DAMN I LOVE COURT TV!!!

More than any other station, I love Court TV.
Rite now, though this case has gone on FOREVER,
I am gettin some real entertainment.
Heaven forbid I should ever catch another case, but DAMN,
if I did...
I have seen some tricks in this case that I have never seen used. And I'm not alone in this. There are lawyer friends of mine that are taking note to whuts going on in N.Click.
Today is gonna be like a movie or some shit when the defence
comes out and trys to discredit an 'expert' witness. woot!

DURHAM, N.C. — After Michael Peterson's defense leveled a blistering assault on the credentials of a prosecution expert Friday, the judge ruled that the witness had lied on the stand and ordered his testimony struck from the record.

Jurors will not be allowed to consider the testimony of Saami Shaibani, who claimed to be affiliated with Temple University, after defense lawyer David Rudolf presented letters from Temple denying that Shaibani currently works there.

"Any claim by Mr. Shaibani that he is now a member of, or even affiliated with, the Temple University Department of Physics is fraudulent," read a Sept. 27, 2001, letter from Edward Gawlinski, chair of the Temple University physics department. "Furthermore, at least once a year I have to write this sort of letter when Mr. Shaibani again tries to establish his bona fides as an expert witness by claiming he is a member of the Physics Department."

Shaibani seemed rattled as Rudolf unraveled his academic credentials, while jurors' heads turned from one man to the other as in a tennis match.

Prosecutor Jim Hardin Jr. appeared blindsided by the new information and did not attempt to dispute the defense's allegations.

"If the court finds that Dr. Shaibani has perjured himself, the state's not going to object to striking his testimony," said Hardin to Judge Orlando Hudson Jr., who promptly ruled that Shaibani had committed perjury and instructed the jury to disregard everything the witness had said.

Shaibani testified Thursday during the prosecution's rebuttal case that, based on tests he had done on falls down stairs, the defense theory that Kathleen Peterson died as the result of such a fall simply "didn't add up." Prosecutors say that the December 2001 death was the result of a vicious beating by her husband, not an accident.

Michael Peterson, charged with first-degree murder, faces up to life in prison if the jury buys the prosecution's theory.

According to another letter Rudolf received from Temple's lawyers yesterday, Shaibani had a "courtesy appointment" as a clinical associate professor without compensation or permanent faculty status between September 1995 and August 1998.

Calls to the Temple University physics department were referred to the school's media relations office, which did not respond.

Shaibani, who said Friday on the stand that he was seeing the letter from Gawlinski for the first time, emphasized that his position was a research affiliation, not a teaching position.

Under his direct examination on Thursday, Shaibani had said that he was not currently paid by Temple and that, when had been doing research at Temple, he had been paid through grant money, not by the university.

But Rudolf was not satisfied.

"Do you understand, sir, that when you get on a witness stand and swear to tell the truth that it is perjury to lie even about something like what your position is at a university?"

"I understand that, yes, sir," said Shaibani.

"You've committed perjury at numerous murder trials throughout this country, haven't you," said Rudolf.

"No, sir," denied a wide-eyed Shaibani.

Rudolf also asked Shaibani if he was aware that he was under investigation by the American Academy of Forensic Sciences. Mouth agape, Shaibani looked to the judge as if in disbelief.

Anne Warren, executive director of the Academy, told Courttv.com that Shaibani was currently a member in good standing with the organization and that the ethics committee handled potential breaches of conduct under seal. But Friday's perjury allegations, she said, were exactly the sort of thing that the committee considers.

Under North Carolina law, Shaibani could spend 10 to 20 months in jail if convicted of perjury, a class F felony.

While most of Rudolf's assault focused on Shaibani's credentials, the lawyer also briefly criticized Shaibani's experimental methods, calling the stairway test in which he asked volunteers to fall backward so he could measure where they hit the doorjamb a "stupid" and "silly" extreme.

Rudolf also read from the transcripts of Shaibani's testimony at another murder trial in which a man allegedly drowned his wife in a toilet.

"I asked these women, put your head in the toilet and see if you can drown yourself and I'll fish you out," read the lawyer. "The laws of physics didn't allow them to drown themselves."

After court recessed for the day, Rudolf appeared elated as he was congratulated by members of his defense team.

"It makes me very very angry when a guy like this comes in and puts people's heads in toilet bowls and gets convictions," he said later outside of court.

"It's junk science. People are on death row as a result of it, and I think it's gotta stop," Rudolf said.

Joseph E. Kennedy, an assistant professor of law at University of North Carolina's law school and a criminal defense lawyer, told Courttv.com he had never heard of a situation like that which occurred with Shaibani Friday.

"It's just incredible that this man has misrepresented his affiliation so many times without being caught, and that the prosecution didn't discover it," Kennedy said.

Prosecutors, however, told Court TV that Shaibani was a highly regarded expert, and the controversy was a result of a misunderstanding. Other letters between Shaibani and Temple University would clarify it, according to prosecutor Hardin.

Kathleen Peterson's sister, Candace Zamperini, also said that Shaibani came well recommended by other lawyers but acknowledged that the prosecution "got kicked in the teeth" Friday.

All in all, it was a banner week for Peterson's defense, which rested its case Monday with the surprise presentation of a fireplace poker like one prosecutors claimed was the missing murder weapon. Rudolf said his investigators had found the poker in the Petersons' garage, dusty and apparently undamaged.

"I asked these women, put your head in the toilet and see if you can drown yourself and I'll fish you out," read the lawyer. "The laws of physics didn't allow them to drown themselves."

After court recessed for the day, Rudolf appeared elated as he was congratulated by members of his defense team.

"It makes me very very angry when a guy like this comes in and puts people's heads in toilet bowls and gets convictions," he said later outside of court.
