None of these people aren't acting as adults, even so we don't know this complete story about the mess; to throw around words such as calling her stupid? Please, don't go there...

Berry, Aubrey, and Martinez need to get their hot mess together. Courts don't always get it right (many times they get it wrong) but if there's no substantial evidence so far (the fight between Aubrey and Martinez notwithstanding) that Aubrey's an unfit to parent, Berry would be advise to get over it and try to co-exist with the guy for the sack of their child. If she's that concerned about her kid and the paparazzi move somewhere else in the States it's a damn big country, good grief.

They've all clowned too much for any of them to every become drinking buddies but they can make an effort to be civil. Whatever happened in that house is a case of he said / he said. I wouldn't be surprised if Aubrey was arrested because Berry got to the phone first. They'll be back in court in an attempt to hash out what happened. We'll Berry lose custody over this fiasco, not hardly. In many instances parents are ordered by the court to take conflict/resolution course(s). The court may order Berry (without her man) and Aubrey to drop off and pick up their child for Aubrey's visitation at a neutral location... Micky D's, Jack IN The Crack, Ralph's parking lot.

Whether Aubrey called Berry a Nigger, I wouldn't be surprised. There's a tendency for some whites to compartmentalize their attitudes about race; just because they've fucked or maybe liked you doesn't mean they can't and don't hold racist attitudes. Do those racist attitudes come out in the wash? Yes, eventually they do. But I know whites whom I work with every day who grin in my face and are racist as the day is long. They aren't aware that they made an assumption of speaking in front of someone whom they assumed was white. Whether Berry has picked when its convenient for her to be Black, I can't say. If she has she's not in a minority, a whole lot Black's play clueless about the issues of racism. my 2 cents.

There are two sides to every story. When Halle Berry’s ex-boyfriend Gabriel Aubry and current fiancé Olivier Martinez got into a bloody brawl on Thanksgiving day, the initial report was that the model started it all when he attacked Martinez after dropping off his 4-year-old daughter Nahla at Berry's home. Now, four days later, Aubry, 36, is telling his side of what happened that morning.

According to TMZ, Aubry was granted a restraining order from the “Unfaithful” actor, and in his declaration, he claimed that the day before the fight, he took Nahla (his daughter with Berry) to her school play, and when his ex and Martinez showed up, Martinez whispered in his ear in French, "I wish I could beat the s--t out of you right now. You're lucky we're in a school right now. We're going to take Nahla right now and you're not going to follow us.” That next morning, Aubry states, he brought the little girl back to her mother’s home, but instead of the nanny receiving Nahla as she normally does, Martinez appeared at the door and said, “We need to talk.” According to Aubry, he was walking to his car when Martinez jumped off the stairs and knocked him to the ground. As he beat the model, he yelled that he had cost him $3 million in lawyer fees (Berry and Martinez recently lost their bid to move to France with Nahla). I don't care about what happened, or who's the aggressor or whatever...I just googled both dudes out of pure curiosity on what they looked like and both dudes are pretty hot.

I too am what you could call disinterested in who did what, really. But let me ask you, you mean you didn't see Oliver in the movie "Unfaithful"? He does that steamy thing pretty well:

He also lives in France and Italy when he's not living in the States, but he's worked so long with Wilhemena in New York, I would imagine he long since has residency and has paid taxes in the US, so he would just be subject to the same laws as anyone else. It's very easy for models (especially of that stature) to get residency; actually most fashion industry people don't even have to show up at their own immigration proceedings when they settle into new countries; that's handled by agency reps and lawyers, along with the proper paperwork submissions when you first start out.

lol It's all about Nahla to me. nod I just feel Halle played as much a part in this as Gabriel (to a lesser degree) and Olivier did. And it upsets me how as a celebrity she's able to get away with certain stuff. I may have gone a little overboard though in my rant. evillol But I still meant it when I said Halle is a dumb ass and she WILL lose custody of that baby. wink

That's what I read somewhere last night, it's hard weeding through this stuff. Most of the time I don't even try.

If this is what really happened then, Martinez is totally out of line

It's obvious since Gabriel was granted an protective order

Any man this violent will end up hitting Halle

It looks like Gabriel was doing what he was supposed to, Halle knows Martinez had no business saying anything to Gabriel. Martinez has no say whatsoever in what happens between Gabriel Halle & Nahla

After this incedent, I can see Gabriel getting custody of the daughter

Gabriel goes on to allege that he turned his back on Olivier and walked towards his car. Gabriel then claims in the court documents that Olivier jumped off the stairs and knocked him to the ground before brutally beating him. Gabriel also claims in his sworn declaration that Olivier screamed that he has cost them $3 million in their custody battle.

Gabriel then claims in the court documents that Olivier took his head in his hands and slammed it on the concrete driveway and raged that the family was going to move to Paris and Gabriel should follow too or Olivier would kill him.

County Department of Child Protective Services will be formally re-opening an abuse investigation involving Halle Berry and Gabriel Aubry's daughter, Nahla, following the Thanksgiving brawl between her father, Gabriel Aubry, and her mother's current boyfriend, French actor Olivier Martinez, RadarOnline.com is exclusively reporting.

"Detectives from the LAPD formally contacted CPS after Gabe's arrest, because Nahla was present when the fight occurred," a source close to the situation tells Radar exclusively.

"Nahla wasn't actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla's environment is safe."

The cops were called, and both men ended up getting treatment at Cedars-Sinai Medical Center in Los Angeles. Aubry was booked on suspicion of misdemeanor battery, posted a $20,000 bond and has a December 13 court date.

Meanwhile, Berry has reportedly gotten an emergency restraining order to keep Aubry away. The two have been in an ongoing child custody battle. Berry was recently shot down by a Los Angeles judge who ruled that she couldn't move with Nahla to France, because Gabriel lives in Southern California.

Just because you are humping smeone it does not give you the right to interfere with a biological and PRESENT parent in the child's life.

That Martinez dude needs to sit down somewhere and keep quiet.

Halle is so wrong for allowing that to happen, oh and TMZ reported that Martinez was an ex-boxer, so he is a trained fighter. Its no wonder he hurt Gabriel so badly.

Halle must of known that and she is dead wrong for co-signing that mess. As Nahla's mother, she should do her best to keep the peace for Nahla's sake. disbelief

Aubry said he told officers to check the security camera footage after Martinez claimed it was Aubry who attacked him.

"Apparently the cameras were repositioned so it's not on tape," a source told The News Monday. “That’s a sign that someone’s innocent. He was begging to get the tape."

Aubry said he suffered a fractured rib, nasty bruises and multiple cuts that required stiches. He included gruesome photos in his filing that showed his right eye swollen shut with deep purple bruising and his left eye with a deep cut underneath...
