SANTA ANA (KTLA) -- A 33-year-old Cypress man -- who prosecutors described as a "monster" -- was sentenced Tuesday to 25 years to life for the brutal beating death of his 2-year-old niece.

Michael David Balderas was given custody of little Jo Jade in 2005 when his sister was imprisoned in Texas.

Deputy District Attorney Michael Murray described Balderas as a "monster" to Superior Court Judge William R. Froeberg before sentencing, saying the little girl had been tortured and sexually assaulted. Murray told the judge that Balderas was not human, according to the Orange County Register. .

Balderas was convicted in January of second-degree murder and assault on a child likely to produce great bodily injury resulting in the death of Jo Jade on March 30, 2006.

The jury deadlocked at 11-1 in favor of first-degree murder because one juror did not find that sexual assault led to Jo Jade's death. The jury later agreed on second-degree murder. dunce

A doctor testified during the trial that Jo Jade had received the worst beating he had ever seen. The child, Murray said, had bruising on every inch of her lower extremities.

Prosecutors said Balderas beat his niece because she was dirtying her diapers. hmm [sexual trauma perhaps?]

The key evidence in the case was an 80-minute videotape of a police interview of Balderas shortly after the child died. In the tape, Balderas claimed he had warned her that such behavior was unacceptable and would result in more "pow pow" -- or more beatings.

In it, Balderas claimed he believed Jo Jade was intentionally defying him by continuing to mess her diapers even though he had warned her that such behavior was unacceptable and would result in "pow pow" – or more beatings.

While the child lay dying, Baleras played poker and surfed on the internet, the judge said.

He admitted hitting Jo Jade four or five times with his fingers and a belt on March 30, 2006 and didn't notice until later in the afternooon that she was unconscious. He then ordered her to take a nap. When he couldn't wake her up, he called his girlfriend and the couple took her to the hospital. Jo Jade was pronouced dead a short time later of her injuries.

I will never understand why those who don't want children continue to have them or even attempt to have custody, e.g. fosterering or adoption. Even if he was the only other relative to Jo Jade's mother it doesn't mean that upon her incarceration he was the most suitable person to care for the child. Now this.

Well I'd like to believe this isn't the alternative for every child in foster care or awaiting adoption. From what I've read there are upwards of 2 million kids in foster care and not enough people gay or straight to adopt them all.

When it comes to abuse, we definitely need more child advocacy laws on the books and we need to start investigating the backgrounds of adoptive families even if they are related to the child just to weed out any history of child endangerment. Seems like just because Michael Balderas was the uncle, they handed the baby over to him without checking his background. I'd bet he had a violent history. There's no way this baby should have gone to him.
