Is Prince.org gonna get sued next?

I mean, his lyrics are being used across the top of the site, more than likely without permission.

Hundreds of people on here are using unauthorized images of Prince in the avatars and profiles.

People post lyrics to his songs on here without permission.

blah blah blah.

And Prince can be an asshole enough to do something like that, so who knows? lol

I think the org has insulated itself pretty well from such an action. "independent, unofficial.." language, no bootlegs, no mp3's, different situation from freemyheart. The prince.org t-shirts had me wondering though. Tangentially you're flirting with making money off his name. Could be a problem, but if they haven't heard anything about it by now...

oh please...if Prince wanted to sue the Org, he would've done it already (he probably would've LOST, mind you) But PRince obviously hasn't found anything wrong with the Org.

GIVE ME A BREAK...Prince really would B nuts 4 suing this site...the Org guy owners (sorry) have things that directly say no bootlegging or stuff like that when you sign onto this site. If Prince overlooked that and tried to sue due 2 the people who want to defy and do it on their own then he would be evil & Prince may be nuts but he's not evil

Speaking from personal experience intellectual propery doesnt mean diddly squat on the internet.

I am a web master of a very successful website with almost 1 million unique hits since it went live back in 98. There has been a very well known company that has served us 3 times with a cease and desist order but to no avail.

Anyway thats my 2 cents worth

Also, to a certain extent, I've always been told that a webmaster cannot wash his/her hands completely clean from all liability simply by putting a disclaimer up. If you run a site, and theres illegal, slanderous, or other lawsuit friendly remarks posted on it, its the webmasters responsibility to moderate and remove them.

Yes they do moderate here, no Prince hasnt sued them yet, but is the door open for it to happen if someone on here rubs P the wrong way?

Ture, anybody can sue anyone, however, by all appearances the "initial round" of lawsuits seems to be over. Freemyheart didn't get sued for posting lyrics or images.

They posted music and got sued. As long as prince.org stays away from that, then they will probably not merit his attention.

p.s. Is it just me, or do we need to have a widescreen monitor to read the posts around here now?

Good thread - I hope you don't mind me moving it to Site Discussion?

I think Prince.org has been pretty careful about such things - disclaimers galore smile And it helps that one of our moderators is well trained in law (Matt). I guess the avatars and lyrics could be problematic, but it would be a simple matter to remove those features if needed I guess...

Okay,fine. Regardless, as long as p.org doesn't do what freemyheart did, I don't think that it will merit his attention.

Posting a link to material that someone else is hosting is NOT illegal. Prince was just throwing his weight around online, as he has done for many years in the past.

Of course, if there ever WAS something on the Org which violated Prince's copyright and he asked us to remove it, we'd happily comply.

Gotta question, has the legality of linking to music files hosted by someone else been decided in the States yet?

I know the Ticketmaster case sorta resolved "deep linking" but I thought the mp3board.com case (which seems more analagous) was still going on?

Let me add... back around 1998, we received an email from Londell McMillan (Prince's lawyer at the time) that asked us not to allow bootleg trafficking in the PPML Marketplace. We immediately instituted the "no bootlegs" policy that's still in effect today at prince.org. Other than that, we haven't had any complaints from Paisley Park. In fact, Mr. McMillan's email said that, aside from the Marketplace, they had no objection to our operations.

If, in the future, Paisley Park has a legal dispute regarding prince.org, I hope that they contact us and try to resolve it amicably, rather than just filing a lawsuit without warning (as was done to Uptown back in 1999).
Please note: effective March 21, 2010, I've stepped down from my prince.org Moderator position.
