Lohan to be charged with grand theft

LOS ANGELES - Prosecutors said Tuesday they plan to charge Lindsay Lohan with felony grand theft of a $2,500 necklace reported stolen from a jewelry store last month — the most serious count the actress has faced in more than three years of trouble with the law.

District Attorney's spokeswoman Jane Robison said the charge will be filed Wednesday. Lohan, 24, is due in court for an arraignment on Wednesday afternoon.

Los Angeles police said Feb. 2 that Lohan was under investigation for taking a necklace from a Venice store later identified as Kamofie and Co. Detectives obtained a search warrant to try to retrieve the item from Lohan's home, but it was turned in to a police station before any search was made.

Police said they had no update on the case Tuesday and did not say whether the actress had made arrangements to turn herself in at court or at a police station.

Robison said bail would be decided by a judge.

A phone message to Lohan's attorney, Shawn Chapman Holley, was not immediately returned. Holley has previously denied any wrongdoing by Lohan.

"We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press," Holley said in a statement released Saturday.

The new case represents the most serious charges the "Mean Girls" star has ever faced. Arrested twice in 2007, Lohan was charged with drunken driving and drug possession, but both were misdemeanors.

Lohan remains on probation for drunken driving. A judge had threatened to throw her in jail if she ran into trouble again.

Prosecutors in Riverside County have been considering whether to press charges against Lohan for a December altercation with a worker from the Betty Ford Center, where she was being treated.

Lindsay Had Enough Cash For Jewelry Purchase


Lindsay Lohan had more than enough cash on hand when she took the $2,500 necklace out of an L.A. jewelry store ... sources tell TMZ.

TMZ broke the story ... the L.A. County District Attorney's Office will file felony grand theft charges against Lohan any day ... though we're told it won't be today.

Sources connected to the case tell us ... Lindsay had around $6,000 in cash with her because she had been eyeing a ring in the store, which was going for $3,400. Lindsay had gone to the store several times previously, debating whether to buy it.

Short story ... Lindsay had enough money to buy both the ring and the necklace on the day in question.

We've learned the surveillance video shows Lindsay walking out of the store wearing the necklace, without paying. In the video, the necklace is partially hidden by other jewelry Lindsay is wearing around her neck.

D.A. Focuses On Lindsay's... Shopping

Sources connected to the case tell us ... in deciding whether to prosecute, the D.A.'s Office heavily considered 3 incidents where Lindsay allegedly pilfered expensive items:

-- She was suspected of taking a $400,000 necklace in 2009 from an Elle Magazine photo shoot.

-- She was accused of stealing a $12,000 mink coat in 2008 from a NYC nightclub.

-- She was accused of taking a $35,000 Rolex from a "friend" in 2010.

Lindsay was not prosecuted or convicted in the three cases, but sources say prosecutors not only heavily considered the prior incidents in making their decision ... they will ask the judge to admit the three incidents into evidence to show "prior bad acts" if the case goes to trial.

Our sources say there are two other factors that weighed heavily in the decision to prosecute:

-- Lindsay has had repeated run-ins with the law, including two DUIs.

-- She repeatedly thumbed her nose at the legal system by failing to perform her probation requirements, blowing off court appearances (remember that trip to Cannes?) and acting disrespectfully before the judge (the whole fingernail thing).

As TMZ reported, the D.A. has a surveillance video which shows Lindsay walking out of a Venice, CA jewelry store with the $2,500 necklace in question. The necklace is partially hidden by other trinkets around Lindsay's neck.

Lindsay will be arraigned today at 1:30 PM PT. Lindsay will be in court, accompanied by her lawyer, Shawn Chapman Holley. Prosecutor Danette Meyers reps the people of the State of California.

Lindsay Lohan Accused of ...g Company

Lindsay Lohan is being sued by a mobile tanning company that claims they bronzed the actress up from 2007 to 2009 ... but she stiffed them on the $40k bill.

Lorit Simon claims Lohan hired her Nevada-based company, Tanning Vegas -- and the job required interstate travel when Lohan was craving a color change.

