The thing that bothers me about this case is that it makes it look like these regulators are actually doing something. Martha should have been the last person on the list of corporate CEOs, stockbrokers and other corporate criminals who have so far got off scott free in the corporate scandals. They shouldn't have bothered with her until they nabbed the more important crooks first.

BIG co-sign. She's done some bitchy things, but I'm not excited to see her go to jail, and I think it's sad that people are cheering it. Definitely victim of a Bitch Hunt.

Another co-sign. Why the delight in a smart, successful woman's misery? Bitch hunt, totally. Not to mention that filling jail cells and using public resources to keep a person like her in jail is ridiculous. Only violent crimes should end up with jail time.

I feel sorry for her. Celebrity sucks.

Yet another co-sing. Why do people take so much joy in this 60 something year old woman that built up a huge empire just so see it fall becuase the government used her as a distraction to bigger problems in coroprations? Let's make an example of her while we forget all about the Enron's of the world. It's a good thing!

my concern was more with the way the public has looked at her. its as if they wouldn't do the exact same thing if the opportunity presented itself. unfortunately, the market is a dog eat dog world where screwing someone may be necessary to get ahead or save your ass. i don't agree with it, but nonetheless, that's how it is. martha was plain and simply being a business woman.

While this is an interesting way to look at her situation, it kinda misses the point IMO. Martha wasn't charged or convicted of insider trading, which is the behavior you're describing. Martha was basically convicted of trying to cover it up when the authorities confronted her about it. That's where this whole question of ethics gets murkier. It's one thing to try and not lose $50K (which was frankly pocket change to her). It's an entirely different thing to lie about it when questioned and to alter records..

"Criminals get caught when they make up stories afterward," said Frank Taylor, a securities attorney at Briggs and Morgan. "The message that is sent here is if you speak, you have to speak honestly. Sometimes when people make a lot of money and are powerful, they forget the basic rules and requirements. It doesn't matter how big you are, if you lie, you lie."

Bill Michael, a former federal prosecutor now with Lindquist & Vennum, agreed.

"The mistake here is one that is common throughout economic fraud activities," Michael said. "The coverup has more serious consequences than the original act."

Michael said that if Stewart had come clean immediately about her stock sale, the SEC might have handled the infraction as a civil matter and sought just a fine. When she didn't comply, "the government used her to show the public that no one is above the law," he said.

Let's face it, martha is a fishstick in a sea of sharks. While I think Justice was served, I won't be happy until they fuckin lynch the bigger thieves.

I was actually suprised when I heard the news. I doubt she will spend much time behind bars if any time at all due to it being her first offense, but we will see.
