It's a 3rd Degree Rape charge Being twenty-one (21) years old or more, he or she engages in sexual intercourse with another person less than seventeen (17) years old; (NY Law)
The Prosecution will have to PROVE he knew how old she really was for that to stick but I don't see how, when their star witness keeps telling anyone that will listen that she walked into a dark motel room. He asked her age and she personally told him she was 19.