In the lawsuit filed last week in Nevada, Simon claims Lohan racked up $41,031.60 in unpaid charges -- and even now, she refuses to settle her debt.

Simon wants Lohan to fork over the money -- plus attorney's fees and interest.

Simon has sued Lindsay before -- accusing the actress of stealing her secret formula for a spray tanning product and selling it under her own Sevin Nyne label.

It just goes to show you how far fame, money, and pale skin goes in this country. If she had been poor, brown, elderly, had an accent, or possessed any number of undesireable traits as deemed by hollyweird....she would have been locked up after her first dui and would probably still be sitting in jail right now.

Lindsay Lohan Arrives At Court

LOS ANGELES, Calif. -- Lindsay Lohan has arrived at the Los Angeles International Airport Superior Court on Wednesday afternoon, where she is expected to enter her plea to a charge of felony grand theft over an alleged stolen necklace.

Access Hollywood is on the scene with live updates:

1:48 PM PST: Lindsay's bail bondsman is seated in the courtroom.

1:40 PM PST: Lawyers for both sides are in chambers with the judge.

1:29 PM PST: Lindsay and her attorney are now seated in court. The actress has a large diamond ring on her left hand, on her middle finger. Her nails look worn down. Two fingernails are painted pink, while all the others looked chipped. On the right hand she has a few gold and silver sparkling bracelets and a leather rope band on her left. Her sunglasses - Chanel - are on the table in front of her. She appears to be in a great mood, joking with her attorney and talking to one of the officers in a plain black suit, about his cars. No family or friends of the actress appear to be present.

1:13 PM PST: Lindsay is in a white dress with black heels and her lawyer is behind her in all black. Her entrance had a red carpet feel... As her car pulled up, she came out to a ton of camera flashes.

Upstairs in the courthouse, she is wearing dark shades and her hair is pulled back. She is being escorted by officers and is making a beeline to the court, passing all the reporters in the hall.

Judge CRUSHES Lohan -- 'D...our Luck!'

Lindsay Lohan was just remanded into custody -- following a STRONG warning from Judge Keith Schwartz -- "You're no different than anyone else ... please don't push your luck."

Moments after Lohan entered a not guilty plea in her felony theft case -- the judge came down on her like a ton of bricks ... telling her "things will be different" this time around because she's on the hook for a felony.

During the hearing, Judge Schwartz said Lindsay's lawyer, Shawn Chapman Holley, and prosecutor Danette Meyers, were going to meet to possibly reach a plea bargain.

Lohan -- alongside attorney Holley -- was then remanded into custody ... and is currently being booked.

Judge Schwartz set her bail at $20,000 -- but warned, "If you violate the law, I will remand you and there will be NO BAIL."

The judge also revoked Lindsay's probation in the DUI case and set bail at $20,000 -- so total bail is $40,000.

Lohan was also ordered to refrain from contacting the jewelry store during the case, after Meyers said someone had sent the store owners flowers, which kind of freaked them out.

LOS ANGELES, Calif. -- It was Lindsay's day in court and Access Hollywood was on the scene with all of the updates from inside the courtroom.

1:53 PM PST: The lawyers exit the judges' chambers and the judge calls the case.

After Shawn Chapman Holley enters Lindsay's plea of not guilty, the judge issues a stern warning, telling the actress, "You are no different than anyone else."

He revokes her probation and sets two bail at a total of $40,000.

At one point, those in the courtroom laugh when Lindsay's attorney says she's passed all of her drug tests and has been a model probationer.

The case is pushed to February 23.

Although the judge says she still has to go through the booking process like anyone else, she is not handcuffed as she is led out of the courtroom, and escorted through another door.

I think the problem for Lindsay now is that all of the drama has completely overshadowed her career and it's sad. There are probably a bunch of people who can't make the distinction between her and Paris Hilton, Nicole Richie, etc even though she's the one with the legit job. She's an actress. And she's really good.

It's like the movies she makes now don't even matter. She doesn't get any press for any of them. We're all still stuck in 04 with Mean Girls.

She still has a chance but she just keeps piling and piling and piling shit on top of each other instead of laying low. She should have moved out of LA a long time ago.
