New Laws Eliminate Cash Bail Reformfrom Non-Violent Crimes

So this is similar to Chicago's I-Bond law. And that is some trouble for Chicago.

New York State has a similar Bail law on the books set for January.
I can see not hitting certain misdemeanors like driving without a liscense or something that really isn't a hazard to society/neighborhoods etc. They are going to need to be very sharp and technical on this one. Catch and Release is already a problem.

NYS will be legalizing Marijuana very soon, so differintiating between someone in possession(smoking) vs someone dealing -illegally will be an interesting puzzle for them to put together.

There are a good number of violations on the 'non violent' list that i seriously concider 'violent' and a problem if someone is if caught but let go.
Also it is not a Federal crime to committing abuse against an animal.

But Endangering the Welfare of a Child: NY Penal Law 260.10

I know 'what' the specific accusation is makes a difference, but to return a person/parent to a child with just a ticket to appear?

District Attorney Fears Public's Safety Following Bail Reform

Sweeping criminal justice reform goes into effect in three months, and some local district attorneys are sharing concerns on social media.

Starting in January, judges across New York will have less discretion when a defendant first appears. There's no more cash bail for most misdemeanor and nonviolent felony arrests. The list includes criminally negligent homicide and unlawful imprisonment. If you're accused of one of those crimes you'll be issued an appearance ticket. The expectation is you'll go back to court for your next court date instead of possibly sitting and waiting in jail.

"We shouldn't be locking people up just because they can't afford to pay the bail when they are legally presumed innocent by the US constitution," said Emily Singletary, the co-founder and co-executive director of Unchained.

Bail was intended as collateral to make sure people showed up at their court dates. Advocates say it disproportionately penalizes minorities and poor people.

"The attorneys and the judges who are making these bail arguments, they could afford $2500 bail," said Singletary. "It doesn't occur to them that, you know, a lot of the people that they're dealing with in court, nobody in their entire social network could come up with that."

Gov. Andrew Cuomo says the changes mean 90 percent of people arrested and charged, but not yet convicted of a crime, will stay out of jail.

Onondaga County District Attorney Bill Fitzpatrick says this could jeopardize public safety. Judges will not be able to consider a defendant's history.

"The person who is going to be assaulted or killed by someone out on bail who any under normal, sane set of regulations would've been held pending trial," said Fitzpatrick. "That's my biggest fear."

The new laws don't eliminate bail all together. For cases where bail is acceptable, the new law requires multiple forms of bail to be set. That means the court could include credit cards or allow your family to help pay.

The changes will not be retroactive.

The criminal justice reforms also touch on enforcing trial deadlines and sharing evidence.

Once again, do not be misguided in your belief that if an offense is a property or non-violent crime it will not be vigorously prosecuted by the District Attorney's Office. For that matter, if you believe that receiving a New York City Desk Appearance Ticket signifies that the case is of nominal consequences, know that if you are convicted the ramifications are no less than the police held you in jail for 24 hours before seeing a judge. Remember, even if a non-criminal disposition is reached there may be lifelong implications to your career.

NEW YORK (CBSNewYork) – The NYPD's Deputy Commissioner of Intelligence and Counter-terrorism says New York is bound for trouble if the new bail reform plan goes into effect next year.In 2020, new criminal justice reform will eliminate cash bail in New York. It calls for people arrested on low-level misdemeanors or nonviolent felonies to be released without bail, until trial.

"Everybody who gets arrested for anything except for maybe murder and attempted murder is going to be released without having to pay any bail, right at arraignment," Miller said.

He criticized the reform for eliminating incentive for criminals to stop breaking the law.

"Before they enacted this law, 89%, 89% of people were being released at arraignment without having to pay bail anyway," Miller said. "Now that's going to go to probably 99%, which is going to be a problem because criminals are going to know at the time they're arrested 'I'm not really risking going to jail, I'm not really risking anything except going through the system and coming out at the other end.'"

NYPD Chief of Department Terence Monahan back Miller's sentiment.

"You're talking about people who can sell pounds of cocaine and walk out with no bail. Someone burglarizes your house and walks out with no bail," Monahan said. "We're going to be facing some major issues come Jan. 1 if this doesn't get changed."
