in the Jackson case published yesterday by 'The Smoking Gun.' "Question: Were there any times that you actually called Mr. Jackson 'Daddy?' Answer: I wanted to know if I could call him Daddy. Daddy Michael —" I told you about this one year ago, reported from sources whose other information holds up in the harsh light of the newly released testimony. The Daddy information was revealed when prosecutors questioned the now 15-year-old accuser last year. It's very interesting, because the accuser's mother had made it seem like Jackson wanted her kids to address him this way. It was just the opposite. In the redacted documents, the mother and her son have a unique take on some key points in their relationship with Jackson. Their difference of opinion centers on their week at the Country Inns and Suites in Calabasas, Calif., a period of time in which they claim to have been held hostage. I reported on this exclusively last week. From the grand jury testimony, it's possible to see the basic facts line up with our story. The family was put up at the hotel where they shopped and ate out extensively in public restaurants, and made dozens of phone calls from their room. A sheriff's station was not far from them. On the stand, the mother acknowledges calling her parents, her cousin, her boyfriend and even the girlfriend of actor Chris Tucker. At no point does she mention to any of them that she's scared, worried or being held against her will. Under benign questioning from the prosecutor, she gives no reasonable explanation for this. Page 1107: "Question: There were many calls made from that room? Who did you call? Answer: [name omitted], parents, my cousin, [my husband]. I hadn't spoken to [my husband] for a spread of days." Even worse: The accuser tells the prosecutor that he and his family were powerless to leave the hotel. Page 408: "They didn't let us leave the room. I don't think they let us even have keys to the room." If the case makes it to trial, the accuser will have to explain going to see the movie "Old School" and his countless visits to fast-food franchises and outlet shopping emporiums. In his grand jury testimony, the accuser comes off as articulate, calm and rehearsed. Just like his mother, he seems like a witness who's spent a lot of time repeating his story for prosecutors and is fairly unemotional on the subject of his own alleged sexual abuse. But it's the mother's testimony that readers and defense attorneys will focus on. She has no logical explanations for many things, including doing nothing when she thought she saw Jackson licking her son's head on a private plane trip and why she allowed the boy to return to Jackson's Neverland Ranch after she thought the singer had served him alcohol. Even more incredible, however, is her description of "killers" she claims were after her and her kids. This part of the testimony concerns the alleged conspiracy by Jackson and associates to hold her family against their will and ship them off to Brazil. Even after reading her account of it, the story still makes no sense. She evinces just enough paranoia about Jackson and his team that a jury might start to think they're watching a Hitchcock movie. From page 1145: "On the freeway, people flashing lights, bright lights. I thought at the moment they were just trying to pass me up. And so when I moved over, they moved over. So when I drove faster, they drove faster. And when I got inside [her then boyfriend's] apartment underground parking, they were there revving their engine. They had their lights bright, vroooom, vroooom." Interestingly, my sources have been telling me a parallel story to the mother's for a little over a year. Now, seeing the grand jury testimony, I can tell you that that version seems a lot more plausible than the one told by the mother. Her insistence that Jackson's aides threatened to kill her and members of her family does not come off as particularly believable. In fact, as the story unfolds before the grand jury, the prosecutor never once mentions that the mother has allegedly been treated twice for mental health problems. As she recounts the amazing amount of help she solicited and received from celebrities other than Jackson, she also fails to report various fundraising drives she organized for own benefit, including one from the Los Angeles Police Department. At the same time, she tries to dodge questions from the grand jurors themselves about her means of support, or her simultaneous dependence on the welfare system. If nothing else, this woman comes off as a wily scrapper who knows how to manipulate all systems and emerge profitably from every situation. At one point she concedes that she married her boyfriend to get health insurance. Little is made by the prosecutor of her using the boyfriend's address to get her kids into a better school. The mother gets a lot of things wrong, too. She calls Jesus Salas "head of security" at Neverland. Salas, who she says befriended her, was actually head of the house staff and had nothing to do with security. If Salas testifies for the prosecution, that should present a problem, since he was dismissed and could be painted as a disgruntled ex-employee. The mother, however, is really fixated on the so-called unnamed, un-indicted co-conspirators. In particular, she has not much use for Frank Tyson and Vincent Amen, the pair of 24-year-olds who chauffeured her around during February and March 2003. The mother vilifies them throughout her testimony, at one point claiming: "I started to realize they were the killers themselves." Tyson and Amen, two slight and unprepossessing characters, come off like Paulie Walnuts and Big Pussy from "The Sopranos," thanks to the mother's unquestioned descriptions. It's not until the grand jurors themselves get to ask questions that some sense of disbelief is injected. On a taped phone call seized from private investigator Brad Miller's office, the mother apparently told the now-loathed Tyson, according to a grand juror, that she loved him, trusted him, that he was like family (page 1182). The very smart grand juror asked her: "Nobody was telling you what to say to Frank?" The mother responded: "No, that's me. That's who I was." In the end, though, the focus will be on the accuser's testimony. There are no witnesses to his alleged sexual encounters with Jackson. He jokes with prosecutors during his testimony in a very intimate way; much the same, his mother refers to District Attorney Thomas Sneddon as Tom. At one point he even mentions a prosecutor dining with the family the night before the grand jury. The accuser, in fact, doesn't mind making light of what might have happened to him in Jackson's bed. From page 1545: "Question: So on all of the occasions where he [Michael Jackson] did something to you sexually, physically inappropriate, nobody else was in the room besides you and Michael Jackson? Answer: No. Question: Okay. Answer: Not unless like a Navy Seal dropped down." And what is the result of the grand jury testimony being leaked to the media? Some Jackson experts I know say this is exactly the kind of tactic Michael's father, Joe Jackson, has always employed: Release everything and hope that it neutralizes the shock value. It's possible that Jackson's team is hopeful of a poisoned jury pool, one that, when court resumes Tuesday, will have heard most of this material and will no longer be impartial. We shall wait and see. "New Power slide...."

