Just the fact alone that he even tried this stunt is good enough for me. His expanation needs to be over the top for me to reconsider support for him. Seriously. How dare he even pull this crap in the first place. Honestly, someone cannot post a picture of his album cover and then disertate on how it saved their life or what it means to them without fearing a LAWSUIT. That alone is sickening and appalling and uncalled for. TOTALLY.

Well a great teacher of mine once said "Just cause someone says "Im gonna sue you" ..does not mean they are going to win the fight"

And thats all I have to say biggrin

Not true...

All of photo journalism would be stopped in that case. If prince is walking down the street and I take his pic...its my pic. I can come here and say....Hey look at the pic I took.

This is how I understood the law.

If Prince does'nt like the picture or the way you have published it. He has the
right to take legal action.

Well then wouldnt all the tabliods, poparazzi, and negative celebrity sites be out of buisness???

The issue over copyright on the letter was described today by a Trading Standards officer as "total bluff"

If anyone wants to read up on copyright law check out www.statutelaw.gov.uk and search under copyright

The Copyright Designs and Patents Act 1988 etc cleared up quite a few issues

Companies tend to get complacent when they are used to people rolling over at the first mention of "cease and desist"

Did this trading officer actually see the letter?

No, I read it to him over the phone in its entirety twice and then several sections a few more times

He actually laughed at two parts of the letter

The reason why celebs don't sue is because they are scared of the tabloids.

And that they might look stupid for being so petty.

They get away with it by instilling fear into there targets.

If you take his photo you do not infringe his copyright unless there is a prior contract

I strongly suggest you speak to someone who knows what they are talking about before coming out with what purports to be an authoritative statement that is incorrect

Absolute rubbish !!! NO contract is needed !!!! If you take a photo of anyone without there permission and use it for publication without there permission you infringe there copyright.

The same goes for video and audio.
[Edited 11/7/07 11:35am]

You are clueless, go get an opinion off an expert

I am legally qualified and have more experience in trademark and copyright law than you can imagine

I double checked my opinion with that of two trading standards officers, one of 18 years experience and one of 20

Exactly what are your qualifications in copyright and trademark law?

And on what do you base your "expert" opinion?

Or are you just here to wind people up as most of your posts appear to do?

Good luck Prince.org and all the other fan sites. Don't take this lying down.

If there is a fighting fund set up, I'll contribute.

The org has been a really great friend to me over the years - in all seriousness, probably the one site that's meant the most to me since I started proper internet usage as a student.

Regardless of legal rights and wrongs, this is just stupid, and really spoils what has been a great couple of years for him.

Are you able to confirm whether or not there is a request for tatoos and license plates to be banned? If so, are you able to provide only that text or is that infringing on the so called copyright of the actual letter if you publish just this piece?

But THAT I can truley understand..if a celebrity wanted to sue that tabloids..

If I was a celebrity and there was a fat, cellulosis, spider viens, photoshopped it to make it worse having picture of me on the front cover ..I would go after those who took it..Now thats degrading..and half the time the tabloids make up ridiculous stories to make 2 cents.

And I truley believe that fans would support celebritys in it because the paparazzi expecially can be dangerous (ei Princess Diana). There should be limitations as to how close they can get.

But this is different...

Getting off track here I know biggrin

The one email that has been published on here relates to the princefansunited website and statements on it

There is no reference to images in it at all

It does try to claim copyright on the content of the letter and is signed not by an individual but simply "web sheriff"

I have not seen any of the other emails or correspondence

I think it would be useful if everyone did see them

It might clarify any possible misconceptions

Just read this on Yahoo.com. According to the article that I just read, Prince is expected to issue a full response to the fan sites' statement later today. You have a lot of explaining to do, Prince!! Hopefully he'll be clear in what he tells us, it won't be in some cryptic language that will leave us scratching our heads. We all know that sometimes Prince talks in circles.

I'm praying he will be clear and direct with us. It's time for some answers.
I'm not a fan of "old Prince". I'm not a fan of "new Prince". I'm just a fan of Prince. Simple as that

Agreed! Matt, where are you?

NOT to speak for him or anything, but...this may not fall under the kind of law that matt practices, or he may just be deciding that it's not in his best interests to get involved. so who knows. i'm sure he's heard about all this mess, and if he feels comfortable chiming in, he certainly will. nod

He might be particularly concerned about chiming in in an informal way if there's any possibility of him becoming formally involved later. I'm not expecting him to say much on the boards.

Which is too bad, cuz I'd love to hear an educated opinion on the legal details.

As I look on the web about this issue, it states that the author of the photography is the owner, not the subject.

The photo can be used for any non-commerical use - newsworthy - without permission of the subject.

I think what also is happening is there's a long history of Prince vs the fans stuff going on. From Uptown to the collective nonsense, Prince seems to have this hate-hate relationship with the hard core fans.

Its just hard to look at this objectively with history.

Exactly and like I stated above, even if you take out the extreme stuff like the tatoos and license plates the request is still outlandish that we cannot post album covers or lyrics and discuss them and why does anybody owe Prince or these companies any money for doing just that? It's outrageous at best.....

It really is.

And you know he's going to come out and say:

"Fams,

Our cre8or has blessed me with the gifts eye share with the world. Eye feel blessed 2 b able 2 do so. Eye only ask 4 the same respect u would show 2 ur friends and family, which is 2 use my image and art only with my permission. Eye am asking my fams 2 respect my wishes. It is meant in the spirit love4oneanother. All praise 2 the almighty Jehova.

Peace, Prince"

And his Fams are going to go, "aw, u know, he's right, it is just a matter of respect. we can talk about our love of his music without actually posting the lyrics. we know them all anyway! the h8ers should really go somewhere else. we love u, Prince! the check is in the mail. . ."

And the rest of us are going to go, "mutual respect doesn't generally involve lawyers rolleyes ".

And then either the fansites will roll over, or shut down, or they will find the resources to fight him. And all of those options are lame.

And WHY are things in this state?

Because the man gots issues.

We all do, right? If we were only gonna love issue-free people, it would be a lonely world. People can have issues. People can express their issues. People can ask for help with their issues. All of that applies to Prince.

What I've had about enough of, though, is people who think it is their RIGHT to make their own pathology into everybody else's problem. Which is what Prince is doing. And I can feel all kinds of happy mushy stuff towards him and his music, but his behavior is ridiculous and we've got every right to say so.

And certainly the right to stand up for ourselves.
