Macy's / Bloomingdales class action lawsuit.... haha! Commission related...
I worked for Bloomingdales for approx 3 months during the X'mas holidays some years back to gain a bit of insight on retail. I was asked if I wanted an hourly wage or commission so I chose commission because my manager seemed to push it saying stuff like, if you sold $4000 you would get a commission check of say $400. I don't remember what the exact rate was then. The first month I got a check for X dollars, can't remember how much but not more than 2000. The second month half those goods were returned and the check was half of what I expected. The third month, same thing. The fourth month, I had a minus check... ie I owed Bloomingdales for working for them? Anyway I also noticed, during returns for size exchanges one sales woman was returning merchandise I sold the day before and putting it under her own number thus cutting me off my commission. Anyhoo... I chalked it up to bad experience and moved on I had no intention of being a sales person for the rest of my life anyway. So, a few months back, I received a note from a legal team representing plaintiffs in a class action lawsuit against Federated Stores and so I told them about my experience. Apparently there was an investigation by the Dept of Labor and now Federated has to fork out a few million dollars... [Edited 1/30/10 11:49am] | |

Good! That commission racket is a bunch of I put myself thru college by working in retail. The same thing would happen where I worked- but if you were caught re-ringing an exchange under your number, you were written up. But still... heffas were sneaky about it. A funny aside: Whitney Houston frequented the store where I worked. NO ONE wanted THAT commission! She was mean and ignorant toward salespeople. Actually that was the second time I was contacted by an attorney regarding sales practices by Federated stores. The first time was for a class action lawsuit regarding their discrimination practices toward black and ethnic shoppers. I did notice some sales people following black shoppers around the store to make sure they were not shop lifting. In a store like Bloomingdales they felt that only white women with/without money were allowed to shop there. [Edited 1/30/10 10:26am] | |

I've sold and managed on commission for almost 20 years and I've NEVER HEARD that your commission is deducted when an item is returned... never!
Now that one lady who was commission switching should have been fired on the spot! I hope justice serves you well!! A working class Hero is something to be ~ Lennon | |

Actually I approached the manager with copies of receipts of the purchases and they ignored them. The sales person in question was their favorite and had worked there for a number of years. I had confronted her, initially she said it was not my sale she returned but later when she saw the receipts I showed her, she said the customer was her "regular". BS. so i guess then you could add yourself to the list..
i would.. i worked for federated way back when it was becoming.. jordan marsh,maas brothers ,burdines..worked in the warehouse in tampa when they put all the stores together and eventually made it just burdines.. and now it's macy's.. there was alot of discrimination there.and in their individual stores.. i used to shop in burdines in t shirts and jeans..and except for being followed around, was basically ignored..there was always a sales associate nearby,but almost never an offer of assistance.. the one that did come up to me and ask always got my business..to the dismay of the ones who ignored me..when i shopped there it was for certain things..and it was not really a small sale.. i'm white but i dressed like i had no money..and most of them ignored helping me,but were watching like a hawk.. and i still do shit like this.. so you joining the class action.. or letting them off the hook?? were it me i would not 'why y'all trying to say goodbye? I didn't go anywhere, I'm right here, im all around you,always..'

The only people who make any money in a class action lawsuit are the attorneys. They are just a scam to make money for lawyers. They will collect 50 percent of any settlement plus expenses and everyone else will get $20 or something similar if they jump through a bunch of hoops that are designed to make you not collect any money.
BTW - the return policy make sense cause otherwise what is to keep you from just having all of your friends go in and buy $1,000's in clothes and then simply return them to make you some money? I mean it does seem as if they were being a little crooked if they were acting as if everything you sold was being returned but the return policy makes perfect sense to me. | |

I mean it does seem as if they were being a little crooked if they were acting as if everything you sold was being returned but the return policy makes perfect sense to me. probably most true.. many years ago i joined a class action against baby formula maker similac.. they were accused of price goughing..charging way too much for what it cost to manufacture and distribute.. anyway..class action won.. and i got a check for $3.60 i aways meant to get it framed.. i may still have even.. and it's been over 15 years 'why y'all trying to say goodbye? I didn't go anywhere, I'm right here, im all around you,always..'
