Certainly, being fired for saying something about someone in a private message sounds like grounds for an unfair dismissal claim to me, but of course I'm not a solicitor. You should have a word with a solicitor to see if you have a claim!

calling someone names, no matter how it's done, should me enough for firing someone these days, yes.

If that was the case everyone who ever said "oh my boss is such a prick" in private conversation would be out of a job... basically everyone in the world who has had a job.

Personally I wouldn't ever use company email for anything other than business, and I use my own personal email for personal stuff. Still though... they should have given him a warning, to let him know that the behaviour is not acceptable and that they do read emails. It sounds like some petty person with an axe to grind...

I think you could make a reasonable case of unfair dismissal...

Point is - they should have warned him first, and he should have been told that they monitor emails.

Also, it depends what you call a private e-mail. if you're using their facilities to send that e-mail, they might be responsible for what happends because of it. she could sue them if the e-mail came in from within the company.
