This is a strange one.....


ODESSA, Texas -- A West Texas student who led his high school basketball team to the state playoffs last season was actually a 22-year-old man, police said Tuesday.

Police say the basketball star was really Guerdwich Montimere, a naturalized U.S. citizen from Haiti who school officials say was recognized last month by Florida coaches as having been a star high school player in Fort Lauderdale, Fla., a few years ago.

Ector County school district officials said the man posed as 16-year-old Jerry Joseph and enrolled at Permian High School in Odessa for the 2009-2010 academic year. He also presented himself as homeless to the school's basketball coach, Danny Wright, who took the boy in last summer, the coach said.

That is so fucked up. It's bad enough this dude felt he needed to lie about his age and living status just to get into high school but to also take the lie further and start sleeping with teens is just ridiculous. Not sure how I feel about the sex assault charges. This girl willingly had sex with him but now that she found out he was 22 and not 15 (where in the world do 22 year olds look 15 anyway) she wants to rat him out to the cops? Talk about some ass backward morality. He should do whatever minimal prison sentence is required for falsifying state documents (school records) and that's all. I feel bad for the girl that felt she was deceived but come on....you're a 16 year old dropping your panties for a male jock you think is 15? She sounds just as shady as Joseph aka Guerdwich aka haitian hustler.

It illustrates why we need to have better ways to determine a persons Identity.

Did he force this girl? Sounds like she willingly laid with him then got mad when she found out he wasn't a year younger than her. I wouldn't necessarily classify that as rape unless he flat out seduced her knowing full well she was under age. In that scenario it is statutory rape not a sexual assault. Sexual assault implies a situation where one person is forced or a person who is unaware or incapable of consenting to a sex act. Meh...what do I know. There is such a difference between the law and what's right and sensible.

If your 15 year old daughter said she wanted to have sex with a 40 year old would you approve? His age be it 22 or 102 make no legal difference, nor does that she was lied to about his age. Now if she lied to him, I would have some sympathy. But he is the one that lied not her. And I am not going to victim blame.

I agree that he should be deported but 20 years in prison? Hell no. I hate rapists but given this scenario I cannot include him in the same category as say those green bay packers players accused of sexual assault or even that mary kay letourneau (sp), the teacher that seduced her student had his kid and married him.

If this Guerdwich fellow had really been 15, he would not be in jail and neither would she as they would have both been minors having consentual sex. Since he is 22 and she didn't like that he was 22, or somebody else perhaps didn't like it, he gets the rape charge added. Frankly I think it's a bit of a set up. There is probably no harsh punishment for impersonating a high schooler and leading your team to the play offs. What's happened here is sheer embarassment so they had to find something more dirty and sticky and indeed criminal. They get this teen girl who says she had sex with him and sex with a minor even though said minor consents is illegal. My argument is that what happened between this dude and his 16 year old booty call should have a different defintion other than rape. If we're going to call sex between two consenting persons, one of whom tells a lie about who they/where they came from/how old they are, then hell everybody has been raped at least once in their lives.

And before we say she couldn't consent to sex simply because she was 16...what if she had committed murder? Her age would probably be moot. She could be charged as an adult. Why is it nonconsentual when it involves sex but consentual when it involves every other type of illegal action like drugs, murder, speeding, stealing or jay walking? I don't want to eliminate the law of statutory rape mind you but I just think that for this particular situation...it's bullshit. They just want to humuliate and punish this dude for making asses out of them.

If I had a 15 year old daughter stupid and whorish enough to want to sex up a 40 year old man I'd probably have her committed to a mental institution or at least beat her ass.
