"Oksana recorded the conversations without Mel's knowledge. In California, if a person isn't told their conversation is being recorded, it is not admissible in court.

There are exceptions -- notably, if Oksana reasonably believed the conversation related to the commission of any felony of violence, she could make the recording without Mel's permission.

Here's the problem. TMZ has learned Oksana sent Mel several text messages in which she clearly states she recorded the conversations because Mel didn't keep his part of the deal to support her.

We're told Mel's people will use Oksana's text messages to try and prove it was just a money grab, which would make the recordings inadmissible in both the custody case and any possible criminal case.

Sources connected with Oksana say ... if she was motivated by money she would not have rejected Mel's $15 million settlement."

We already covered the legal aspect in the other thread and they would be admissable because he was threatening her with physical harm which IS allowable under the law. Her texts aren't going to change that.

She stated that the tapes were produced because Mel didn't keep his part of the deal to support her. Legally what she did could invalidate those tapes from being used as evidence since their purpose was to secure monetary support from Gibson, NOT protection.

It's all a question of LAW and how the court chooses to INTERPRET what Oksana has done. If the court feels convenced that these recordings of Gibson where made soley with the intent EXTORT money, then those text messages may come back to hunt her.

They sure as hell would be admissible if the government made them without your knowledge. And they could get your ass locked up without a trial, too. Gotta love this country!

True! The court system is STRANGE! I have a lawsuit going now and there's plenty that can kill a case even if you have one. LEAKING THOSE TAPES TO THE PUBLIC WAS NOT A GOOD COURT MOVE ON OKSANA's PART. Their going to look at...
