Gabriel Aubry took another lump in his war with Halle Berry today ... a judge just rejected his bid to have the restraining order removed ... which means he still can't visit with his daughter Nahla.

Gabriel had gone back to court today to ask the judge to lift the emergency restraining order that was issued against him on the day he got beat up by Halle's fiance Olivier Martinez.

Initially, the restraining order was supposed to stay in place until Dec. 3 ... but today, the judge acknowledged there was a clerical error ... and the order can only stay in effect until Thursday Nov. 29.

The order prohibits Gabriel from going within 100 yards of Nahla, Olivier or Halle.

Gabriel wanted the order to end TODAY -- but the judge shut him down.

The cops were called, and both men ended up getting treatment at Cedars-Sinai Medical Center in Los Angeles. Aubry was booked on suspicion of misdemeanor battery, posted a $20,000 bond and has a December 13 court date.

Meanwhile, Berry has reportedly gotten an emergency restraining order to keep Aubry away. The two have been in an ongoing child custody battle. Berry was recently shot down by a Los Angeles judge who ruled that she couldn't move with Nahla to France, because Gabriel lives in Southern California.

Law enforcement sources tell TMZ, when detectives visited Halle's home last year to investigate a scary stalker situation, they advised her to re-position her home security cameras to face the fences surrounding the property ... in order to catch a possible intruder.

Halle obliged ... and the cameras have remained facing the fences ever since ... and could not have captured the front door area of the home where the fight between Halle's past and present men took place.

Actually the judge told Gabriel to wait a couple days. He ain't lost big with this. They just need time to see what needs to be done. From what I heard, Gabriel can still see Nahla but they're gonna need two days to go over it.

Yeah I saw this on TMZ and I call BS on this story. So the cameras didnt catch what happend cuz they were facing towards the fences and not the property? My, how convenient for Ms. Berry I do not believe that detectives would only tell her to reposition the cameras towards the outer fences of her property. Surely there were arrangements made for surveillance to be made on BOTH her property and the surrounding areas at all times. I think this is a story handed to TMZ by Berry's publicist, not the "law enforcement source" they claim. Story reeks of damage control spin.

I think both her and Oliver's careers and popularity will definitely take a nosedive because of this. This is already having a very negative impact on their image. The backlash Halle is getting online now kinda reminds me of the backlash Janet Jackson received this summer during the whole Jackson family fiasco, except the anti-Halle sentiment is more intense.

I'm actually calling BS on the whole "move to France permanently" line by the tabloid , because as an actual resident of an EU country that belongs to the SCHENGNEN Convention, I can personally tell that you have to actually establish residency FIRST with a temporary visa to live in these countries (including France) passing certain criteria over the course of 5 years before you can apply for permanent residency, whether single or married. Unless she's been living here on this continent for 5 years straight in an EU state that belongs to the Convention, she doesn't even have the opportunity to move here "permanently", so it doesn't even make sense for it to be reported that she's trying to take her daughter away to France ad infinitum.

Gabriel lied to the cops... unless Gabriel really started this (and there's no proof he did, it's just hearsay), I'm gonna believe what I believe. For now, Nahla needs to be put into some kind of foster agency before anyone makes any big plans.
