i bet a careful review of your lease would reveal the words "peace and quiet enjoyment"' as pertains to your right to live without noise interference and likewise your neighbors' right to live without being forced to listen to your music.

you should definitely not be playing your music loud enough to be heard in a neighboring unit. word

389.60. What constitutes violation. (a) Any activity, not expressly exempted by section 389.50 or this section which generates sound regardless of frequency that is more than ten (10) decibels (A scale) above the ambient noise level when measured within any dwelling unit (other than the one of sound source) in a condominium, townhouse, apartment house, multi-unit dwelling, single-family dwelling, or similar dwelling between the hours of 6:00 a.m. and 10:00 p.m. All measurements applying to the above shall be made indoors with the doors closed, and within the dwelling. . .

I don't live in Minneapolis and my house rules on my lease agreement say between the hours of 9:00am and 10:00pm and doesn't mention decibels and shit

I live near a block of flat which look over my yard. Once we were lookin after my uncle and aunties doggy. Poor lil thing. One of the flat people went psycho at it when it barked...threw a humungus stone at the lil thing, opened our front gate then threw a stone through my mum's front window! SO the next day we put our music up SOOO LOUD (after callin da police ofcourse) hehehehe...it was fun...well not at da time... but playin da music blasting loud was giggle

In the meantime, I will be documented every time they pound down on me when I'm playing my music between 9:00am and 10:00pm!

hug Jan, I totally sympathize with you, your neighbor sounds exactly like mine. disbelief I'll never forget recently when I was walking around in my room (not pounding on the floor but walking softly) at night. It was early, I think about 8:15 - 8:45 pm. Suddenly, I hear this loud, "BANG, BANG, BANG!" on the floor separating my condo from the neighbor's below me (I live in an apartment style condo). It scared the shit out of me, not to mention pissed me off, so I went to the register and banged on it just as loudly. Assholes! pissed

Then there was the time a few years ago when I accidentally had a leak in the bathroom that went into the neighbor's place downstairs. I got word of it from the condo association, and my dad went over to my place with the maintenance guy from this place to have a look. When the maintenance guy and my dad got came to the neighbor's place downstairs, he acted like a total prick and wouldn't let my dad in. My dad finally convinced the prick to let him in and they took a look at the damage. Turned out to be a water leak, and the maintenance guy told my dad "not to worry about it".

A few years went by and I heard nothing more about the leak, so I assumed the problem was resolved. Then, about two years after this happened, I get a subpoena in the mail from the small claims court near where I live telling me that the prick downstairs is suing me for the amount that it cost for him to repair the damage ($300.00 - BUT here's the catch: Right before the court date, the prick neighbor had someone in his house doing repairs. He obviously was milking this claim for all it was worth, since he works in the insurance firm; I guess you have 2 years after an incident to file a claim, which is exactly what he did).

Again, my dad went to the prick neighbor's condo and knocked on the door, because he wanted to see the damage. The prick's wife (i.e. the bitch) was home, and my dad asked her nicely if he could come in to take a look at the damage. The bitch got all nasty and said, "Talk to the condo association, they know all about it", and slammed the door in my father's face! pissed omfg Excuse me, my dad was trying to be pleasant about an already uncomfortable situation, and you're acting like that???

So the court date comes along (whoopee rolleyes), so my dad and I, of course, show up for it. The judge came in and said a few words, then left us alone to discuss it and to possibly work it out. The funny thing about this part of the story is that my dad laid into my prick neighbor, telling him that we had a real problem with his attitude and with the way the whole thing was handled. I asked him repeatedly how the hell were we supposed to pay this water damage bill when he never even told us about it? Can you believe this prick did not even answer me, he would not even look at me. pissed LOL - my dad pulled me aside and told me that I needed to calm down a little before our appearance with the judge, because I was fuming mad! I wanted to choke that prick neighbor and punch his lights out.

Then the judge came back to us after hearing a few cases before ours, and we sat before her and explained our side of the story. Unfortunately, the judge had to go by the rules, so I wound up paying this prick $300.00 (which might not sound like a lot to some of you, but for me it is). The judge asked me how I was going to pay it, and I told her, "I'll give him $25.00 per month, that's all I can afford right now." I thought to myself, if this prick does not have the balls to come to me to tell me what is going on, he can wait for his damn money, to hell with him!

What is the worst about this whole situation is that this court ruling is now on my credit report, and it will be there for another few years. That is not fair either, because when I went to buy a car, of course a credit check was run, and that court ruling was on there. I explained to the car dealership what happened, and they understood completely. It was the same when I was considering buying a house (but didn't). Again, the court ruling thing came up, and I had to explain what happened. LOL - I remember telling the real estate agent, "That is part of the reason why I want to move, to get away from those people". Unfortunately, I still live here, but only because my current job pays shit wages and I can't afford to move anywhere else. I would love to move and get the hell out of here, get my own house and get away from these creeps, but it doesn't look like it's going to happen anytime soon.

But I know how aggravating living around selfish uncaring people can be. The people downstairs have someone living with them who talks so damn loud and can hear his voice all the way upstairs! I called the cops on them the one day because he just kept talking and talking and wouldn't shut up (at 12 a.m.). Also, these people have a dog that has barked in the wee hours of the morning 2:30 a.m. - 6:30 a.m. and have woken me out of a sound sleep. I lay in bed, pissed off that I have been woken up and even more pissed because I can't go back to sleep. Their cat sits in their back window in the summer and meows very loudly in the wee hours of the morning too. They open and close their closet doors (slam them) repeatedly at 8:30 in the morning (on weekends when I'm trying to sleep), which also annoys me. The list of the stuff they do to irritate me goes on and on. I usually get along well with most people, but there are some people you just can't get along with, and the people downstairs are one of them. I don't have any trouble at all with the other people living in this building, just them. I know that other neighbors have had issues with them as well, so I know it's not just me.

It's pretty shitty, Jan, that your neighbors get all bent out of shape about your music, when it's not even that late at night! They probably are the kind of neighbors who blast their music, then when someone complains about it, they say, "What? The music is not on that loud." rolleyes Perhaps your neighbor and mine should live near each other so they can piss each other off, and leave us alone. lol I look forward to the day when I can earn enough money so I can buy a house and get the hell out of here. For me it can't happen soon enough.

you would need to do a search for the word "noise ordinance" and then your city name.

i know i won't persuade you, you are beyond reason. but be aware that your argument cuts both ways
