The 'letter' to prince.org from Prince's lawyers

Has it been published on here? Rather than trawl through a million threads I'd like to know first what his lawyers have requested rather than getting it secondhand. Can anyone help or know if it's been published on a link?

I think it's only fair that prince.org publishes it..so we can all get an informed opinion of what is being requested.

(sorry if it has been already!)

for the millionth time (and read some of the threads before posting these) Prince's lawyers had the letters COPYRIGHTED. So re-posting them (which Prince didn't want) alone, opens you up for more lawsuits.

Sorry again, as I said I've only just read the home page and the 'goings-on'

A bit odd though. I mean I would have thought he would have wanted his opinion known., not from 'US HERE' copying them into a forum, but just allowing us to read them..perhaps on the homepage.

It's difficult commenting on something where we haven't the whole facts!

(and I really asked for a LINK to an official statement really!) not a copy..hehe

Still for me I don't KNOW about what the official communication was about..so I can't form an opinion.

Oddly on another issue...say prince.org WON ...the essence of the site is to encourage love for Prince and his music.....is the site over now? I mean if p.org did WIN ...how 'could they' continue after that? Is it a kingdom divided now? (Prince and lovers of Prince?)

I mean whats the fight over? It's become not about Prince at all...BUT the essence of the site IS about Prince.

I think things can get a little out of hand! Almost like a fight over a piece of land.

I think I know what Prince wants to do- to create a new paradigm and president and more besides of all sorts of things...a new respect beyond what we have now..to the nth degree. I wish he would communicate to us fams though...then we could understand.

You can pretty much get your questions answered by listening to Ben's podcast. It's a very extensive interview that makes many things quite clear.

Halfway through the interview I hear - 'Prince is a just a footnote to this site'....if so...call it something else surely? How can you let a site that is based (even semi) on an individual and his expression continue?

I'm still hoping to hear Prince's statement on all this...but I'm thinking that this will be about a philisophic statement about what makes things work in society.

Question is - do you love Prince for his music only...or the drive to change things in the world?

We'll see.

ben's point was that this site has naturally evolved...prince is the uniting theme of this site but its become much more then that.

Has anyone checked if this copyright actually exists? Afterall, they seem to be bullshitting about a lot of other things.

You do not need to register your copyright anywhere. You simply create something and claim copyright on it, and presto, you have the copyright.
The little (c) things you see are exactly that, someone claiming copyright.
Not to be confused with things such as registered trademarks (TM).

Copyright exists to prevent republishing without consent of the party claiming copyright and possible loss of income because of it. However, it's dubious that it can apply to letters that are being sent out by the Sheriff because 1. they are heavily standardized/contains paragraphs that are used over and over again in different correspondence/contain industry standard formatting/etc so they do not represent an original piece of work and as such do not fall within the intended use of copyright 2. i do not see a context wherin Web Sheriff and/or his clients could ever claim loss of income (this is pivotal in copyright) by making these letters public, except for possibly being outed as abusers of our system which may or may not have repercussions on their bussiness dealings... but this can never be the problem of anyone else but the Sheriff and/or his clients.

In UK and European law, what you describe is property rights, not copyrights. Copyrights should be registered.

Even in the US, the law states this:

"To enforce a copyright in U.S. federal court, it must first be registered, as proof of ownership, and a copy deposited with the Library of Congress. Copyrights registered early do have the benefit of certain statutory fines, if an infringement is proven."

Just to try to clarify a point...

- I haven't published the cease-and-desist letters... yet. I may soon, however, depending on what my laywer says.

- Any claims of "copyright" on the EMAILS sent is b.s./unenforceable says my lawyer smile