from BBC NEWS:
http://news.bbc.co.uk/1/h...232827.stm Why I'm here for Michael Emily Smith was among hundreds of Michael Jackson fans who showed their support outside the California court where the singer faces charges of child abuse. Here the 23-year-old from Sevenoaks in Kent explains why she made the trip. This time I'm here for a week, so I took leave from the cinema, supermarket and temp jobs where I've been doing overtime to pay for this. But when the trial starts I hope to be back for the start and the end. In an ideal world, I'd love to get a work permit and stay for longer because going for a just a few days at a time is not sufficient. I'm here because Michael has done so much for his fans over the years so it's my turn to repay the favour. The only way I can really explain it in simple terms is when England are playing football in an away match and fans go because they want to be there to support them and cheer them on. So I'm here for Michael to give him strength and show him he's not on his own, to help him fight this injustice. On bad days, when he sees all his friends out there longing for it to be over and being so supportive, he can draw a lot of our energy. Some people dressed in Jackson costumes but a lot of us dressed in white to show purity I flew over by myself and got in touch with other fans I'd been in contact with in Los Angeles. On Sunday I drove 200 miles straight to the court and stayed there for 23 hours until Monday afternoon. In my group we took it in turns to go back to the car for an hour because it was so freezing. I had about six layers and was still shivering to death. I thought I was hallucinating at one point. But I've met people from Australia, Japan, other parts of Europe and the US, Brazil, and others from England. They're aged between three and nearly pensioner age. Singing By Monday there was about 500 people and there's a mixture of feelings. Personally I was partly nervous, partly excited and partly angry I was there for that reason because it shouldn't have come to this. And I feel so sorry for Michael at the moment. There were about two people protesting against Michael but fans told them 'Unless Michael's convicted, they're in the wrong place.' Some people dressed in Jackson costumes, but a lot of us dressed in white to show purity, like Michael who wore a white suit. But through the night I put on more layers until the sun came up. We sang some of his lyrics which are relevant to the case and other chants. When Michael's lawyers appear, we chanted to hype them up. Members of his family have been here, thanking fans, collecting messages, and filming us to show to Michael later. On Tuesday I got up at 2.45am to get to court for 4am. When it was adjourned until Monday we went to Neverland and had a vigil outside for him. The atmosphere was different there, not as loud as at court. Fans have too much respect for him to disturb the peace and cause trouble outside his personal home. Some people linked up in circles and said prayers, others just wanted to get a glimpse of him. On Tuesday, Michael shook hands with fans and signed autographs. He's such a humble person for someone who's a huge megastar. My friends think I'm mad but they know it's one of those things I do. I've probably been to about 10 concerts or Jackson events in the last 10 years. I was here for his 45th birthday, when I won a raffle and went to Neverland, but I had to sign an agreement not to talk about it. But it's a magical place. People say he needs to grow up but there's nothing odd about it. You can escape from the world there. I also came over for his court appearance at the arraignment. The whole Michael Jackson culture you either get or you don't. It feels like the most natural thing in the world to me but if you're outside it then it seems like an extreme thing to do. He brings a sense of love and belonging, and he brings people together from all over the world. He's given his whole life to the industry, to friends and supporters. He gives more to charity than any other celebrities and puts out an influential message about healing the world and I truly believe he stands for that. If I had any element of doubt in my mind that he was innocent I wouldn't be here now. I'm heartbroken to be going home because I feel I should be here next week, but I have to earn some more money to come back for the trial. Prosecutors seek to expose Michael Jackson's financial records
LINDA DEUTSCH AP Special Correspondent LOS ANGELES — Prosecutors in the child molestation trial of Michael Jackson want court permission to subpoena the star's financial records and present expert testimony about his wealth, according to documents released Friday. Defense lawyers argued the materials are not relevant and violate Jackson's privacy. In their motion, prosecutors said they plan to show Jackson's actions toward his accuser and the boy's family were motivated by a desire to minimize the effects of a documentary titled "Living With Michael Jackson" and to "preserve both his fortune and his reputation." They contend the entertainer held the family hostage at his Neverland ranch until they agreed to participate in a rebuttal video, making laudatory statements about Jackson. This was the first time prosecutors have alleged a financial motive by the entertainer. Prosecutors also said they needed testimony of a financial expert, saying the jury cannot accurately judge Jackson's assessment of the documentary "without evidence of his financial circumstances." The defense countered Jackson "is an international recording artist and a man who has varied and complex business relationships with numerous individuals and entities." "The very nature of these types of business relationships is that the parties honor a commitment to their respective privacy," the defense said, arguing disclosure would hurt the star's ability to do business in the entertainment industry. The 46-year-old pop star is charged with molesting a boy, plying him with alcohol, and conspiring to hold his family captive. Jury selection is scheduled to resume next week. OK, so Michael kidnapped, intoxicated and molested Gavin for financial reasons and to PRESERVE his reputation? I must be from a different planet or something, cause there´s no way that something like that could fit my logic! "When Michael Jackson is just singing and dancing, you just think this is an astonishing talent. And he has had this astounding talent all his life, but we want him to be floored as well. We really don´t like the idea that he could have it all."

I rate "one more chance" and his solo "gigolo" "I can't wait" and the newjackish "love you honey" very highly. APrticually "one more chance" which has a gorgeous middle 8 (bridge)
