Andre Davis Found Guilty In HIV Sex Trial

All 12 of the women who accused Davis testified that they had unprotected sex with him and he either never told them or lied about HIV, which can be transmitted through unprotected sex. The judge, citing medical privacy laws, prohibited attorneys from bringing up whether any of the women was infected with the virus.

Prosecutor Amy Tranter told WLWT that the case involved a great deal of testimony and that jurors considered evidence “step by step.”

“It’s an important case,” she said. “It’s a serious case.”

Tranter had said in closing arguments that Davis should go to prison for a long time, saying the case was about his responsibility to tell the women his test results.

Cohen, the defense attorney, had suggested that Davis’ accusers were promiscuous by having unprotected sex and multiple partners. He also said that a company — not a doctor — told Davis that he was HIV-positive.

The Cincinnati Enquirer has reported that World Wrestling Entertainment told Davis in July 2009 that it wouldn’t hire him because he failed his physical and tested positive for HIV.

Davis’ attorney said earlier in the trial that he didn’t think prosecutors could prove that Davis has HIV.

Tranter said that state law requires those who test positive for HIV to inform their sex partners of that statuses and that she didn’t have to prove that Davis is HIV-positive.

Davis faces similar charges in Warren County, north of Cincinnati.

What's interesting and also confusing about this case and how its been reported is that the defense attorney is essentially saying there's no proof Davis is HIV positive, yet he was fired from his pro-wrestling gig for failing his physical which showed his HIV status.

I'm wondering if he was mad about being HIV positive and wanted to spread it to others so they could suffer as maybe he feels he is.

this is an interesting legal precedent. for example, i wonder if it could open the door to lawsuits against the caregivers of a non-vaccinated child, if said child were to contract a disease and spread it to other children.

Good point. However, if I remember correctly, the condom broke with some of the women and I remember specifically one woman thought this dude was "her man" and they were trying to conceive a child; he has kids already with his girlfriend. He's just been laying it low and spreading it wide to too many females for me to keep track.

Still...with humans, being the little horny buggers that we are, protection from STDs requires both parties to be up front and honest and look out for each other. His health is already compromised so why compromise it further? I'm sure he didn't give a damn about his side women but he didn't even consider the health of the mother of his child waiting at home for him. He was ready to spread it to strangers and bring more home for the baby momma. Just trifling ass.

My guess is, that this is more about the financial burden put on the state when all these fools come poppin' up infected and needing treatment. The state has to put him away as a matter of public safety. Now these women have to go on a cycle of drugs to maintain their own health and who is to say their future children won't be born infected? Unless they have some good health insurance...who is footing the bill for their care?

I know several male womanizers, or "playas", as they liked to be called, and they have ZERO respect for women, even if she's his baby mama. They just care about one thing, getting in as many women's pants as possible. And they are going to tell you whatever they think you want to hear in order to get in your pants. So, ladies, wake up! Unless he's married to you, stop having unprotected sex with these men. It ain't worth it! And, no matter what they tell you, they aren't going to respect you afterwards.

One more thing... STOP BUYING CHEAP CONDOMS! And stop using those bootleg ones they give out free at these clinics! I ain't never had a condom to break cause I buy the good shit. When it comes to your life and your health, spend the extra buck or two on good condoms. It's worth it. Buy you some Trojons. Those suckers are STRONG!

This story is confusing to me. Does he or doesn't he have HIV? It's not like it's complicated one way or the other to prove. If he has it and somebody told him he has it and he didn't believe them, he was grown enough to find out for sure. Outside of that he didn't care whose life he screwed. Good riddence.

I was unclear at first but when he lost his pro-wrestling job because his health exam and blood work revealed HIV, then that is proof he is positive for the virus. Those wrestling organizations don't play and I think the boxing federation is the same way. You're talking men bleeding and sweating on each other and even biting each other (ala Mike Tyson) so they better be negative.

I wonder if the women will file a civil suit. Not saying dude has big bucks but they might be able to reach some sort of financial settlement against whatever money in the bank or insurance/retirement he has.
