I can make the argument that "Hot Summer" isn't a bootleg, because Prince has authorized it to be played to the public, and hasn't offered it for sale in any form.

What do you think? What is your definition of "bootleg" and do you think that possession of "Hot Summer" is possession of a bootleg?

I can make the argument that "Hot Summer" is a bootleg because Prince only authorised it to be played publicly on that radio show and I'm just guessing here...on his chosen websites that I know it streamed from...(Dr.F and EW)

Having it on your computer and sharing that file with anyone else by definition makes it a BOOTLEG!

Now don't get me wrong...PERSONALLY and in all HONESTY...I don't see any problem with what took place.

However, IT CANNOT BE BOTH WAYS!

Prince did not authorize the song to be saved on ANYONE'S hard drives nor did he authorize the SHARING of said file!

Therefore, I'm certain based on court records filed by Prince...himself...and the RIAA wink ...that makes the possession of the song, the sharing of the song and requests for sharing of the song...BOOTLEGGING!!!!

furthermore ; the fact that any streaming audio off any site can be saved to one's HD

makes it public domain

to prohibit sharing a 'legal' audio file that's public domain is , therefore , ridiculous

How many times has Prince had video clips from televised awards shows of his performances that were shown publicly, taken down from various websites that were just showing them in the public domain and not for profit...because they could be saved to one's HD...claiming it violated his copyright?

More times than I care to remember but they are preserved forever, thanks to the power of the internet!!!

Am I correct when I say that if you played "Hot Summer" from one of them, then the song is automatically stored on your computer in a Temp file?

If so, I don't see how that can be considered a bootleg. It's as if Prince himself put the song on your computer.

2. I can't speak on Dr. F website but I do know for a fact that Entertainment Weekly posted about it, using someone's unauthorized Youtube video.

3. According to many...many...many coversations that have been had on this very subject on this board and others since Housequake.com had to go through all they went through to upgrade their video forum to streaming BECAUSE the songs automatically stored on your computer in a Temp file...THAT IS...as far as I've known for years considered a violation of his copyright...even if it was something that he authorized originally to be aired publicly.

Unless that has changed and the RULE needs to be changed, I don't see why it's so difficult to understand.

You can't buy "Hot Summer" anywhere. One of the main tenets of bootlegging is that it takes money out of an artist's pocket. Especially file-sharing.

But "Hot Summer" isn't for sale. If someone saves the Temp file that Prince himself made available, as of 6/9/10 they aren't taking a dime out of Prince's pocket.

Now, if "Hot Summer" was on iTunes or for sale somewhere else, then I'd say that beyond a shadow of a doubt no one should have any copy of it other than what Prince has for sale.

I have to defer to you on the streaming point because that's way over my head, but if an artist knows that putting a song on a website means it ends up on a listener's hard drive through no action of the listener, then I can't see where an artist can bellyache about people saving it.

Nor if you missed it streaming somewhere on the internet officially and can't seem to understand why it wouldn't be ok to ask...(even in the I know I'm not supposed to...so I'll just "hint" at it way that y'all did)...someone on an independent and unofficial Prince fan community site who did hear it and it just so happened to have ended up on their hard drive through no wrong doing of theirs...for it.

The only links to C&E that were "right there for the taking on the Org" were the links posted to the stream by the Current's staff, links posted to the Current's archive of the stream and links to the lotusflow3r website were you could pay 77.00 and join, to listen to it directly from Prince's website.

I've been here for a very long time myself and as I recall most of the folks on that banned list have been head cheerleaders in the protection of Prince's copyright and the heavy handed approach he takes at doing so.

For someone that's been here for 7 years and 10 months, you KNEW better before you even asked or hinted or whatever. So instead of being all pissy and "boo hoo hoo, I got banned for 2 days" about it...stand up to Prince and his bullying tactics and say we have had enough of this foolishness!

Because there's no other reason why so many people that have never been banned, never asked for bootlegs, and always protected Prince's rights would all suddenly turn into the Second Coming of Moonraker.

Yes, we should be able to link to songs that are officially on other websites. Just as yes, we should be able to link to massive amounts of Youtube videos that have suddenly been surfacing without reprecussions because Prince has made some sort of deal with Youtube.

It's not Ben's or the Mod's fault you were banned for breaking what is clearly a well known rule around here...it's your's and Prince's!

The only question is...if you're really so upset about it, when are y'all going to stop acting like innnocent victims of the mean ol' Mods power play and take a stand on getting that antiquated stupid ass rule changed?

The rule at the very top of the main page of the PM&M forum state in flashing letters:

ABSOLUTELY NO SOLICITING FOR BOOTLEGS.

and if that rule applies to ME...it applies to EVERYBODY...no matter how cleverly WE might try to disguise it...out in the open forum. wink

The most frustrating thing is what most us said was harmless, and/or 2 subtle 2 warrant being banned.

More frustrating than that, was being banned without any warning, long after whatever comments we made.

Folks were out of control, and I understand why luv4u went snipping, but then to ban everyone she snipped (except Militant), and without warning, and with people who have never broken any Org rules, and/or rarely even discuss bootlegs... seems a bit harsh.

Anyhow, it's over now. No sense in contacting anyone, Ben or otherwise.

I can't speak for Luv4u but considering this wasn't the first, second, third, fourth, fifth, sixth, seventh, eighth, ninth, nor tenth...etc. time that a new Prince song has come out and SOMEONE...actually a great many SOMEONES have thought they'd be clever and try to get around the rule that has stood at the top of the message board every single day since we've been members...

You had plenty of warning! You've watched and I'm sure reported, as well as cheered as others have been banned for doing the exact same thing you were doing. You KNEW the rule and you KNEW you were breaking it but at the time you didn't care because you just wanted to hear the damn song.

Why shouldn't you be able to ask a friend for a song that was played on a public radio station and streamed from their website, where if they listened with the right browser and had a little know how, it could be found in their cache to hook you up?

There's nothing wrong with that in MY eyes but it IS filesharing and therefore bootlegging and therefore against that stupid ass rule that is in place on THIS independent and unofficial

Actually, we don't disagree all that much. I think it's beyond stupid that you couldn't do what you did because of the rule and were banned...but the rule is the rule.

The problem isn't the enforcing of the rule...if it stands for one, it stands for all...even if that includes the good fans who simply got a little over-eager and forgot themselves for a moment!

The problem is with the rule itself!

It NEEDS to be CHANGED but it won't be if y'all don't accept resonsibility for your actions and demonstrate how ridiculous it is to continue with this antiquated ass rule, when Prince isn't even bitching about his music and videos on Youtube anymore. So obviously his stance or somebody's stance has changed.
