Writing Hot Checks!!!! My husbands SSI and Disability monthly check of $1086 usually goes into our bank account on the 3rd of every month and that is the day when we write out a check for our monthly rent of $846(the reason its so high is because right now we are living in one of those greedy-assed Assisted Living Care Apartment complexes with onsite medical care services, etc.). And our monthly checks are usually processed in 24/48 hours time after the check is submitted to the office. Anyway, after taking into account the rent check, we would have a total of $255 left in the bank, so since our submitting of the rent check we have done some CAREFUL shopping and everything!! The thing is, today we did some shopping, with the asumption that our rent check had already been processed, and then decided 2 go to our banks ATM 2 check our balance and we noticed that we still had $847 in our account and so I went up 2 the counter and asked if our rent check had gone through and it hadnt and it wasnt even in the pending file of our banks computer system either waiting 2 b processed!! The thing is, what we have paid for today will also go through, which means that there wont b sufficient funds 2 cover the rent check, so that means that in all honesty the rent check is a Hot Check!!!!
This is our last month of living in this place cos we have been evicted(these assholes have evicted a couple one of which is disabled no less anyway) due to a total cock-up on the part of the landlords of this place asking that I personally pay rent as well as my husband and I flew back to the USA on the asumption that I didnt have 2 pay rent!! So, anyway, what is the procedure now regarding Hot Checks?? Will we b arrested or what?? Thanks!!!! [Edited 3/6/10 13:14pm] | |

my aunt just wrote a bunch of bouncy lil checks the past month....trust, no one arrested her. lol, they will probably pass it through and charge you a horrendous fee...or not pass it through and still charge you a horrendous fee | |

Ex-Moderator | Whether your rent check was cashed or not, you still know how much money you have... so you must have been planning to bounce the check at the grocery store instead of for rent.
Either way, yeah, you're gonna get returned check fees. |

They won't close your account if it's the only bad check you've ever written in your life. But if you have a history of them, then it's possible. And yeah, if you bounce checks all the time you won't be able to open a new account. |

I personally think that our landlords and the CEO of this Assisted Living Complex are being total assholes to us and making us sweat, cos they have the State up their asses cos they have commited an unlawful eviction!! We have had the State of Minnesotas Ombudsperson come down and had meetings with us!! | |

If you talk to the bank and tell them whats going on, they will probably let the check clear instead of returning it, and charge you overdraft fees... If they do return it usually the person sends it in for a second time.. Unless you have a history of this one bounced check is no big deal... Also, they way it worked at my bank, when someone wanted to open an account that had been turned into check rite or whatever credit place they use, the teller took it to the bank manager for approval... Its up to them to decide if they will let you open it... Usually they let a person open them unless you have really bad check writing habits... They can also put all different types of holds on your accounts or you may have to maintain a certain balance... ~~~~~ Oh that voice...incredible....there should be a musical instrument called George Michael... ~~~~~ | |

As long as you speak to the bank and don't have a history of this, you should be fine. If you really fear the bank are about to yank your account, open up some new accounts with other banks quickly. once you get bad credit in the us it can be hard or impossible to open up new checking accounts in any state. if you have some on stand-by, you can at least cobble onwards with banking facilities. Got my mojo working...it just don't work on you!

Sounds like her choices are limited one way or another and at least then she'll be able to get another place. Gonna do it next month with her $200 bucks? Believe me, I'm a landlord and I think I'd pay to get her out this way rather then an eviction which actually could cost 6 months rent that you'll never see. Although why do I actually give a ratt's ass? It's Saturday night and I'm talking to strangers on the computer...fuck, I've bottomed out. The reason our landlords did us wrong was that when I was in the UK last year, My husband moved into this place cos social workers and everything decided that this was a "safe" place for him 2 b so that he could be kept an eye on regards his health and his meds, but they never really sat down with him 2 discuss his finances and how much he got and whether he could afford 2 live in this place to start with and everything, and also his ex-social worker got him 2 sign papers when he wasnt perfectly well and in a sound mind(so really those lease papers are considered null and void legally anyway). Anyway, me, my parents, social workers and Joe and the Director who worked here at the time, we all got into teleconferencing and really we couldnt get straight answers 2 simple straight questions as whether I PERSONALLY had 2 pay a rent as well!! This went on for months, untill finally a month before I flew over we FINALLY got the answer that we have been months trying 2 get from these jerks - NO, I DIDNT HAVE 2 PAY MY OWN RENT ONLY FOR MY MEALS IN THE DINING HALLS HERE!! So, we thought, well thats fair enough, so I booked flights, flew 8000 miles from the other side of the world and arrived here on the 14th of Dec and they KNEW that i was coming over here 2 live permanently and everything!! So, fast forward 2 1/2 months and then one day the new Director who started here in January suddenly hit me with this bombshell that they wanted MY rent and it all snowballed from there!! I went ballistic and everything and it eventually got 2 the State Ombudsperson who is on our side and now we have contacted Legal Aid and everything!! Then because I refused 2 pay rent cos I have no personal income anyway due 2 the fact that immigrants and other movers have 2 b in the state of MN for 3 months before they can apply for cash assistance and also its getting more and more hard 2 find work now cos of the weather and online applying, last Tuesday we were issued with a formal written notice of eviction!!!! its been a total nightmare for about 2 weeks for us, but now we have found a new apartment in Glencoe, MN and we are moving out on the 31st of this month!!!! | |

Such as it is my parents are wiring over money to us, left, right and center so that we can get groceries, pay bills that arent included with the rent, and keep our car on the road!!!!
