I think she should have 2 sever double the time he served:

LONG BEACH, Calif. -- A former high school football star whose dreams of a pro career were shattered by a rape conviction burst into tears Thursday as a judge threw out the charge that sent him to prison for more than five years.

Brian Banks, now 26, pleaded no contest 10 years ago on the advice of his lawyer after a childhood friend falsely accused him of attacking her on their high school campus.

In a strange turn of events, the woman, Wanetta Gibson, friended him on Facebook when he got out of prison.

It's been a struggle. But I'm unbroken and I'm still here today.

In an initial meeting with him, she said she had lied; there had been no kidnap and no rape and she offered to help him clear his record, court records state.

But she refused to repeat the story to prosecutors because she feared she would have to return a $1.5 million payment from a civil suit brought by her mother against Long Beach schools.

During a second meeting that was secretly videotaped, she told Banks, "'I will go through with helping you but it's like at the same time all that money they gave us, I mean gave me, I don't want to have to pay it back," according to a defense investigator who was at the meeting.

It was uncertain Thursday whether Gibson will have to return the money.

eek Are you fucking kidding me? This man lost years of his life and this bitch is talking about "well I don't want to have to pay back the money we won in the suit"....they should throw the book at her greedy ass.

i'm listening to him on the radio now on kfwb-am, a news station here in l.a.

like most men who've been falsely convicted, he talks about his faith in his innocence and how he knew it would only be a matter of time before the truth comes out.

i have to say that i've always found these men (and it's almost always men who've been falsely accused) to be really, really, really better people than i could ever hope to be. i just couldn't be so calm if it were me. however, i guess if they held on to that bitterness and allowed it to turn into rage, maybe they would be able to focus on their appeal or battle to exonerate themselves? i don't know, but this young man is amazingly composed under the circumstances.

what's even sadder is that the guy copped to rape because he was too afraid to go to trial and run the risk of being convicted of much more. if i'm not mistaken, kidnapping is a federal offense. fed charges are so much more severe.

the only reason i think she copped to it was that her conscience got the best of her, it seems. but notice how she doesn't want to give back the money. wouldn't that be considered fraud, insurance fraud of some sort? it'll be interesting to see how this shakes out.

I heard about this on the news this morning...extremely sad.

I see this happen so often at work, dudes getting railroaded because the PD's office doesn't have the staff, resources or sometimes even the will to properly defend the case, so they just advise people to take a plea. The worst thing is a lot of them never have the good fortune to get exonerated.

Don't get me started on the travesty that sometimes goes on in support and DV cases.

That chick should be made to surrender all the money/property that she and her mother possess and she should do some jail time for her hateful lies.
