New version of the website but not of the terms and conditions. They are still saying you can't copy any of the material, not even a copy for personal, non-commerical use on another device than your laptop or desktop. And they are still saying they can terminate your "license" AT ANY TIME, even in the case you haven't "violated" the terms.

Permission is granted to temporarily download one copy of the materials (information or software) on NPG Records’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • 1) modify or copy the materials;

  • 2) use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

  • 3) attempt to decompile or reverse engineer any software contained on NPG Records’s web site;

  • 4) remove any copyright or other proprietary notations from the materials; or

  • 5) transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by NPG Records at any time. So, now I am prohibited from using or accessing this site, says the terms.

Why do I not agree with the terms? Well for one, beause they prohibit me from using or even accessing the site when I do not agree with any and all conditions it sets.

But there are several more terms and conditions of use that I do not agree with. Let me pick out just one for now, for the sake of simplicity.

Under paragraph 2 of the terms it says:

What this simply put says is, that when I buy a song on 3rdeyegirl.com, I do not own the copy of the song that I pay for to download. It's not like when I go into a record store when I buy a copy and own it, and therefore can sell it or lend it or make copies for personal, non commercial use of it. On 3rdeyegirl.com I only buy a "license" or conditional permission to "temporarily download one copy".

That one copy is "for personal, non-commercial transitory viewing only". Transitory meaning only temporarily, meaning one day, who knows when, I might not be allowed to view or listen to my legally purchased copy any longer. Moreover, I am also not allowed to make any copies of the material, not even for personal, non-commercial purposes. Since I may only make one copy and not make any copies of that copy.

Strictly and all lawyery speaking this means that when I buy a song from 3rdeyegirl , I may only listen to it on the device that I download it on. Since I am only allowed to make one copy. That means that if I download it on my computer, I am not in my rights to transfer a copy to my Ipod for example, or make a CD of it and listen to it on my stereo, or in the car, or wherever. Let alone sell my legally purchased copy to anyone.

Since I only bought a "license", a permission to make and listen to only one copy. But in my country, the Netherlands, the law says that I am allowed to make a copy for my personal use. That's "my applicable local law". So why would I sign that away? They even ask me to comply with my local laws, but this way they are not complying with mine. So I simply don't agree with doing that.

Of course I could say: who cares? Copy away! But I would ask then: what are these terms of service really worth then and why do you force me to agree with them? For sure, if hypothetically speaking, there were ever any lawsuit about it (you never know with Prince), these terms would be worth a lot. But would a lawsuit be worth it in the first place? I don't think so.

Then why still force your customers to agree to such draconic terms? Why not be just a little bit more fair and realistic, less controlling and most of all more practical.

No, no go for me. And I am not going to download it illegally either. I think I will just PASS (again).

At the end of the day, if this was legalese.com, lawyerslunch.org or legaldiscussions.com...i could understand why you are all up in arms....however, the reality is that his is PRINCE.ORG. implied is a biased demographic...a degree of "appropriate terms or not, im getting this song, and a whole lot of who gives a fuck...or apathy i should say.

So like someone selse said...calming down would/could/is a great idea... and taking the discussion to a domain name where the discusion you wanted would be more apt to happen would/could/is a great idea

Yes...of course...we are all free to discuss whatever we want. If i want to start a discussion on....hmmmm...lets say the differences and pros/cons concerning the use of 90 minute and 45 minute mud...i will get a a huge lack of response, and a large portion of the response i will get will be from those who like to have fun, ise their wit, and play with words. They will probably send some signals that, in this venue, the OP's intended discussion is of minimal importance. Let's say that I, the OP, insist on a different degree of importance, disregarding the given signals. I should also entertain the notion that I am being silly for expecting something from people or a group who are telling me im not going to get it, and for reasonable reasons as well. I should begin looking elsewhere for what I want. This is prince.org and not...ummm...drywallers.com or drymudandsun.org.

Actually there is a law in the USA also that allows for "hometaping", it's called the Audio Home Recording Act.

It allows you to make copies of audio recordings for your personal non-commercial use. However, it was enacted in 1992 and the US Congress hasn't quite made sure this law is also applicable to the internet.

However MY law to make copies for personal, non-commercial use does apply to the internet and yours SHOULD also, but when you agree to the 3rdeye girl terms you do NOT have those rights!

Audio Home Recording Act

The Audio Home Recording Act of 1992 (AHRA) amended the United States copyright law by adding Chapter 10, "Digital Audio Recording Devices and Media". The act enabled the release of recordable digital formats such as Sony and Philips'Digital Audio Tape without fear of contributory infringement lawsuits.

The RIAA and music publishers, concerned that consumers' ability to make perfect digital copies of music would destroy the market for audio recordings, had threatened to sue companies and had lobbied Congress to pass legislation imposing mandatory copy protection technology and royalties on devices and media.

The AHRA establishes a number of important precedents in US copyright law that defined the debate between device makers and the content industry for the ensuing two decades. These include:

  • the first government technology mandate in the copyright law, requiring all digital audio recording devices sold, manufactured or imported in the US (excluding professional audio equipment) to include the Serial Copy Management System (SCMS).
  • the first anti-circumvention provisions in copyright law, later applied on a much broader scale by the Digital Millennium Copyright Act.
  • the first government-imposed royalties on devices and media, a portion of which is paid to the record industry directly.

The Act also includes blanket protection from infringement actions for private, non-commercial analog audio copying, and for digital audio copies made with certain kinds of digital audio recording technology.

By using the terms "digital audio recording device" and "digital audio recording medium", which have specific meanings in this legislation, Congress required that in order to be exempt from copyright infringement actions, digital copies must be made to a device or medium marketed specifically for recording audio.
