Ebay Auctions of Tickets: Face Values?

I went to Ebay to auction off an extra front row ticket I have for the Saginaw Show. I remember there being a reserve you can set that automaticly wins the auction. By Michigan law, I am required to charge what I paid for the ticket. Before I set up shop, however, I checked the prices for the other tickets being sold.

In the fine print on these auctions, they all say (for the Saginaw and Detroit shows) that max cost per ticket is $190.00 USD.

Who determines this to be the max cost? Does Ebay? Does the seller? I would love to get up to $190 for my ticket, but I don't think it is legal?

Anybody who can give legal background on this, please let me know!

it's illegal in most states 2 sell tickets 4 more than face value -- that's scalping. Plus it just ain't right.

Dude, I'm not charging more than I paid!

The tickets cost $85 dollars. Ticketmaster charges $8 in fees. If a buyer wants to re-imburse me for FedExing Overnight or UPS Overnight, I'll add that into the charge.

MY PREVIOUS OFFER IS NOW OFF THE TABLE. MY TICKET IS NOT FOR SALE. I WILL NOT OFFER ANYTHING LIKE THIS AGAIN UNTIL THERE IS A FORUM WITH RULES DEDICATED TO SUCH TRANSACTIONS.

I wish that I could have seen your post earlier. I live in Detroit MI where the 03/06/02 concert sold out before I could get tickets. My girlfriend and I are desperately looking for tickets! As for the accusation that was made regarding your being a scalper, I don't agree. You're not making money, you're simply trying to get reimbursed for the money that you spent. It's the same as if you had bought the extra ticket for a friend and he/she paid you for it. If you know of anyone who has two, let me know.

The Indiana Supreme Court has held that ticket scapling is protected under our state constitution, at least to the extent that one cannot be criminally prosecuted for it. See Kirtley v. State, 84 N.E.2d 712 (Ind. 1949).

As a capitalist, I disagree with statutes that prohibit ticket scalping. The "fair" price for a ticket is whatever the market will bear. However, I have no problem with (and I even support) contractual restrictions on scalping and private measures to enforce them, such as Prince's voucher system 1997-98.

The PPML rule (and, it seems, the de facto prince.org rule) on reselling tickets is found in the PPML FAQ:

Tickets may not be sold for more than their retail price. The PPML strictly prohibits "scalping" and "ticket brokers". If you intend to sell tickets on the PPML, you may charge the face value of the tickets plus any fees charged by the authorized ticket agency. For example, if the ticket price was $60 and you paid a $3.50 Ticketmaster surcharge, you may charge no more than $63.50 for the ticket.

As for laws on reselling tickets... IMHO it's the reponsibility of the people involved in the transaction to comply with any applicable laws. I'm speaking only for myself here, not in my capacity as a prince.org staff member.
