No, a prenuptial agreement contract can't be void because either party has cheated unless, it was specicfically written in the prenuptial agreement. I don't know of any self-respecting lawyer who would advise their client to sign such an agreement. Elin's lawyers could have requested a "cheating clause"; she would recieved a lump sum and/or an increase in montary payments monthly or yearly if she could prove her husband cheated on her. Tiger lawyers could have requested something along the same lines too.

If Elin is angling to have their prenup revised (as some have claimed) it's probably because she knows if the marriage dissolves'before the 10 year mark she could be vulnerable, financially. Granted she and her kids won't be living in a 3 bedroom condo eating tv dinners while her could be ex is living high off the hog in 8,000 square feet homes around the world but depending on what was agreed upon, her spousal benefits may not be enough take care of her and the lifestyle she's become accustomed to living in the long term. Besides, Florida is among the States that passed a law two years ago that makes it harder to challenge a prenuptial agreement on unconscionability. So, what's ever in that prenup she'll have to adhere to.
