As long as you don't go into their yard to take them, you're probably safe. Of course, you could always wait until they fall. They'd be yours, for sure, in that case.

as far as I know that hang overs are legally yours to take, you could also get then to cut the branches on that side so they do not hang over.

I wouldn't figure it's all that complicated. Here, if your neighbors tree branches grow over into your property then you are responsible for maintaining those branches, keeping them trimmed and such, so yes the fruit that grows on your property is yours. Now as for things that grow on the street, here the person who's property it's in front of is the person who's responsible for the maintance of it, so I think it would be just common courtesy to ask, even though most people won't, but then most people wouldn't have cursed that lady like rhubarb lady did, so it's a balance thing.

If her tree is encroaching your property, you have every right to trim it or help yourself to the lemons that are hanging on your side of the fence. I would think you neighbor is aware that the tree's branches are handing over the fence onto your property and doesn't mind you helping yourself, but to keep matters on a even kiel, I would discuss it with the neighbor.

My brother is having the same issue with his neurotic neighbor. He had a pussy willow tree planted in his back yard. A few of the branches overhung his neighbor's property. The tree was very small, not a big bushy thing. And the branches weren't even an inch around, but this bitch took a pair of shears to his tree and chopped off the few thin branches hanging over the property line. She claimed they were shading her bushes she just planted, which was a lie becuase the branches on my brother's tree didn't have enough foliage to shade an ant hill.

The rhubarb lady, although surely a bit nuts, is probably right. The lady who planted the rhubarb planted it outside her property fence on the side of the public ally. Sure, it's "her" rhubarb, for she planted it, but she planted on public property which gives any person the right to help themselves. Now unless she has permission from the county to use the land for her own purposes, which is highly unlikely, she has no right to claim that land as her own.

I was growing a marijuana plant on my deck in a pot and I had the pot close to the deck railing separating my deck from my neighbor's. Our decks were not joined, mind you, just very close together. When the plant reached about 6 feet and started to droop a tad over my deck rail to hers, she cut the top out of my plant claiming, "I don't want that stuff growing in my yard." Just a few weeks prior, she didn't have a problem with it, but she got mad with me about something she perceived I did or said to her and cut my plant just to be spiteful. I knew she was trying to get me to buck, but I ignored her crazy ass. That really pissed her off. So the next thing she did was trap my cat and call the animal control and had him declared a stray, KNOWING it was my cat. Cost me $160 to get hiim back. I was thorugh with her ass then. Thank God she finally moved.

Yeah, well in this day and age, everybody and their mother is trying to get paid. They tacked on fines and fees for boarding and such. He didn't have a collar with a license, so I got fined for that, then the cost of them picking him up, the cost of him being in the shelter overnight and any other extraneous shit them deemed appropriate. It's all designed to get as much money out of the petowner as possible, knowing any responsible person is going to pay to get their beloved pet back. Had I not figured out what happened to him and just let it go for a few days, they might have put him down, and then I would be in jail for murder my damn self because I would have killed that black hearted bitch. It just amazed me what lengths she would take just to get my attention. Another friend told me she thought the bitch "wanted me." lol Too bad, but I don't swing that way.
