I don't know about anywhere else but in Illinois if you sell a gun to a felon you can get up to 10 years. | |

If they broke the law in the course of the sale (didn't register it, weren't licensed to sell, whatever), then yeah - I'd think they may have some cupability.
They almost certainly don't know what the buyer intends to do with the gun, but this is one situation where the term "should have known" applies. I think a reasonable person should know that someone who wants to buy a gun outside the terms of the law may have bad intentions. Kind of like how the bartender who knowingly serves a drunk patron that goes out and kills someone on the road is held partly responsible. . [Edited 7/20/09 7:35am] | |

Well, in the McNair case dude was a felon and violated his parole, for a murder conviction BTW, so he shouldn't have even had a gun to sell in the first place. I'm still trynna figure out how he got out after a murder conviction. They must have mandatory release in his state. He definitely needs to be charged in the McNair case and be in jail for the rest of his life. | |
