Lawsuits ... is it worth fighting for your rights or not? Personally I think the whole judicial system is like organized crime. Only the courts, lawyers and judges make money... everyone else loses. | |

That's a very narrow view. There's always some amount of dirty somewhere, but you can't blanket the whole organization from a bad taste in your mouth. One man's trash is another man's treasure. The courts aren't making money. They're funded by the state. Judges get paid by your tax dollars, not a share of a settlement. Yes, lawyer's get paid, but I never understood the bad rep lawyers get. They're the first ones someone call to get their dumb ass out of trouble w/ a ticket or worse, yet the constant butt of jokes. Lawyers go through a LOT of training, which is often ongoing throughout a career, just as doctors, hairstylists, or even a musician.
I say all that to say, don't over judge a broad picture, based on a bad seed here or there. The justice system works, when it's used properly. Everything is flawed, and the justice system is no different. I agree w/ RenHoek.....it's a case by case basis as to what you should do, and how far you should pursue it. | |

OK, let me explain... unfortunately I am currently involved in a lawsuit. The judge decided part of the case on summary judgement against me. I don't understand why he would allow us to proceed and allow our motion to strike SJ if he was going to decide the case on SJ.
Why incur the extra expenses in lawyer fees drafting out documents if they are not needed? We were going to proceed with discovery, depositions etc. and now all of a sudden the judge wakes up in the middle of depositions and decides one part of the case on SJ? My first lawyer was the son of a judge and at first when I hired him I figured he was smart. Wrong! If you have never been to law school and are smarter than your lawyer it is never a good thing. So I had to fire him and retain another lawyer who specializes in the field of work my case is based on.... I have had to rework some of the paperwork my old lawyer worked on and now we are going to file a separate case in court against the other party. and so this saga continues...
