Although it appears no criminal charges will be filed against Gabriel Aubry in the Thanksgiving Day massacre of his face at Halle Berry's house ... cops on the scene concluded he was the instigator ... TMZ has learned.

According to the police report, after interviewing Gabriel, Olivier Martinez and Halle, ​the investigating officer concluded, "Suspect [Gabriel] arrived at victim's [Olivier] residence for child custody exchange. Suspect and victim engaged in verbal altercation. Suspect became upset and attempted to punch victim's head but missed and struck victim's right shoulder instead. Victim returned with 3 punches to the suspect's head, causing him to fall to the ground. Victim's fiance [Halle] notified police."

It's interesting ... Olivier and Gabriel each claimed they said nothing to incite the other, but the report concludes both were smack talking.


According to the conclusions in the police report, Olivier acted in self defense: "Victim defended himself and punched the suspect."

And law enforcement sources tell TMZ ... Gabriel never told police about the alleged death threats made by Olivier both the day before and during the fight ... threats he later claimed were made by Halle's fiance. What's more, cops contacted Gabriel after the fight and asked if he had more info, and he passed. There was no mention of death threats.

Nonetheless ... in the end law enforcement believes it's a case of mutual combat and it's almost certain Gabriel will not be prosecuted.

Attorneys for Halle Berry and her ex-boyfriend have settled court issues that arose after a Thanksgiving Day fight at the actress' home.

The fisticuffs involved Berry's ex-boyfriend Gabriel Aubry and her fiance, actor Olivier Martinez. Aubry was arrested after the fight, which left him with a black eye, a broken rib and other injuries.

Aubry obtained a temporary restraining order against Martinez. The model and Berry have been battling over custody of their 4-year-old daughter for months and have appeared twice in a family law court since the fight.

Blair Berk, an attorney for Berry, and Shawn Holley, who represents Aubry, released a statement after Thursday's hearing that said the two sides had reached an amicable agreement.

No details were released, and the attorneys declined to answer questions.

Although Gabriel Aubry and Halle Berry have split up, the model says he has nothing but love and respect for the actress, with whom he has a 2-year-old daughter.

“While I will not comment on all of the wild inaccuracies being speculated about in the media, I am sad to say that Halle and I have decided together to separate at this time," Aubry, a model, confirmed Friday in a statement to Access Hollywood released through his agency, Wilhelmina Models.

Reports of the couple's break up first began circulating widely on Friday. Berry’s rep couldn’t be reached for comment.

Aubry says of his Oscar winning ex, "She is, and will forever be, one of the most special and beautiful people that I have ever known, and I am certain that we will continue to have only love and respect for one another."

Berry, 43, and Aubry, 34, had been together four years. They first met at a Versace store opening in Manhattan in February 2006.

In the September issue of Vogue, Halle Berry opens up about her breakup with Gabriel Aubry for the first time.

"It's just that you realize you are not meant to go the distance with everybody. We were meant to bring this amazing little person into the world. And I think that's why we came together. And because of that, we are going to be together, forever, all three of us. We are a family until we are not here anymore," she tells the magazine.

Berry and Aubry, who split this past April, have a 2-year-old daughter, Nahla, together. They'd been together four years when they ended their relationship.

"We have always been friends, we're still friends, we love each other very much, and we both share the love of our lives. And we are both 100 percent committed to being the best parents we can be. And while it was not a love connection for us, he was absolutely the right person to have this child with because she is going to have an amazing father. And that was really important to me. Berry refused to remain committed to her ex romantically just for her daughter's sake. "I don't think I'm unlike a lot of people. I am just someone who is trying to find that mate, and I think it's a really hard thing to do. And I am not willing to stay somewhere where I am not really happy. And I am not willing to pretend I am for the kid's sake or so that I don't have to go through another public humiliation."

But the actress believes that the breakup is a positive thing. "It's about accepting who we really are, not who we want to be. As much as I have always wanted to be in this committed relationship and have the picket fence and grow old with the same person, I'm coming to terms with: Maybe that's just not who I am."

The two have been true to their word when it comes to raising their daughter, and have been spotted together occasionally since the breakup.

It's pretty remarkable, but a week after nuclear war at Halle Berry's house which left Gabriel Aubry's face a bloody mess, they have figured out a path to peace ... and the clearest evidence is that Gabriel's lawyer just went to court and dropped his restraining order against Olivier Martinez.

It happened just a few minutes ago. Shawn Holley, Gabriel's lawyer, told the judge her client no longer needed to keep Olivier away from him.

As TMZ first reported ... the parties struck an agreement Thursday to end their mega-dispute, which revolves around 4-year-old Nahla.

The remaining issue ... Olivier made a citizen's arrest after the fight and the case is going to the L.A. City Attorney for review. We're told it's "highly unlikely" Gabriel will be prosecuted.

If Halle can do it, maybe there's hope for Middle East peace.

And she should be. What Oliver did was despicable and he should have been arrested. This whole thing was a set up but it backfired on them both big time (kind of like when the Jackson's plans to kidnap their mother and overthrow Michael's Estate Executors blew up big time in their faces, but I digress.) I think Halle's plan was to get Oliver to confront Gabriel and push his buttons and get him mad enough to react and start a fight....I dont think her plan involved Oliver beating Gabriel into a bloody pulp, and my guess is she's pretty pissed at Oliver right now. Especially since her public image is taking a beating.
