New details about the Jussie Smollett alleged attack case have been made public, following a judge's ruling to unseal legal documents.

Not good news for Jussie. Also Jesse William(whom I worked with on Grey's Anatomy) has won the coveted role that Jussie auditioned for the day of the attack.

I know they put out some of it weeks ago but were told to stop. But I had it... it was not interesting. This may be more telling. It is clear he made it up and should have gone to trial. Last I heard the FBI is close to making a statement on the federal charges.

there is a ridiculous about of evidence against Jussie. Not only for this hoax hate crime (which IS a hate crime) but for other crimes... there us ZERO excuse to just give him a pass.

Apparently the other day while I was at work generating tax money to pay for the investigations of Jussie's and other people's fake hate crimes, the thread deteriorated to the point where it was removed. Not a surprise as we know the usual suspects want to shut down every thread about Jussie.

I ask that everyone please, please stay on topic and don't get baited into offtopic nonsense. Don't give the usual suspects what they want.

As for Jussie, is it at all surprising the corrupt State's Attorney's office all the way back on Feb 28 instructed Chicago PD to end the criminal investigation. There has GOT to be consequences for the actions of the State's Attorney's office, what they did was itself criminal.

Special Prosecutor to Be Appointed to Investigate Handling of Jussie Smollett Case, Could Reinstate Charges

A Cook County judge on Friday ruled that a special prosecutor be appointed to look into State’s Attorney Kim Foxx’s handling of the Jussie Smollett investigation, according to local Chicago news reports.

Judge Michael Toomin ruled that Foxx, who recused herself from the investigation, had no authority to appoint First Assistant State’s Attorney Joseph Magats in her place, reports CBS 2 Chicago. Toomin argued that Foxx essentially appointed Magats to a “fictitious” office. The prosecutor would be allowed to bring forth new charges against Smollett if it is deemed there are “reasonable grounds” to do so, according to the report.

“What causes concerns is that she appointed him to an entity that had and has no legal existence. There is no office of acting state’s attorney,” Toomin said, according to the report. Toomin argued that this meant there was effectively no state’s attorney when Smollett was arrested, charged, indicted, arraigned, and when the charges were eventually dropped, meaning that all those decisions are invalid.

I am not comfortable with the SAME charges being brought back up. The way they were dismissed seem to be more a kin to an acquittal. (Which I believe was intended as was charging him with some many separate charges)

We all owe an enormous amount of gratitude to former judge Sheila O'Brien, as without her efforts the special prosecutor would not have been appointed to re-investigate this travesty of justice. It took a special, admirable woman like her to accomplish what a large number of people couldn't and wouldn't ... pursue justice.

To further muddy the issue, Foxx’s office first said she had recused herself from Smollett’s prosecution. Later, though, her office claimed Foxx had not recused herself “in the legal sense."

In his ruling, Toomin called that “an exercise in creative lawyering.”

“Under that rubric, Foxx could carry on as public prosecutor, unhampered by her contradictory statements,” wrote Toomin, 81, who has been on the bench for nearly 40 years. “However, discerning members of the public have come to realize that the ‘recusal that really wasn’t’ was purely an exercise in sophistry.”


Toomin “absolutely nailed” the complex legal issues, Ekl said after reviewing the judge’s written order.


Rank-and-file prosecutors’ powers derive entirely from Foxx’s authority, Ekl said, and when she withdrew from the Smollett case, she was legally obligated to recuse the entire office.


“When the state’s attorney feels that he or she has a reason to recuse themselves, they absolutely have a right to do that,” Ekl said. “But (the statute) does not give the state’s attorney ... the ability to handpick who replaces him or her.”
