CONCERT in GENEVE - What are you doing???

For all the people with tickets for the concert of July 23rd in Geneve....what are you doing? Are you waiting for more information from the promoter (???) or www.resaplus.ch" or someone else?

Resaplus needs to deal with the 'promotor' first.

That's why they try to gain some time by saying that the decision to refund or postpone the show is still pending.

Yet, resaplus is our sole contact. They sold us the tickets.

So we need to pressure them.

They they can be more open about the situation.

I can post a Swiss Le Matin article later today, shining some light on the status quo.

We did business with resaplus, right?

They want to stay in business.

So they will refund us or provide the service of a concert.

Getting the money from the promotor is their job.

We spotted a suspicious building while walking from the Petit Lancy neighborhood towards Geneva city:

So we had a look closer, inside:

So what is this?

There was a PIN-type security thingie on the inside door.

No reception, no real setup for visitors.

The lights were on on the 6th floor... (saturday...)

There are two ideas i guess:

1. we give the tickets back to resaplus and get our money back. This would have two effects:

a. if there is going to be a concert soon, we will have to buy new ones (maybe not in the categorie we want, if too late)

2. we wait to get new informations and leave the money to resaplus (and an eventual promoter 8which hopefully would be able to organise a gig), which may increase the chance to get a Prince concert in geneva (or nearby) soon. Otherwise with no money there are little smaller chances to get a concert, i guess.

What do you think?

So a new concert (date) looks quite tentative right now.

Combined with the shady position of the promotor, the probable holder of the ticket monies, I would now rather get a refund than wait for another reschedule

BTW: while in Geneva, we visited the Stade de Geneva and stole the greater part of the posters that were on the outside of the windows, announcing the postponement of the show from the 12th to the 23rd.

The venue really looked empty. A concrete, windy skeleton with a green grassy field in the center and some materials stacked in some corners around the stadium.

No other fans in sight during that morning.

The nearby shopping center had a person acting as salespoint for resaplus tickets.

They said that the decision about refunding or postponing (again) was still pending.

Yeah, right.

I bought my ticket from resaplus.ch so I hold them responsible for reimbursement, no mattter the promoter's default. THEY must take care of matters, and I believe they have insurance... I haven't sent them an e-mail yet but I will in a couple of days if no information has been sent to us in the meantime, because I really believe Prince is not coming back to Europe, at least not until next Fall... and I will no longer buy any tickets unless I know the shows are being taken care of by Encore Productions... (Pascal Bernardin) confused

I still don't understand how Prince's management could have dealt with this shady Daniel S. Quarcopoome when there are promoters in Switzerland who are well known in the business and who could have dealt with organizing his concert. Some people should get fired... No, they won't! Resplus' only job was to sell us tickets! And that's what they did! For the rest, they can totally refuse to have any part in it and let us deal with the concert promoter ourselves (which I doubt they will though... unless the concert promoter is indeed a crook and has left with the money)! I suggest you read the AGB!

3. Tickets

3.1 Customers acknowledge that rights and obligations, in particular from ordering tickets and/or making use of other services available on the Resaplus website, arise solely between the respective promoter and customers. In respect of any kind of concerns or claims in conjunction with events themselves, apart from in relation to processing the ticket procedure, customers are to approach the respective promoter directly.

3.7 Tickets shall remain valid should an event be postponed. In the case of cancellation of an event without a replacement event, tickets may be returned, if specified by the promoter, within 30 days following announcement of the cancellation. Customers who have purchased their tickets via the Resaplus website or the Resaplus call centre, and have paid by credit card, can be refunded for the value of the ticket, at the exception of the delivery, processing and credit card fees. In all other cases tickets are to be returned to the Resaplus outlet where they were bought.

3.8 Resaplus or a Resaplus ticket office shall, in any case, only reimburse the purchase price to the extent that the promoter's respective regulation enables Resaplus or the Resaplus ticket agency to reimburse amounts. The promoter is the only responsible for reimbursing amounts for ticket prices. Reimbursement that extends above the ticket price is excluded in any case.

We have a contract with the concert promoter, not the ticket selling agency! Well, we had one, but Resaplus fullfilled their part!

Good luck with that! They were hired to sell tickets and that's what they did! The fault doesn't lie with Resaplus, but with the Promoter! And as stated in the AGB, whether the concert takes place or not, is not their responsibility! Sad but true! I'm just so glad I only got a 30 € ticket and not the expensive ones!

On the Geneva ticket, there is no mention of the promoter nor the name of his company, I therefore hold resplus.ch as responable contrary to the Nice tickets where Encore Productions was clearly mentioned.

Did I legally acknowledge them?

Are these terms fair?

I did business with resaplus.

So I expect a product, a delivery.

As the ticket is only a placeholder.

So if the promotor defaults or offers only a partial refund, the war is on.

You can't order the tickets unless you tick off the box saying that you acknowledged it! Whether you read them or not is your business!

If you deem them not fair (which indeed they aren't, even though common), you are free to not order the tickets!

Yeah, and Resaplus delivered... you got a piece of paper saying "Prince @ Stade de Geneva, July 12th", which is their product!

Yeah, but the war is on with the Promoter, not Resaplus, who was only a middleman to sell tickets! wink wink

Resaplus did not reply to any of my emails, yet.

No update on what they are doing.

No contact info on the promotor.

Nothing.

I've got always an answer from them (more polite than resaplus...): let's see what they suggest to do in this case. Probably they will try to contact directly resaplus in order to have some more information.

I'll keep you updated...or it would be better if you write them too...

Because resaplus aren't exactly replying to my emails, despite the nice wordings, I would like to give them a call.

They only give a pay-number: 0900 552 333and a fax.

Does anybody have a number that can be used for international calls to resaplus?

I just want clarity on the situation:

Is the 'promotor' in cooperation and communication with the ticket
seller to arrange a refund?
Is the 'promotor' in cooperation and communication with the artist to
arrange a reschedule?

If not:

What is the Swiss process that leads up to a warrant for his arrest?
What can we do in this case to help it proceed more quickly?

PRINCE - INFORMATION

Samstag, Jul 31 2010
Dear Clients,

We sincerely apologise for this most distressing situation that has deeply affected us.

At the present time, it is not possible for us to make any reimbursements for the Prince concert of 23 July 2010 that was annulled.
No precise instructions have been received from D. S. Quarcopoome or the promoters, and the advance payments have not been returned.

For this reason, Resaplus SA will take legal action as of 2 August 2010 in order to reimburse the clients for those tickets.

Resaplus will not abandon this and payments made for the concert must be recovered and our clients reimbursed.
However, it was necessary to allow a few days for the organisers and their partners to clarify the situation.
For the time being nothing has been settled and everything will be done to resolve this affair and reach a positive outcome.
Resaplus is also a victim of this appalling situation and we are fighting for our clients.

An official announcement via the media, internet and at sales' points will be made by Resaplus during the week of 2 August.

Thank you for your patience and your comprehension.
